The participant designated as a contractor shall choose the form of the the performance guarantee.

The guarantee presented in the form of a sum of money or a bank guarantee may be provided on behalf of the contractor for the account of a third guarantor.- When submitting a performance guarantee there shall be explicitly stated the contract and the respective lot, for which the guarantee is submitted - When the selected contractor is a grouping which is not a legal entity, each of its partners may be the principal of the bank guarantee, respectively the importer of the amount of the guarantee or the holder of the insurance.

The participant, designated as contractor, chooses the form of the guarantee- The conditions and terms for the detention or release of the performance guarantee are set out in the contract for the public procurement.

Note: When a tenderer is designated as a contractor for more than one lot, he / she must provide separate performance guarantees, respectively in the specified amount for each lot for which it is designated as a contractora requirement for the establishment of a legal entity if the participant designated as a contractor is a grouping of natural and / or legal entities.
