1) Reasons for criminal convictions

The DUAE Form (Part III - Exclusion Reasons) completed with the reference data / information in accordance with the provisions of Article 164 of the Law no.98 / 2016.

The DUAE will be provided for each entity participating in the awarding procedure, such as a bidder, associate, subcontractor or third party.

The contracting authority will request the supporting documents for the qualification criteria to be awarded to the bidder ranked first in the application criterion award. The tenderer has the obligation to present justifiable documentscases demonstrating the fulfillment of the undertaken by completing the DUAE, such as: - a criminal record for the tenderer and for persons who are members of the administrative, management or supervisory body of that tenderer or have the power to represent, decide or control as it results from the certifying certificate issued by the ONRC / constitutive actany foreign document considered to be edifying in the country of origin or in the country in which it is established, such as self-declaration, certificates, criminal records or other equivalent documents issued by the competent authorities of that country, accompanied by authorized translation in Romanian.

Each entity participating in the award procedure will-complete the DUAE, the supporting documents being submitted by the economic operator (respectively bidder, associate, subcontractor or third party) ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders, at the request of the contracting authority, 2) Reasons for the payment taxes and social security contributions:

- documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 (if applicable)

For foreign bidders, any document deemed to be edifying in the country of origin or in the country in which it is established is accepted, such as own-account statementscertificates, criminal records or other equivalent documents issued by the competent authorities of the respective country, accompanied by authorized translation in Romanian.

How to access the DUAE for completion by operators interested parties by mentioning the following link: https://ec.europa.eu/growth/tools-databases/espd/filter./ The clarification requests will be-the address in Romanian, through SEAP, the "Questions" section of the electronic award procedure, and the responses to them will be published in Romanian, in SEAP, in the "Documentation, clarifications and decisions" section of the tender notice. In order to submit clarification requests, economic operators must register in SEAP (www.e-licitatie.ro):

The Evaluation Committee will forward the clarification requests regarding the offer, in Romanian, by using the technical facilities available in SEAP ("Questions" section) The economic operators will send the answers to the clarifications and any documents requested during the evaluationthrough the SEAP (the "Questions" section), in full in the section corresponding to the respective request, in electronic form, in the form of one or more separate signed documents / files signed with the electronic signature according to the provisions of Law 455/2001 on electronic signature.

All the documents / documents relating to the award procedure submitted by the offeror(the offer, requests for clarification, answers to the clarification requests) will be written in Romanian or will be accompanied by the authorized translation in Romanian
