The Quantities of Natural Gas are Estimated.

The bidders, third parties and subcontractors will prove that does not fit into the situations provided by art. 164, art. 165, art. 167.

The manner by which the fulfillment of the requirements can be demonstrated: Will be presentedthe DUAE by the bidders / candidates (including associates / subcontractors / third parties) as the first proof of non-compliance in exclusion situations and the fulfillment of capacity requirements in accordance with art. 193 par. (1) of Law 98/2016, and the supporting documents consist of: - the criminal record of the economic operator and the members of the administrative body, management or supervision of the respective economic operator, or those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / Act of incorporation, - Certificate regarding the payment of the obligations to the local budget and to the consolidated general budget confirming the lack of overdue debts at the time of their depositthe payment of taxes, duties or contributions to the consolidated general budget proving the fulfillment of the obligations assumed by the DUAE shall be submitted at the request of the contracting authority, only by the first ranked bidder in the interim ranking of the tender evaluation; in the provisions of art. 59 and 60 of Law 98/2016 on apublic calls will be completed and deposited by all participants in the procedure with the submission of the DUAE; The economic operator (leader, associate, third party, subcontractor) will fill in the corresponding requirement in the DUAE form in the awarding documentation:

The failure to do so with the DUAE is the basis for requesting clarification of any inadvertent form of informationincluded in the DUAE sections of both the tenderer / candidate and the subcontractor / third supporter, this being necessary to ensure the proper conduct of the award procedure.

General information on unit activity: Annual average turnover over the last 3 years, an average global turnover figure over the last 3 years (2016, 2017, 2018) at least equal to RON 1, 200, 000.00. For a unitary assessment of how the requirement is met, the annual average RON / EUR exchange rate communicated by the NBR for each year will be applied for the calculation of equivalence.

In accordance with the legislation in force (Emergency Ordinance No. 146/2002, with further modifications, regarding the formation and utilization of the resources carried out by the State Treasury), the collection and payment operations between the public institutions and the economic agents shall be carried out only through accounts opened with the State Treasury, it being obligatory for the contractor to open such an account to the treasury in whose radius Territory has its headquarters.

The procedure for awarding the procurement contractthe public contract is initiated under this suspension clause in the sense that the conclusion of the public procurement contract is conditioned by the allocation of the budgetary credits for this purpose, the signing of the contract being made in compliance with the provisions regarding the commitment of the expenditures from the budgets falling under the public finance legislation
