Framework agreement on the public procurement of various foods

Reference Number: 255 / 30.01.2020

Framework agreement on the public procurement of various foods for D.G.A.S.P.C. Vaslui. Based on the framework agreement, 4 subsequent supply contracts will be drawn up. Delivery will be made in subordinate centersto D.G.A.S.P.C. Vaslui. The estimated period for the implementation of the framework agreement is approximately 14 months, from 1.5.2020 to 30.6.2021. Economic operators will be able to request further clarifications / information 10 days before the deadline for submitting tenders. The contracting authority will respond to requests for clarification before the deadline for submission of tenderon the 4th day. The value of the largest subsequent contract is min. 363.48 and max. 491 015.68 RON excluding VAT.

Main Site: Centers subordinated to D.G.A.S.P.C. Vaslui specified in the specifications.

Various food products in the quantities, conditions and with the requirements specified in the specifications.

Requirement no. 1. Statement on your own responsibility regarding the non-classificationin any of the situations provided in art. 164, 165 and 167 of Law no. 98/2016. The bidders, the third party supporters and the subcontractors must not find themselves in the situations provided in art. 164, 165 and 167 of Law no. 98 / 2016.

The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with informedilles related to their situation.

Requirement no. 2. Presentation of the declaration regarding the failure to comply with the provisions of art. 59 (avoiding conflict of interests) of Law no. 98/2016 Form 2 of the "Forms" section will be completed by all participants and will be uploaded to SEAP with DUAE.

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked in the first place in the intermediate rankingr drawn up until the completion of the evaluation of the offers. These documents can be:

- certificates certifying the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation,

- the criminal record of the economic operator and the the members of the administrative, management or management bodyproof of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document,

- as the case may be, documents proving that the operator economic can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law no. 98 /2016 regarding public procurement,

- other edifying documents, as the case may be.

The Romanian legal tenderer ranked first will have to present these scanned documents in SEAP. at the town halls and the financial administrations they hold or issued by the competent authorities of the country in cthe bidder is resident. To the extent that the procedure for issuing the certificate does not allow confirmation of the debt situation on the requested date, the bidder / candidate may submit a declaration on his own responsibility, according to art. 168 of Law no. 98/2016 for the fulfillment of the requirements 1-3.

If there are uncertainties regarding the situation of an economic operator the contracting authority has drept to request information directly from the competent authorities.

1) The economic operators who submit tenders must prove a form of registration in the conditions of the law in the country of residence, that they are legally constituted and that they are not in any of the situations of cancellation of the constitution., as well as the fact that they have the professional capacity to carry out the activity that is the subject of the contract.

Annual general turnover. Global turnover for the last 3 years (2019, 2018, 2017).

The way in which DUAE can be accessed in order to be completed by the interested economic operators: SICAP. the contractor will request the submission of new price offers through SICAP. The division of the offers will be reported the equal offers from the first place.The economic operators will electronically upload documents containing the new prices, following the first 2 offers containing the lowest price to be declared the winners. The contract will be concluded with the operator ranked in the first place. The bidders will present a declaration accepting the contractual clauses contained in the contract model from the award documentation, otherwise it will be considered thathas tacitly accepted the contractual terms
