Contracting Authority The Arad Penitentiary will respond cand complete all requests for clarification / additional information up to the 10th day before the deadline for submitting bids. The Arad penitentiary will conclude the framework agreement for supplying food on lots (Lot 1 - Pork in frozen work, Lot 2 - Pork sausages, Lot 3 - Yoghurt) for a period of 15 months with 1 economic operator. Subsequent contracts will end withthe economic operator signing the framework agreement as required.

1) Requirement: tenderers, third party supporters and subcontractors should not find themselves in the foreseeable situations to art. 59 60, 164, 165, 167 of Law no. 98/2016. Mode of accomplishment: DUAE will be completed by the operatoreconomic times participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders. Along with DUAE will also post FoArticle 1, respectively, the Declaration on non-compliance with the situations provided in art. 60 of the Public Procurement Law 98/2016; 2) Requirement: certificates on the lack of overdue debts regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation; required - required requirement. How to do itAnnotation: The DUAE will be presented, completing the sections related to the required requirements. For Romanian legal / physical persons will be presented supporting documents, respectively certificates confirming the payment of taxes and duties to the consolidated general budget and the local budget, and for foreign legal / physical persons will be presented editorial documents issued by the competent authorities.in the country of residence, to prove the payment of outstanding debts to the state budget and the local budget in accordance with the legislation of the country of residence at the time of filing these documents. The aforementioned documents will be submitted only by the bidder ranked first at the request of the contracting authority upon completion of the tender evaluationNote:

1) The failure of the DUAE with the offer (including the associate / third party supporter) entails its rejection as unacceptable; 2) The following documents will be submitted with the DUAE: the firm's firm commitment of the third party in which it will materialize its support, the subcontracting agreement and / or the association agreement, as the case may be. Failure to do so oncewith the DUAE is the basis for requesting clarification of any inaccurate form of information contained in the DUAE sections of both the tenderer / candidate and the subcontractor / third party, which is necessary to ensure the proper conduct of the award procedure. 1: the documents requested by the tenderer ranked first in(a) certificates on the absence of overdue debts in respect of the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of the presentation,

3) Beneficiary contracting authorities reserve the right to redimension the minimum and maximum amounts of the subsequent contracts depending on the allocated resources and needs up to the maximum amount of the framework agreement
