The company will have to complete the Single European Tender Document attached to the tender documents as indicated in the Disciplinary of the tender.
The tender procedure is managed with the Telematic system called Sintel, accessible from the website www.arca.regione.lombardia.it. Description and method of use for the presentation of the offer are specified in the Tender Regulations, relative Annexes and technical manuals available on the website www.arca.regione.lombardia.it. The Sole Manager for the Procedure pursuant to Legislative Decree 50/2016 and the dott. Roberto Toniolo.
All communications and information exchanges must take place via the Sinte platforml.
The rules for participation in the tender, the Specifications and the outcomes, the clarifications are published on the website www.sanita.padova.it under the heading and can be obtained at the same address as in point I.3).
The Contracting Authority reserves the unquestionable right, also with reference to the single lot, to:
a) suspend, cancel, revoke, re-direct and modify, or re-open the termsof this procedure with motivated provision, without the companies being able to claim rights or claims of any kind or incurring liability and / or request for damages, compensation or compensation from the competitor and / or potential bidder not even pursuant to art. 1337 and 1338 of the Civil Code;
b) cancel / revoke the awarding procedure, without the participant / bidder being able to do sopay any compensation / indemnity claim for expenses incurred in the event of the stipulation of a centralized procurement procedure at the regional level or CONSIP if the prices published by the Observatory of the Supervisory Authority of the products being tendered should occur;
c) not proceed with the awarding if no offer is suitable or suitable in relationto the contractual object, and / or for reasons of public interest, pursuant to art. 95 of Legislative Decree 50/2016;
d) not to award the present procedure in the event that, at the end of the technical evaluation, only one valid offer remains, except for the hypothesis in which it is objectively infungibile and / or exclusive, or particularly advantageous
Pursuant to paragraph 35 of the art. 34 deLaw 221/2012, the cost of publishing the extract from the tender notice as required by Legislative Decree 50/2016, will be charged to the contracted companies.
The Contracting Station, in the case of incomplete documentation, it will be able to assign to the competitor a term, not exceeding 10 days, for the necessary declarations to be integrated or regularized, thencandidates the content and the subjects that must render them, under penalty of exclusion from the tender.
The contract will not contain the arbitration clause.
