The object of the future procurement contract is the supply of food, 58 of assortments, divided into six lots, according to the specifications, namely:

Supply dairy products 5 assortments according to the details in the specifications.

1. The bidders (all members of the association), third-party supporters, subcontractors must not be found in the situations provided in art. 164 of Law no. 98 / 2016.

Bidders (all members of the association), third-party supporters, subcontractors will complete the corresponding requirementre in the DUAE form in the award documentation. Framing in the situation provided in art. 164 of Law no. 98/2016 regarding public procurement attracts the exclusion of the tenderer from the procedure applied for awarding the public procurement contract. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented only by the tenderer classified on the primul place after applying the award criterion, until the date of the conclusion of the award procedure report, according to art. 196 paragraph (2) of Law no. 98/2016 on public procurement;

2. The bidders (all members of the association), the third-party subcontractors must not find themselves in the situations provided in art. 165 and art. 167 of Law no. 98 / 2016.

Bidders (including all members asocierii), third parties, subcontractors will complete the corresponding requirement in the DUAE form from the award documentation.

Except for the situations provided by art. 166 of Law 98/2016 and art. 165 para. (2) of Law 98/2016, the framing in the situation provided in art. 165 or 167 of Law no. 98/2016 regarding public procurement attracts the exclusion of the tenderer from the procedure applied foru award of the public procurement contract. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented only by the tenderer ranked first after applying the award criterion, until the date of the conclusion of the award procedure report, according to art. 196 paragraph (2) of Law no. 98/2016 on public procurement.

The supporting documentssome that will be presented by the bidder ranked in the first place, in order to support those declared in the DUAE for fulfilling the requirements regarding the failure to comply with the provisions of art. 164, 165 and 167 of Law 98/2016 are:

(i) certificates confirming the lack of outstanding debts, regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation;

(ii) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control in its framework, as it results from the certifying certificate issued by the ONRC / the constitutive act;

(iii) as the case may be, documents throughwhich proves that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement;

(iv) other building documents, as the case may be.

Non-resident (foreign) economic operators have the right to present any building documents, issued by the authorities of the country in which they are resident, andequivalent to the above. In this case, the documents will be presented together with their translation into Romanian, carried out by an authorized translator;

3. In order to apply art. 59 and 60 of Law no. 98/2016, for the detailed provisions of art. 167 para. (1) lit. e), the economic operator (all members of the association), including third-party supporters and subcontractors, together with dthe qualification documents will present its declaration regarding the conflict of interests, related to the persons with decision function within the contracting authority regarding the organization, the development and the completion of the award procedure, namely:

(i) Cotirleț Adrian legal representative, manager;

(ii) Găman Oana financial-accounting director;

(iii Țuștiu Simona Irina chief purchasing officeii;

(iv) Dobrovat Elena Garofita legal adviser;

(v) members of the Board of Directors of SMU Moinesti Armeanu Mădălina-Constanța, Cehan Bogdan Petru, Lucaci Cecilia, Nastasa Alin George, Nimerceag Ioan;

vi) Adrian Vatamaniuc administrator of the supplier of services auxiliary to the procurement (SC 3P Consulting & Projects SRL CUI 33893890, J04 / 1134/2016).

Bidders (all members of the associationii), third-party supporters, subcontractors will submit their declaration on the conflict of interest, at the time of submission of the offer in the section "Qualification documents". (all members of the association), including third party supporters and subcontractors and will take overas at the time of submission of the offer in the section "Qualification documents".

Warning: declarations regarding the conflict of interest completed by the third party supporters and the subcontractors participating in the procedure will be signed with an extended electronic signature specific to each third party sponsor / subcontractor (electronic signature is not accepted of the tenderer).

If the tenderer participates lproceeded together with subcontractors or third-party supporters, then the DUAE will be presented separately drawn up and assumed by each of these economic operators involved in the preparation of the offer. His DUAE will also present his commitment to support, accompanied by doccurrences transmitted by the third party (s) / supporter (s), from which to effectively show how he / she will / will ensure the fulfillment of his / her own commitment commitment, documents that will be annexed to the respective commitment.

If the tenderer intends to subcontract parts of the future public procurement contract, then, together with the DUAE of the subcontractorproposed, the subcontracting agreement assumed by the parties, in which the part (s) of the contract to be eventually subcontracted (s), together with their quantification (value, in lei or relative, in percentage) will be presented explicitly.

Requirement 1.

The economic operators submitting the offer must prove a form of registration in the conditions of the law of the country of residence, in order to reso that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution, as well as the fact that it has the professional capacity to carry out the activities that are the subject of the public procurement contract.

Method of fulfilling the requirement 1: the economic operator bidder will complete the corresponding requirement in the DUAE form from the award documentationthe ranting ranked on the first place after applying the award criterion, until the date of the conclusion of the award procedure report, according to art. 196 paragraph (2) of Law no. 98/2016 regarding public procurement, to prove the fulfillment of this requirement, will present a certificate issued by the Trade Register Office next to the territorial court, valid at the date of presentation, from which it was settledlte information regarding its situation.

The content of the certificate must show that the activity of the tenderer must correspond to the object of the future public procurement contract. with the activities of each associate / subcontractor, I agreem of the association / subcontracting agreement concluded between the parties.

The foreign natural or legal persons will present the document equivalent to the one requested above, issued by the competent authority of the originating state of the tenderer.

1. The interaction with the bidders, respectively the process of evaluating the bids will be carried out according to the following rules:

(a) To view the award documentation stillbroken in SEAP / SICAP, the economic operators must have a program necessary to view the electronically signed files (they can be identified on the websites of the electronic signature providers);

(b) Data communication and transmission rules: requests for clarifications made by the potentials bidders, referring to this award documentation, will be addressed exclusively through SEAP, in the section related to the award procedure carried out by electronic means, and the answers to these will be published in the SEAP, both through the box where the request for clarifications was received, as well as in the section "Documentation, clarifications and decisions" of the simplified participation announcement, according to the schedule provided in section II.1.4) of this data sheet;

2. In the casein which, within a lot, after the completion of the stage of application of the award criterion, two or more admissible and compliant offers occupy the first position in the ranking, having the same minimum price, in order to award the contract, the respective bidders will be requested (for separation) a new financial proposal, in which case the contract will be awarded to the bidder whose new proposalfinancial has the lowest price
