Gas distribution. - Unlimited tender for comprehensive gas fuel supply.

Reference Number: ZPZ-46/10/18

1. The subject matter of the order is comprehensive gas supply to SP ZOZ MSWiA from W-MCO in Olsztyn including:

Main Site: Independent Public Health Care Center of the Ministry of the Interior and Administration with the Warmian-Masurian Oncology Center in Olsztyn, -al. Wojska ...

1.) Supply (sale) of high-methane gas group E for own needs,

2.) Transmission and distribution of gas fuel to the point of interconnection, which is a set of gas appliances located in the building at al. Wojska Polskiego 37.

2. Estimated demand for gaseous fuel in the period of 24 months is: 9 372 178 kWh.

3. Gaseous fuel sales and benefitsdistribution services will be held on the conditions specified in: Energy Law with executive regulations, Civil Code and relevant Tariffs approved by the Energy Regulatory Office. Contractor whose tender was rated as the most advantageous in the proceedings to confirm compliance with the conditions for participation in the proceedings, at the request of the Employer, will submit the above-mentionedthe following documents marked by the Ordering Party, not shorter than 10 days: • the current concession of the President of the Energy Regulatory Office for trading in natural gas, issued in accordance with the provisions of the Energy Law, • current license of the President of the Energy Regulatory Office distribution of natural gas, issued in accordance withnotices of the Energy Law Act in the case of Contractors who own the distribution network or • Contractor's declaration on having a valid general agreement with the Distribution System Operator (DSO) for the provision of distribution services in the area where the natural gas supply is located in the case of Contractors who are not the owners of the network distribution.

O-ordering may be requested by Contractors who:

1.) They are not subject to exclusion from the proceedings,

No grounds for exclusion will be verified on the basis of the submitted statement together with the offer in the form of a Single European Order Document as per Annex 3 to the ToR and required documents .

2.) Meet the conditions for participation in the proceedings regarding: a.) Kompetenor the authority to conduct a specific professional activity, if it results from separate regulations; - the Employer requires that the Contractor should have: • the current license of the President of the Energy Regulatory Office to operate in the scope of natural gas trading, - current license of the President of the Energy Regulatory Office conducting operations in the field of natural gas distribution in case ofwith Contractors who own the distribution network, - issued in accordance with the provisions of the Energy Law Act

Or

Has a valid signed general agreement with the Distribution System Operator (DSO) for the provision of gas distribution services in the area where the natural gas supply is located in the case of Contractors not being the owners of the distribution network,

Additional infoOrmacje rejection of the offer:

The Contracting Party rejects the offer, if:

1.) is inconsistent with the Act;

2.) its content does not correspond to the content of the Essential Terms of the Order, subject to art. 87 par. 2 point 3 of the Act,

3.) Its submission constitutes an act of unfair competition within the meaning of the provisions on combating unfair competition;

4) contains a grossly low price in relation to the subject of the contracta;

5.) was submitted by the Contractor excluded from participation in the proceedings for the order or not invited to submit offers;

6) contains errors in the calculation of the price;

7.) The Contractor within 3 days from the delivery of the notification did not agree to correct the mistake referred to in art. 87 par. 2 point 3 of the Act,

7a) the contractor did not give consent, referred to in art. 85 ust. 2, on the front- 7b) the bid was not filed or was filed incorrectly, if the Ordering Party demanded payment of the tender bond,

7c) the variant offer does not meet the minimum requirements specified by the awarding entity,

7d) its acceptance would violate public safety or significant security interest state, and this security or interest can not be guaranteed-in another way,

8.) is invalid on the basis of separate provisions.

The ordering party does not specify the condition of participation. This condition will be fulfilled if the Contractor and the offer submit a signed declaration in the form of a Single European Order Document according to the template on Annex 3 to the ToR;

Information on the submission of joint offers:

16.11. The Contracting Authority allows the possibility of submitting offers-common.

16.12. In the case of Contractors who apply jointly for the award of a contract, attach a document of the power of attorney to jointly represent in the contract award procedure or to represent and conclude a contract for the order and the required documents for each partner separately. The power of attorney should be submitted in the form of an original or a copy certified by a notarynot.

16.13. The appropriate fillings of places dotted in the form of documents constituting attachments to this SIWZ and included in the offer may be made by computer, machine or manual.

16.14. Documents prepared independently by the Contractor based on the models constituting attachments to this Specification must be in the form of a computer printout or typescript.

16.15. Zamahe recommends that the entire offer be made in a form that prevents it from being unintentionally removed, the sheets (cards) of the offer must be stapled, bound or joined together in a different technique.

16.16. The Contracting Authority recommends that all the sheets (cards) of the offer you have written are numbered consecutively.

16.17. All places in the offer, in which the Contractor has made corrections or changes to the entered prself content (ie only in places where it is allowed by the Employer) must be initialed by persons authorized to represent the Contractor).

16.18. Documents included in the offer may be presented in the form of original or certified copies of the original. The compliance with the original of all copies of the documents included in the offer must be potby the authorized representative (representatives) of the Contractor, (in accordance with the document setting out the legal status of the Contractor or attached to the offer). In the case of submitting electronic documents, they should be signed by the contractor with a secure electronic signature verified by a valid qualified certificate.

16.19. In the case of contractors jointlyNot applying for the order and in the case of other entities, on the resources of which the contractor relies on the principles set out in art. 22a of the Act, copies of documents concerning respectively the contractor or these entities are certified as true copies by the contractor or these entities, respectively. - The condition of participation in the proceedings is to make the bid bond in the correct amount.The bank determines the bid bond in the amount of PLN 14, 000. The bid bond must be submitted before the deadline for submission of tenders. In order to demonstrate preliminary lack of grounds for exclusion from the proceedings, the Contractor submits the following documents: Declaration on no grounds for exclusion from proceedings in the form of a Single European Order Document according to Annex 3 to the ToR. According to art. 24 sec. 11 The right of public procurement The Contractor, within 3 days of the date of publishing the information, will provide the Employer with a declaration of affiliationor not belonging to the same capital group as referred to in art. 24 sec. 1 point 23 of the Public Procurement Law. Model statement about the membership or absence of belonging to a capital group constitutes Annex 4 to the Terms of Reference - Contractor whose tender was rated as the most advantageous in the proceedings, in order to confirm the absence of grounds for exclusion, at the request of the Employer, shall submitby the Ordering Party, the following documents, not shorter than 10 days: 1.) an excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the lack of grounds for exclusion under Article . 24 sec. 5 points 1 of the Act,

2.) Information from the National Criminal Register in the scope ofin Article 24 sec. 1 items 13, 14 and 21 of the Act, and regarding conviction for a prison sentence to the extent specified by the Employer pursuant to art. 24 sec. 5 and 6 issued not earlier than 6 months before the deadline for submitting bids,

3.) Contractor's statement that he has not issued a final court judgment or final administrative decision on his defaulting paymentm of taxes, fees or social security or health insurance premiums, or in the event of issuing such a verdict or decision documents confirming payment of such receivables with possible interest or fines or conclusion of a binding agreement regarding repayment of such receivables;

4) Contractor's statement about the lack of a decision to him as the preventive measure of the prohibitionapplying for a public order. 5.) a certificate from the relevant organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of offers or other documentthat the contractor has concluded an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained legally required exemption, deferral or installment payment of overdue payments or suspension in full of the decision of the competent authority; the head of the tax office confirming that the contractor-it is not in arrears with the payment of taxes, issued no earlier than 3 months before the deadline for submission of tenders or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the legally required exemption, postponement or spreading overdue payments into installments orb suspension in full of the implementation of the decision of the competent authority;

7) declaration of the contractor on the non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016 item 716).
