Requirement 1:

Tenderers, supporting third parties and subcontractors must not findin the situations provided for in art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the economic operators participating in the award procedure will be filled in with the information related to their situation. The DUAE thus completed will be electronically transmitted to SEAP with the extended electronic signature.

The supporting documents that provethe fulfillment of the undertaken by completing the DUAE shall be presented, at the request of the contracting authority, only by the bidders placed on the first three places in the intermediate rankings drawn up at the completion of the evaluation of the tenders. These documents may be:

1) certificates of absence of debts regarding the payment of taxes, taxes or contributions to the general budget(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those with the power of representation, decision-making (local budget, state budget, etc.) at the moment of presentation; or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act;case, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

4) other editing documents, as the case may be

Requirement no. 1

The economic operators submitting a deposit must prove a form of registration in accordance with the law of the country of residence, it should appear that the economic operator is legally constituted, that he is not in any of the situations of cancellation of establishment and that he has the capacity professional activity to perform the activities covered by the contract. Documents edwhich proves the registration form as a natural or legal person and, as the case may be, attestation or affiliation in accordance with the provisions of the country in which the tenderer / candidate is established This certificate must be presented in original only by the ranked tenderers on the first three places after applying the award criterion (including the bidAssociate partner or supportive third party, as the case may be). 2

The bidders shall prove that they hold a valid natural gas license issued by ANRE in accordance with art. 22 par. (2) of the Order no. 29 / 28.6.2016 for the approval of the Regulation on the supply of natural gas to final customers issued by ANRE, as well as art. 8 of the Law on Electricity and Natural Gas no. 123/2012. This certificate must be presented in original only by the bidders placed on the first three places after applying the award criterion (including the affiliate bidder or the supporting party as the case may be).

If it is found that the first ranked offers have equal prices, the authority the contracting entity will seek clarification through SEAP for the electron loadice by economic operators of a new offer. In this case, the bidder will modify the form in which he will mention the price offer per unit of measure without VAT, in RON with at least two decimal places. If even after this re-registration, equal prices are recorded, a new referral will be requested through SEAP.
