Reasons forexclusion: The bidders, the third party supporters and the subcontractors must not be found in the situations provided by art. 164, art. 165 and art. 167 of Law no. 98/2016 regarding public procurement. The way in which the requirements can be demonstrated: the DUAE will be completed by the economic providers participating in the award procedure with the information related to their situation. withIn view of the fact that the procedure is carried out exclusively by electronic means, the DUAE Form is completed by the bidders directly in the SICAP. In case of submission of an individual / joint offer financially and / or technically-professional supported by third parties / third party supporters, eachthe grinder has the obligation to demonstrate the fulfillment of the requirement.

Fitting in one or more of the situations provided in art. 164, art. 165 and art. 167 of Law no. 98/2016, attracts the exclusion of the tenderer from the procedure for the award of the contract.

Failure to submit the DUAE together with the offer (including for the associate / third party supporter) entails its rejection as unacceptable.

The supporting documentsassets that prove the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, by the tenderer ranked first in the intermediate ranking prepared at the end of the evaluation of the admissible tenders.

B) For foreign bidders: Documents for proof of eligibility, issued bythe competent authorities of the country in which they are resident (certificates, court records, other equivalent documents) regarding the lack of outstanding debts regarding the payment of taxes, taxes and contributions to the state budget and the local budget, at the time of presentation. These documents will be sent in the language in which they were issued, in a certified copy "according to the original", signed and stamped by the legal representative, accompanied by an authorized translation of these into Romanian.

In accordance with the provisions of art. 196 of Law 98/2016, in the situation in which the documentssupporting documents are not available in electronic format, at the express request of the contracting authority, transmitted as a result of the completion of the evaluation process and the drawing up of the classification of the admissible tenders based on the award criterion, the tenderer (individual economic operator or members of the association) ranked first in the intermediate ranking, will demonstrate the fulfillment of the requirement, priin the presentation of the documents listed above (for Romanian and foreign bidders), which will prove the statements included in the DUAE (answer) to the requested fields, demonstrating that: - the economic operator is legally constituted in the country of origin, the market its professional activity.
