2. Detailed description of the subjectOrder details, required parameters and general requirements of the subject of the order are included in Annex 2 regarding the description of the subject of the order, which is an integral part of this ToR.

Set for analyzing metabolic parameters

Contractors who are not subject to exclusion due to the lack of grounds for exclusions due to non-compliance with the conditions ofthat in art. 24 paragraph 1 point 12 23 of the Act. The Employer does not provide for the possibility of excluding the Contractor on the basis of Art. 24 paragraph 5 of the Act.

II. To confirm that there are no grounds for excluding the Contractor from participation in the procedure, the Employer requires the submission of the following statements or documents:

1) the Contractor's declarations based on Art. 25a section 1 of the Public Procurement Law, regarding the grounds for exclusion from progressive proceedingsin the form of a single European order document JEDZ according to Annex 4 to the ToR;

2) information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Act issued not earlier than 6 months before the deadline for submission of bids;

3) the Contractor's statement that he has not issued a final court judgment or a final administrative decision regardingsettling taxes, fees or social security or health insurance contributions, or in the event of such a judgment or a decision confirming the payment of such receivables together with any interest or fines, or concluding a binding agreement on the repayment of those receivables;

4) the Contractor's statement that no ruling against him as a precautionary measurerunning prohibition to apply for a public contract;

5) the Contractor's statement on belonging or not belonging to the same capital group; in the case of belonging to the same capital group, the Contractor may submit together with a statement documents or information confirming that links with another Contractor do not lead to distortion of competition in the proceedings within3 days from posting on the website the information referred to in art. 86 section 5 of the Public Procurement Law

VI. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the document referred to in point II point 2, it submits information from the relevant register, or in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the countryin which the Contractor has its registered office or place of residence or place of residence has a person whose information or document relates to the extent specified in art. 24 paragraph 1 item 13, 14 and 21 of the Act.

VII. If in the country in which the Contractor has its registered office or place of residence or place of residence there is a person to whom the document relates, the document referred to in point VI does not appear, it is replaced bya document containing, respectively, the Contractor's statement indicating the person or persons authorized to represent him or a statement of the person to whom the document was to be submitted, submitted before a notary public or before a judicial, administrative or professional or economic self-government body competent for the seat or place of residence of the Contractor or place of residence this persony.

VIII. The Contractor having its registered office in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, to whom the document referred to in point II point 2 applies, submits the document referred to in point VI, in the scope specified in art. 24 paragraph 1 item 14 and 21 of the Act. If in the country in which the person to whom the document was to reside has no place of residence, such documents do not appear, replaceit is replaced by a document containing the person's declaration made before a notary public or before a judicial, administrative or professional or economic self-government body competent for the place of residence of that person. The documents referred to in points VI, VII, VIII must be issued not earlier than 6 months before the deadline for submission of tenders. To confirm that deliveriesy meet the requirements of the Employer should be submitted:

- informational materials; in the case of equivalent solutions,

- statement on equivalent offer (provide documents, i.e. Polish and European approvals, certificates).
