Contract for supplying water jet cutting machine and plan grinding machine

The contracting authority intends to purchase two machines, as follows:

Main Site: Timișoara Boulevard no. 10 B, sector 6, Bucharest.

The contracting authority will purchase 1 (one) water jet cutting equipment.

Reasons de exclusion:

The bidder, the member / members of the association, the subcontractor / subcontractors, the third party / third party (s) must not be found in the situations provided in art. 60, 164, 165, 167 of Law no. 98/2016. The way in which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to the situationof their actions, as well as a statement on their own responsibility regarding the non-classification in the potential-generating situations of conflict of interests, provided in art. 60 of Law no. 98/2016 Form 5.

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, by the bidders who sign the framework agreement.

Thesedocuments can be:

- certifying documents regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation. The document will be presented only by the head office of the tenderer;

- the criminal record of the economic operator and of the members of the administration body, killing or supervision of the respective economic operator or of those with power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act;

- as the case may be, documents proving the fact that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 ofLaw 98/2016 on public procurement;

- other edifying documents, as the case may be.

Note:

It should not be found in the situations provided in art. 60, 164, 165 et ali 167 of Law no. 98/2016: the bidder, the member / members of the association, the subcontractor / subcontractors, the third party / third party (s).

The Single European Procurement Document (DUAE) will be completed according to art. 193 of Law 98 / 2016.

All documents requested by the contracting authority will be submitted by the tenderer by electronic means in SICAP, signed with the extended electronic signature based on aqualified certificate, according to the law no. 455/2001 republished, regarding the electronic signature.

Documents issued in a language other than the Romanian language will be presented in the language in which they were issued, accompanied by an authorized translation into Romanian. All documents will have, besides the signature, clearly mentioned, the full name of the signatory person.

Requirements regarding the capacity to exercisestrength of professional activity:

1. The economic operators who submit an offer must prove a form of registration according to the law of the country of residence, to show that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution, as well as the fact that it has the professional capacity of to carry out the activities that are the subject of the contract.

2. Mthe odality by which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation.

3. The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively the certifying certificate issued by ONRC, or, in the case of foreign bidders, equivalent documents issued andIn the country of residence, it will be presented, at the request of the contracting authority, only by the economic operator signing the contract. For foreign legal / natural persons the documents proving a form of registration / certification will be presented in the authorized translation into Romanian.

Note: The DUAE (Single European Procurement Document) form will be completed separately andprovided exclusively in electronic format, by the bidder / associates / subcontractors / third party supporters. If a group of economic operators submits a common offer, these requirements must be met by each member of the association.

1. Requests for clarification regarding the award documentation will be sent only through SEAP, by accessing the dedicated section "Questions".the bear of the evaluation, the CA can send to the bidders requests for clarifications using SEAP. The tenderer`s response must be uploaded in SEAP, in electronic format, in the same section, before the deadline set by the CA, signed with the extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider. If the AC requests aoffering clarif. and / or completions of the documents presented by him in the tender, and the tenderer does not submit within the specified term clarification / completion. requested or clarification / compl. submitted are not conclusive, his offer will be considered unacceptable.

2. If it is found that there are allowable offers with equal prices, the AC will request the resumption of the competition by sending some pimproved financial feedback, offline, by email.

3. For information on associations and subcontractors, third party supporters will complete DUAE.

4. In the case of an association, at the time of submission of the offer, an agreement or letter of association will be presented stating that all the associates assume the collective and solidary responsibility for fulfilling the contract, as the leader of the associationi is empowered to undertake and

5. In case the tenderer intends to subcontract a part / parts of the contract, DUAE also includes information on the part of the contract that will be eventually subcontracted and will have annexed the sub-agreement.ntractare. Subcontr. on whose capacities the bidder relies must complete, in turn, the DUAE separately, including all the information. mentioned in art. 193 para. (1) lit. a), as well as those from par. (1) lit. b) and c) of Law no. 98/2016, from the perspective of the subcontracting capabilities. on which the tenderer relies in the respective award procedure. In the case of subcontracting. on the goto which capacities the bidder is not based, DUAE will only contain the information mentioned in art. 193 para. (1) lit. a) of Law no. 98/2016

6. For info. regarding the third party supporters, the DUAE will be completed. At the time of submission of the offer, the firm`s commitment to support the third party will be presented
