Natural Gas Purchase at All Consumption Points of the Somes Water Company, listed in Annex 1 of the Tender Specifications

The minimum and maximum quantities set by the contracting authority are those specified in the specification and represent estimates of quantities that wouldcould be requested throughout the entire framework agreement and not the exact quantities to be purchased, the latter being likely to be smaller, equal or higher than estimated, depending on the actual needs of the contracting authority. The minimum and maximum estimated quantities that could be the subject of a single subsequent contract are listed in Appendix 1 to the loading listi. The bidders, the third parties, the subcontractors (if known at the time of submitting the offer) of the bidder, shall not be in the situations provided for in art. 72, 177, 178 and 180 of Law no. 99 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with the informationrelated to their situation. DUAE will be filed, as the case may be, by the third party and the subcontractor.

The following documents will be submitted with the DUAE: the firm's firm commitment of the third party to support the way in which its support will materialize (Form 9), the subcontracting agreement (Form 10) if the subcontractors are known at the time of submission of theThe declaration of non-compliance in Article 72 of Law 99/2016 shall be submitted with the DUAE by the tenderers, third parties and subcontractors (if known), and / or the Association Agreement (Form No. 3), as the case may be. at the time of submitting the tender), according to Form 2.

- as the case may be, documents proving itthat the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Law no. 99/2016 on sector acquisitions, other documents, as appropriate.

Foreign bidders will present any editorial documents issued by the competent authorities of the country of origin or of the country where the tenderer is established to prove otherwisefulfilling the above requirement in accordance with the legislation of the country of origin or of the country where the tenderer is established.

The documents will be accompanied by their authorized translation in Romanian.

The information from the documents presented will be real and current at the time of the presentation;

If, following the application of the award criterion, the evaluation committeefinds that two or more offers are placed first, the contracting entity will ask the economic operators for a new financial proposal and the framework agreement will end with the economic operator whose new financial offer has the lowest price.
