The economic operators of the tenderers / associates / third parties / proposed subcontractors must not find themselves in the situations provided by art. 164, 165, 167 of Law 98/2016. The way in which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, with infothe rhythms associated with their situation. The presentation of the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have the power to represent, decide or control within him, as it results from the certifying certificate issued by ONRC / the constitutive act. The supporting documents that probears the fulfillment of the assumed by completing the DUAE shall be presented, at the request of the Contracting Authority, only by the tenderer ranked 1st in the intermediate rankings drawn up after applying the award criterion only on-line. These documents may be: tax attestation certificates, certificates of absence of debts, with respect to the payment of taxes, tax(local budget, state budget, etc.) at the moment of their submission or any document considered as edifying in this respect in the country of origin or in the country where the tenderer is established, such as certificates, criminal records or other equivalent documents issued by the competent authorities of that country. Romanian Legal / Physical Persons:

Certificat issued by the national trade registry office, which indicates the object of activity of the respective economic operator. The subject of the contract must have a correspondent in the CAEN code of the certifying certificate issued by the ONRC. The information contained in this document will be actual / current at the time of submission. The way in which performance can be demonstratedof the requirement: the DUAE will be filled in by the economic operators participating in the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the bidder ranked first in the intermediate rankings drawn up following the application of the criterionui award.



Requirement 2. Documents proving the marketing activities, distribution and providing services in medical devices takes place in compliance with the WHO no. 309/2015 (approving the Methodological Norms for the application of Title XIX of the Law no. 95/2006 on healthcare reform, on endorsement activityin the field of medical devices), referring to the approval of activities in the field of medical devices for marketing, installation / commissioning and service, activities to be covered by the present procurement.

In order to fulfill the requirement 2 and according to art. 926 of Law 95/2006, will be presented the Operating Notice for trading activities, didistribution and provision of medical devices services issued by the Ministry of Health (through its structure - A.N.M.D.M.), according to the provisions of art. 3 from O.M.S. no. 309/2015, including its annexes, valid at the moment of its submission. It is required to present any legally binding financial accounting document for the last 3 years, 2015, 2016, 2017, by which the tenderer can prove its economic and financial capacity (eg the balance sheet targeted and registered with the competent bodies or, as the case may be, the annual reports, letters of credit frombanks or recognized financial and accounting auditing companies). The information will be filled in the DUAE, and the supporting documents will be submitted, at the request of the contracting authority, only by the bidder placed on the 1st place in the intermediate rankings completed at the evaluation of the bids. Information must be actual / current at the time of submission of the documents. In cthird parties or subcontractors, each of them is required to submit the documents in this section, in accordance with Public Procurement Law 98/2016.
