The contracting authority will respond to the clarifications on the 10th day before the deadline of biddingNumber of days to which clarifications may be requested prior to the deadline for submission of tenders / applications: 15.

The way to prove the fulfillment of the above mentioned requirements:

- The declaration of non-compliance with potentially conflicting interests will be submitted by bidders, third parties and subcontractors with the DUAE.

The supporting documents will be requested by the contracting authority only for the first ranked customer in the interim ranking after complete the e-auction stage

These documents will be:

- certificates regarding the lack of overdue debts, regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget and state budget) at the moment of presentation, - the criminal record of the economic operator and of the members of the management body, or oversight of the respective economic operator or those having the power to represent themdecision, or control within it, as evidenced by the certifying certificate issued by the ONRC / constitutive document, - other editing documents, as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on public procurement. (A) a form of registrationin accordance with the law of the country of residence, that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment, and that he has the professional capacity to perform the activities covered by the contract. which can be demonstrated to meet the requirement:

- the DUAE will be filled in by the economic operatorsparticipants in the award procedure with the information related to their situation.

The supporting documents proving the fulfillment of the undertaken by completing the DUAE are:

(a) Certificate issued by ONRC or, in the case of foreign tenderers, equivalent documents issued in the country of residence, be submitted, at the request of the contracting authority, only by the class tendererThe subject of the contract must have a correspondent in the authorized CAEN code from the certifying certificate issued by the ONRC (according to article 15 of the Law 359/2004),

(b) it will be placed on the first place in the intermediate rankings after the completion of the electronic auction stage. present natural gas supply license issued by the National Regulatory Authority for Energy for the activity ofnatural gas to non-household consumers, according to the Law no. 123/2012 and the framework conditions for the validity of the natural gas supply license - valid at the moment of presentation, in original, legalized copy or legible copy with the mention "according to the original" - Note:

- The supporting documents will be requested by the authority contract only to the pis the first place in the interim ranking, after the completion of the electronic auction stage, - the bidder ranked first will be asked, if necessary, before submitting the communication on the outcome of the award procedure, submit the original documents for compliance. Average annual turnover, calculated over the last three calendar years (2015, 2016, 2017)

Interaction with bidders and the bidding process will be conducted according to the following rules:

- To view the awarding documentation uploaded in SEAP, -economic operators must have a necessary program to view the electronically signed files (e-signature providers' websites); - Rules for communication and data transmission: Requests for clarification regarding this tender documentation will be exclusively addressed to SEAP at the "Questions" section of the award procedure conducted by meansand the responses to them will be published in SEAP in the section "Documentation, clarifications and decisions",

- In order to submit requests for clarifications regarding the awarding documentation, the economic operators will register in SEAP (www.e-licitatie.ro) the provisions of Article 5 paragraph (1) of GD No. 395/2016 and will transmit the requests taking into account the response deadlinesof the contracting authority referred to in art. 160 161 of Law no. 98/2016,

- For subsequent posting submissions, the evaluation committee will forward requests for clarification regarding the offer by using the technical facilities available in the SEAP ("Questions" section),

The way in which the interested economic operators can access the DUAE in the completion will be done through-access to the following link: https://ec.europa.eu/growth/tools-databases/espd/filter, -- The evaluation commission will analyze the DUAE in correlation with the requirements set out in the acquisition data sheet,

- The evaluation committee will analyze and review each offer in terms of the proposed technical elements, and then in terms of the financial aspects it involves. Following completionthe contracting authority will enter the accepted / rejected result in the SEAP and will open in the SEAP the session for submission of the supporting documents related to the DUAE submitted by the bidder on the first place in the interim ranking made at the completion of the evaluation of the tenders, a deadline to answer,

- Economic operators will forward replyclarifications and any documents requested during the evaluation of the offers through SEAP (section "Questions") in electronic format, signed with electronic signature, according to Law 455/2001,

- Economic operators will observe the model of service contract.

Note: The way of ranking the first ranked prizes with equal prices:

- Oddsit will be done solely on the basis of the price and not by the quantification of other technical elements or other advantages resulting from the way the economic agents perform the contract, - In order to divide the bids, the contracting authority will request the submission in SEAP of some new financial offers (the procedure being carried out entirely by electronic means)
