Award of a public-private partnership contract for the achievement of the "Ploiesti Highway Braşov" objective, in accordance with Government Emergency Ordinance No. 39/2018

Construction and Operation Works for the Objective "Ploiesti Highway Braşov (Cristian) ", according to the OUG no. 39/2018 on public-private partnership. ProjectFor Ploiesti Braşov (Cristian), important works of art, including 14 viaducts and 33 bridges with a total length of approximately 3 km, as well as 2.6 km of double-galley tunnels, represent one of the most challenging engineering challenges complex. At the same time, road nodes, motorway access roads are included, as well as ensuring the continuity of existing roads-which the highway might interrupt, the relocation of the various utilities network that the highway affects, hydrotechnical works and mitigation of the impact on the environment. The construction costs cover not only the running surface, but also the many visible parts of the motorway, but also numerous other works that make this tread surface to a high level.Main works: The works will be carried out in the locations / areas described in the Fundamental Study.

Construction and operation works for achieving the "Ploiesti Highway Braşov (Cristian)" objective, in accordance with GEO No. 39/2018 on the public-private partnership. The project foresees important works of art for Ploiesti Braşov (Cristian) sector, including 14 viadducts and 33 bridges with a total length of approximately 3 km, as well as 2.6 km of double-galley tunnels, representing one of the most complex engineering challenges. At the same time, there are included road nodes, motorway access roads, as well as ensuring the continuity of existing roads that the highway could interrupt, the relocation of the various utilities network that the highwayto affect it, hydrotechnical works and mitigation of the impact on the environment. The construction costs cover not only the running surface, but also the high side of the motorway, but also many other works that make this tread surface to a high level of quality. These are important earthworks, as well as consolidation of the slopes due to the profilegeological and geotechnical aspects of the area covered by the highway, works whose stability is directly influenced by the execution of a vast and judicious system thought and achieved by taking over and removing meteoric or infiltration waters. In addition, there are a variety of other highway project specific works such as traffic monitoring, road marking and signaling, Emergency Calling System, ITS (IntelligentTrafficSystem), toll system, maintenance centers, service and parking spaces. By awarding a public-private partnership contract governed by O.U. no. 39/2018 regarding the public-private partnership, aims to achieve the strategic objective set by the Government of Romania by issuing the Decisionno. 357/2018 regarding the approval of the List of strategic investment projects to be prepared and awarded by C.N.S.P.

1) The bidders, the supporting third parties and the subcontractors must not be found in any of the similar situations provided in art. 164, 165, 167 of Law no. 98/2016 on public procurement, as subsequently amended and supplemented. How to do ite: The bidders, the private partner, the association of the private partners, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98/2016 on public procurement, as subsequently amended and supplemented. The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be completed by the participating economic operatorsto the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE will be requested by the contracting authority for the first ranked bidder in the interim ranking made following the application of the award criterion, 132 par. (2) of the Methodological Norms for the application of the provisions-concerning the award of the public procurement contract / framework agreement of Law no. 98/2016 on public procurement, approved by H.G. no. 395/2016, as amended and supplemented. These documents may be: - - tax accreditation certificates regarding the lack of overdue debts, regarding the payment of taxes, duties or contributions to the general consolidated budget (budget lohorse, state budget, etc.) at the time of presentation, - the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have the power to represent, decide or control in its framework, as it results from the certifying certificate issued by the ONRC / constitutive document, - as the case may be, in which it is demonstrated that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement, as subsequently amended and supplemented, - other editorial documents, as the case may be.

Economic operators shall submit, during the evaluation, at the request of the contracting authority, documented documentsupdated to demonstrate the fulfillment of the qualification criteria, according to the information contained in the DUAE, according to art. 196 par. (1) of the Law no. 98/2016 on public procurement, as subsequently amended and supplemented; 2) Bidders, supporting third parties and subcontractors are not in any of the similar exclusion situations mentioned in art. 59 60 of the Law-no. 98/2016 on Public Procurement, as subsequently amended and supplemented.

Way of Completion: Completion of the DUAE and Form no. 1 which confirms that the economic operator is not in any of the situations of exclusion mentioned in art. 59 60 of the Law nThe contracting authority requests that the economic operators / tenderers submitting a tender to prove a registration according to the law of the country of residence, to prove that the economic operator is legally constituted, that he is not in any of the situations of cancellation of establishment, and that he hasthe professional capacity to provide the products that are the subject of the acquisition.

Bidders are required / required to have a positive cash-flow indicator of at least EUR 680 000 000 excluding VAT for the years 2016 and 2017. Formula to calculate the cash-flow: estimated contract value / period(2 years - 2016 2017).

The bidder must demonstrate that the average annual turnover for the last 3 years (2015, 2016, 2017) was minimal: EUR 1 360 000 000 without VAT

If, following the application of the calculation algorithm, there are two or more equal-ranked tenders, the contracting authority will award the contract to the tenderer whose financial proposal has the most great score. The tenderer may take part in the opening of tenders only if he empowers a person, and he must present a mandate toand the time set for opening offers.
