According to the minimum and maximum quantities in the specification, for each lot separately.

The bidders, the third party supporters and the subcontractors must not find themselves in the situations provided in art. 164, 165 and 167 din Law no. 98/2016. Method of fulfillment and applicability in the procedure: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. These documents specified in the DUAE should be presented only at the request of the contracting authority only by the tenderer ranked on the first place in the intermediate ranking preparedat the end of the evaluation of the offers. The contracting authority has the obligation to accept that it is sufficient and relevant for demonstrating that the bidder / candidate does not fall into one of the situations provided in art. 164, 165 and 167 of Law 98/2016, any document considered edifying, from this point of view, in the country of origin or in the country where the bidder / candidate isestablished, such as certificates, court records or other equivalent documents issued by the competent authorities of the respective country. If in the country of origin or in the country where the bidder / candidate is established, competent documents are not issued by the competent authorities such as certificates, judicial records or other equivalent documents or the respective documents do not cover all situationsile provided for in art. 164, 165 and 167 of Law 98/2016, the contracting authority has the obligation to accept a declaration on its own responsibility, an authentic statement given before a notary, an administrative or judicial authority or a professional association that has competence in this regard. . If applicable, documents are presented which prove that the economic operator canit benefits from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement. The supporting documents proving the fulfillment of those assumed by completing the DUAE are:

- the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator, or of those who cthey have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document,

- the certificate of fiscal attestation issued by the Local Taxes and Taxes Department. This document must attest the lack of outstanding debts at the time of their submission. Foreign bidders will present any edifying documents issuedby the competent authorities of the country in which they are residents to prove the fulfillment of the obligations due for payment of taxes to the local budget, in accordance with the legislation of the country of residence. The documents issued in another language will be accompanied by the authorized translation into Romanian,

- the certificate of fiscal certification issued by the fiscal administration body of aterritorial administrative units within the radius of which the company has its registered office; the document must attest the absence of the outstanding debts at the time of their submission. The fiscal certificate is required for the registered office, the secondary offices as well as the point (s) for which there are payment obligations. The foreign bidders will present any edifying documents issued by the authoritiescompetences from the country in which they are residents, by which to prove the fulfillment of the obligations due for payment of taxes to the state budget, in accordance with the legislation of the country of residence. Documents issued in another language will be accompanied by the authorized translation into Romanian. The documents must be presented in the original, a certified copy or a copy conforming to the originalie regarding the non-classification in the situations provided in art. 58, 59, 60 of the Law 98/2016 the bidders, the third-party supporters and the subcontractors must not be found in the situations provided in art. 58, 59 and 60 of Law 98/2016.
