The bidders, third parties and subcontractorsactants should not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated:

The original DUAE (Single European Procurement Document) will be completed by the tenderer / affiliate / third party / subcontractor, with the information relating to their situation as the first proof non-compliance in situationsexclusion and capacity requirements (see DUAE User Guide developed by ANAP available at www.anap.gov.ro) in accordance with the provisions of Art. 193 195 of the Law no. 98/2016, corroborated with Art. 65 of H.G. 395/2016 and the provisions of the ANAP Notification no. 240/2016 on the DUAE User Guide (Economic Operators).

Documents justifydocuments demonstrating the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting authority, only by the economic operators placed on the first 3 places, following the application of the award criterion, according to the provisions of art. 196 par. (2) of the Law no. 98/2016 on public procurement.

The DUAE will be completed by the economic operators participatingthe award procedure with the information related to their situation. The economic operators who participate on their own will submit a single DUAE.

Operators who rely on the capacities of other entities (third parties / subcontractors) will submit their own DUAE and a separate DUAE for each of the entities on which they rely. economics submitting a bid in asocieties will submit one DUAE for each member of the association, including its leader.

These documents may be:

1) The tax attestation certificate regarding the lack of overdue debts to the consolidated general budget, issued by the competent fiscal body, within the area of which the headquarters social economic operator, valid at the time of presentation (according to ANAF Order No. 3654/2015); 2)-The certificate regarding the lack of overdue debts regarding the payment of taxes, social security taxes and social security contributions at the registered office, the secondary offices, as well as the point (s) for which there are payment obligations, valid at the time of presentation (according to Law no 227 / 2015 - Fiscal Code); 3) The judicial record of the economic operator and of the members of the administrative bodymanagement, or supervision of the respective economic operator or of the decision-making or controlling power within it, as follows from the certifying certificate issued by the ONRC / Act of incorporation; 4) as the case may be, documents proving the fact that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 ofLaw 98/2016 on Public Procurement; other editing documents, as appropriate; 5) Tenderers who participate in the awarding procedure individually or jointly with other economic operators, including in the forms of temporary association established for the purpose of participating in the award procedure, the supporting third parties and the declared subcontractors, shall not find a conflict of interest with anyonehas the following persons holding decision-making positions within the contracting authority regarding the organization, conduct and finalization of the award procedures.

- A "Conflict of Interest Statement" will be presented with the DUAE by all participants in the award procedure (tenderer, associate, subcontractor and third party) - (Non-incumbent statement)in the provisions of art. 59 and art. 60 of Law no. 98/2016)

1) Modalitather bidding with the same price that is ranked first: If two or more bidders are ranked first in the ranking of the financial offers, the contracting authority will forward to the SICAP a ground. to clarify the submission of new improved financial proposals, and op. economic agents will send responses using the facilities provided by SICAP.-If two or more bidders are ranked 2nd in the ranking of the financial offers, the contracting authority will submit to the SICAP a request for clarification regarding the submission of new improved financial proposals and the economic operators will send the answers using the facilities offered by the SICAP. These financial proposals can be improved without modificationranking first place. For the improved financial proposals that affect the first place in the ranking, the initial financial proposal will be considered. Similarly, if two or more bidders are ranked No. 3 in the ranking of the financial bids, the previous paragraph will apply without changing the 2nd place in the ranking. If after the deposit(2) If the number of admissible tenders is less than 3 (three), the contracting authority will conclude the framework agreement with op. economic agents who have submitted admissible tenders;

3) Mandatory and specific contractual clauses are found in the model contract-(see contract terms). 6) Communication rules:

- The clarification requests related to this tender documentation will be exclusively addressed to the SICAP, signed with an electronic signature, at the "Questions / Grounds" section. clarification "of the award procedure by electronic means, and the responses to them will be published in the SICAP atthe "Documentation and Clarification" section of the notice of participation, in accordance with the provisions of Article 160 paragraph (1) of the Law and Notification No 247 issued by ANAP on 6.9.2016, the contracting authority not to comply with the requests addressed by another way of communication than the one established by the awarding documentation,
