This procurement procedure is the main stage of the project "Reinforcement of the Retel Coreher Integrated Voice-Data Communications by M.A.I. at national level ", code ROFSIP2017SO6A14P02, financed by the Internal Security Fund, the component for police co-operation. The aim of the project is to increase the security of voice and data communications at the territorial structures of the Ministry of Justice, ensuring all the necessary access to the operational information systems implemented-and the training of the staff responsible for network management.

Main Site: M.A.I. from the municipality of Bucharest and from all the municipalities of the county.

Running of the "Core RCVD Main Contract", related to the project "Strengthening the core of the Integrated Voice-Data Communication Network of MAI at national level", according to the product quantities in the Tender Book.

Core RCVD - Versusprincipal name: the name of this supply contract. This contract contributes to the fulfillment of the majority of the result indicators of the project "Strengthening the Core of the Integrated Voice-Data Communication Network of the MIA at national level", shortly referred to as "Core R.C.V.D."; the objectives of the project will also be achieved through the execution of secondary contracts that are subject to procedures(including the Leader) will present the documents and forms mentioned in the above mentioned contract. The bidder / the associated tenderer, the supporting party and the subcontractor, and if the offer is submitted by an association, each associate (including the leader) this chapter.

In order to prove the fulfillment of the requirements, DUAE will be completed, according to art. 193 fromLaw 98/2016, at the request of the contracting authority, to submit the supporting documents related to those assumed by completing the DUAE, only by the bidder ranked first in the ranking drawn up at the completion of the evaluation of the bids.

These documents may be: Finding certificates on the absence of overdue debts in respect of payment of taxes, taxes or contributions(2) The judicial record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of the persons having the power to act in the general budget (local budget, state budget, etc.); representation, decision or control within it, as evidenced by the certifying certificate issued by ONRC /the constitutive act; 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

4) Other editing documents, as appropriate.

If applicable, bidders will present with the DUAE a list of third party / subco identification datathe contractors, in order to comply with the provisions of art. 63 par. (2) of Law 98 / 2016.

Note:

The contracting authority will exclude from the procedure any bidder / associated offeror / third party / subcontractor who is in any of the situations provided in art. 58 63, art. 164, art. 165 and art. 167 of Law no. 98 / 2016.

All documents requested by the contracting authority will be dleaked by electronic means in SEAP, in the dedicated section, signed with the extended electronic signature, based on a qualified certificate, according to the Law no. 455/2001, republished, regarding the electronic signature. In the event that the electronic signature certificate does not belong to the legal representative of the bidder, a power of attorney will be given.

Documents issuedin a language other than the Romanian language will be presented in the language in which they were issued, accompanied by an authorized translation in Romanian. All the documents will have, besides the signature, clearly mentioned the full name of the signatory.

Global turnover for the last 3 years (2015, 2016, 2017) is at least 35 356 406 RON without VAT. Values will be expressed in RON. For converting RON / other currency, the ECB's average annualized rate for that year (2015, 2016, 2017) will be used. If a group of operators isconomics submit a joint offer, then the economic and financial situation is demonstrated by taking into account the resources of all the members of the group, applying the provisions of art. 31 par. (3) of H.G. 395/2016. The financial statements or extracts from the financial statements - balance sheets for the financial years for the last 3 financial years ended (2015, 2016, 2017)-targeted by the authority where the receipt has been filed or will be submitted attesting the submission by electronic means. If, for objectively justified reasons, the tenderers are unable to submit the required documents, they can demonstrate their economic and financial situation and other documents reflecting the economic and financial situation. Autothe contracting authority has the right to ask the tenderers for the submission of other documents, if the nominations are not relevant .. According to the provisions of art. 139 par. (3) of H.G. no. 395/2016, if two or more bids are ranked first, with equal scores, the tie will be made taking into account the score obtained by the rating factors in descending orderhas their weights. If the equality is maintained, the contracting authority has the right to request new financial proposals and the winning bid will be the one with the lowest financial proposal.

Any bidder has the right to withdraw his offer only before the deadline set for submitting the offer. The tenderer is obliged to inform the contracting authority about any changes made to the certified statements by presenting the documents requested to the head. III.2) and III.3), within a maximum of 7 working days from the intervention or afterz, to be aware of these changes.
