2018. The subject of the order is the delivery, installation and servicing of a brand new digital X-ray machine with systemem and infrastructure for archiving and sending the results of imaging diagnostics.

1. The subject of the order is the delivery, installation and servicing of a brand new digital X-ray apparatus with a system and infrastructure for the archiving and transmission of research results.image agnostics. 2. The object of the order is co-financed under the contract for co-financing

NrUDA-RPPD.08.04.01-20-0044 / 18-00 of the project No. WND-RPPD.08.04.01-20-0044 / 18 entitled: " Improving the efficiency and access to healthcare services of SP ZOZ in Mońki at the level of stationary and outpatient treatment in the field of diseases that are a significant cause of adult inactivation of adults "-from the centers of the European Regional Development Fund under the Regional Operational Program of the Podlasie Voivodship for the years 2014-2020 Priority axis VIII. Infrastructure for public utility services Measure 8.4. Social Infrastructure Sub-measure 8.4.1 Healthcare infrastructure.

3.The main subject of the order, assortment and quantities has been specified in the offer formwhich constitutes Annex No. 1 to the specification of essential terms of the order, constituting its integral part.

4. The subject of the order is intended for Pracgen Rentgenodiagnostyki Ogolnej SP ZOZ in Mońkach located at Al. Niepodległości 9, 19-100 Mońki.

5. The product offered is a medical device listed in Appendix No. 1 to the silverware and has the required certificates, certificates andaz marking provided for by the Act on Medical Devices demonstrating the required admission to use and trade in Poland, in particular the CE declaration of conformity according to the Regulation of the Minister of Health on essential requirements and conformity assessment procedures for medical devices, including the CE Declaration of Conformity one for the whole RTG.Ofe devicethe subject of the order being a medical device must be admitted to trading and use in Poland in accordance with the provisions of the Act of 20.05.2010 on medical devices (Journal of Laws of 2017, item 211, as amended) .

6. The subject of the orders includes in particular:

1) the implementation of the Radiological Protection Project agreed and approved by the competent authorities of the State Sanitary Inspectionej;

2) providing all necessary documents (regarding the delivered apparatus), - Required to submit an application for a permit to perform the activity of starting an X-ray laboratory and / or starting and using an x-ray device for medical diagnostic purposes and assembly of shields after obtaining appropriate consents (if required);

3) delivery of the factorywithout a new one free from physical and legal defects of the Camera along with the necessary equipment. The Employer does not allow the offer of exhibition and demonstration facilities. The delivered device must be free of all physical (constructional) and legal defects and must be ready for work without any additional purchases and investments;

4) assembly of the apparatus in the General Radiology LaboratorySP ZOZ in Mońki, located at

Al. Niepodległości 9, 19-100 Mońki, its immobilization and performance of necessary tests, ie: a) acceptance,

b) specialist,

c) imaging quality

Pursuant to the Ordinance of the Minister of Health of February 18, 2011 on the conditions of safe use ionizing radiation for all types of medical exposure (i.e., 2007-07);

5) after starting the apparatus, provide instruction and training of medical and technical personnel in the scope of service and use in the price of the offer;

6) integration of the camera with the HIS OPTIMED STD software of Comarch Polska SA Healthcare, which is used by the Employer;

7) dismantling one type X-ray camera type typMulitx Pro and a TUR-D800 type camera 1 item including transfer to the indicatedfrom the Saving room located in Mońki, Al. Niepodległości 9, within the period agreed by the Parties of the contract.

The offer should be submitted at the headquarters of the Ordering Party: the Secretariat of the Independent Public Health Care Center in Mońki, ul. Al. Niepodległości 9, 19-100 Mońki (the building of the District Clinic in Mońki). III. The Awarding Entity does not provide for the selection of the most advantageous offer with the use of an electronic auction. IV. The Awarding Entity does not provide for the conclusion of a framework agreement and the application of an auctionand electronic and establishing a dynamic purchasing system V. The Employer does not provide for the orders referred to in Article 67 sec. 1 point 6 and 7 or art. 134 sec. 6 point 3 Pzp VI. The grounds for exclusion are specified in Chapter XI of the Terms of Reference. 1. The Ordering Party will exclude from the proceedings the Contractor in the event of occurrence of circumstances referred to in:

1.1 art. 24 sec. 1 item 12-23 of the Act Lawpublic speaking, 1.2. Article 24 paragraph 5 points 1 and 8 of the Public Procurement Law. 2. Contractor who is subject to exclusion pursuant to art. 24 sec. 1 point 13 and 14 and 16-20 or paragraph 5, may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove that the damage caused by the crime or fiscal offense has been remedied, financial compensation for damage suffered or repairing the damage, comprehensive explanation of the facts and cooperation with law enforcement agencies and taking specific technical, organizational and human resources measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply, if the contractor, being a collective entity, has been the subject of a final court decision prohibiting him from applying for the order and the period of validity of the prohibition specified in that judgment has not expired. 3. The Contractor shall not be excluded if the Awarding Entity, taking into account the weight and special circumstances of the Contractor's action, deems sufficient evidence presented under point 2. 4. Inthe rules referred to in Article 24 sec. 1 point 19, before exclusion of the Contractor, the Employer shall provide the Contractor with the opportunity to prove that his participation in the preparation of the procurement procedure will not distort competition. 5. The tender of an excluded Contractor shall be considered rejected. 6. The Contracting Authority may exclude the Contractor at any stage of the procurement procedure. 7. For confirmationnot to be excluded from the proceedings, the Contractor is obliged to submit with the offer an up-to-date statement to the extent indicated by the Ordering Party in the Contract Notice and SIWZ in the form of a Uniform European Order Document, hereinafter referred to as "Single Document." VII Description of how to assess compliance with the conditions of participation in the proceedings and no grounds for exclusion-is determined by Chapter XII of the ToR. VIII. The list of statements or documents confirming compliance with the conditions for participation in the proceedings and the lack of grounds for exclusion have been specified in Chapter XV, XVII and XVIII of the ToR. IX. Other documents that the contractor must attach together with the offer are specified in Chapter XVI of the ToR. X. The Awarding Entity provides for the possibility of applying the procedure indicated in art. 24aa, i.e.to evaluate the offers and then to examine whether the contractor whose tender has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. XI. The Administrator's information clause regarding the GDP is included in Chapter XXXVII of the ToR. XII.
