The subject of the order is the delivery of a 2-position X-ray apparatus, room adaptation and maintenance stechnical validity of the apparatus for a total period of 4 years

The subject of the order is the delivery of a 2-position X-ray apparatus, room adaptation and technical maintenance of the apparatus for a total period of 4 years.

Realizing the subject matter the contractor is obliged to: purchase, delivery along with the installation and commissioning of a 2-position X-ray machine descriptionin the Annex No. 1 to this Terms of Reference and meeting the technical and functional parameters contained in the said Annex,

b) disassembly and redemption of bone and pulmonary X-ray machine currently used in the Polyclinic

c) X-ray coverage for maintenance for a total of 4 years

d) adaptation works related to the preparation of the pomrooms for installation according to Annex 8

1. The contractors who can apply for the order are:

1) They are not subject to exclusion according to art. 24 sec. 1 point 13 23 and par. 5 points 1 and 8 of the Public Procurement Law Acts - 2). They meet the conditions for participation in proceedings regarding: a) competences or entitlements to conduct a given professional activity, if it results from separate provisions in the present proceedings.the economic operator is not obliged to meet the above condition. b) Economic or financial situation - detailed description in section III.1.2) Economic and financial situation c) Technical or vocational capacity - detailed description in section III.1.3) Technical capacity and professional qualifications

2. Potential of the third party:

1) The Contractor may confirm the fulfillment of the conditions for participation in the progressin relevant situations and with regard to a specific order, or its part, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of its legal relationship.

2) The Contracting Authority informs that "relevant situation" referred to in point 1 will occur only if: a) the Contractor, which relies on the abilities or situation of other entities, will prove to the Ordering Party that it will have at its disposal the necessary resources of these entities, in particular presenting the obligation of these entities to provide them with the necessary resources for the order (including at least the information given in point . c);

b) The Ordering Party will assess whether or not the udosfor third parties technical or professional capacity, or their financial or economic situation, allow the Contractor to demonstrate fulfillment of the conditions for participation in the proceedings and examine whether there are any grounds for exclusion referred to in art. 24 sec. 1 item 13 22 and par. 5 points 1 and 8 of the Act on Public Procurement Law;

c) From the obligation or other documents confirmingThe availability of resources by other entities must clearly and unambiguously result in particular: - scope of available contractor resources of another entity, - how to use the resources of another entity, by the Contractor, when executing the order, - scope and period of participation of another entity when executing the order 3. Contractors may jointly apply for a contract. In this caseto the contractor, they appoint a Proxy (Leader) to represent them in this proceeding or to represent them in the proceedings and to conclude a public procurement contract. All correspondence will be carried out only with the Proxy (Leader). The power of attorney in writing (the original or a copy certified for compliance with the original by a notary public) must be attached tooffers. The power of attorney referred to in the previous sentence should: - specify the scope of the authorization, - replace all the Contractors who jointly apply for the order, - each of these Contractors must sign a joint power of attorney or other document prepared for this purpose ; alternatively - issue an independent power of attorney for the Plenipotentiary individually-Leader (no signature of the Plenipotentiary's Proxy is required on the power of attorney document).

4. The provisions concerning the Contractor shall apply accordingly to the Contractors jointly applying for the award of the contract.

the Ordering Party will consider fulfillment of this condition if, in addition to the initial declaration, the Contractor will submit the information of the bank or cooperative savings and credit unionconfirming the amount of financial resources owned or the creditworthiness of the contractor, in a period not earlier than one month before the deadline for submission of tenders, c.d. from section III.1.1)

5. The Employer will exclude contractors from the procedure:

1) who did not show compliance with the conditions for participation in the proceedings, referred to in point 1.2

2) who will not show that they do not have circumstance towards themeled in art. 24 sec. 1 point 13 of the Public Procurement Law Acts 3) to which the conditions specified in art. 24 sec. 5 points 1 and 8 of the Public Procurement Law Act

Chapter 5 List of declarations or documents to be provided by the Contractor

A) Documents and statements necessary for the deadline for submission of tenders

1. In order to confirm compliance with the conditions for participation in the proceedings and to demonstrate the absence of grounds for exclusion, thejointly in Chapter 4, Contractors must:

a) send the Ordering Party a valid statement on the day of submitting bids in the form of a single European order document (hereinafter referred to as "EAT"). EAT should be sent in an electronic form with a qualified electronic signature by means of the Purchaser's Purchase Platform. Purchase Platform of the Ordering Party is a communication tooland electronic for folding the EAT and can be found at https://spsk4lublin.eb2b.com.pl instructions for submitting FOOD is described in Chapter 7.

The information contained in the statement will constitute preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings.

Note: Conditions for participation in the procedure will be initially verified based on the completed PartIV. Qualification criteria by submitting a general statement regarding all the eligibility criteria at the point "alpha" in EED (no other sections are required to be filled in part IV EAT) - A1) In the case of joint application by Contractors - a declaration in the form a single document (EAT) is sent by each of the Contractors jointly applying for orderse. These statements are to confirm compliance with the conditions for participation in the procedure and no grounds for exclusion to the extent that each of the Contractors demonstrates fulfillment of the conditions for participation in the proceedings and no grounds for exclusion. A2) In the event that the Contractor, to confirm compliance with the conditions for participation in the proceedings, it will depend on the resources of other entities, it is sent to Ordering the third party. EAT should be completed to the extent that the Contractor relies on their resources. EAT must indicate that there are no grounds for exclusion for them (in the same way as the Contractor) and fulfill the conditions for participation in the proceedings in the scope in which they refer to their resources. This applies to both situations when the third party will not be a subcontractor in tr(A3) The contractor who intends to entrust the execution of a part of the contract to subcontractors specifies the parts of the orders he intends to entrust to the subcontractors and gives the companies of these subcontractors in the EAT; it is not required to demonstrate that there are no grounds for exclusion towards subcontractors or indicate them in a statementeniu JEDZ.

b) In the case of reliance by the Contractor on the capacities and situation of other entities - submit together with the offer the obligation of these entities (in the original), referred to in Chapter 4, point 2.2 lit. a).

B) Documents and declarations submitted to the ordering party's request

2. The ordering party shall call the Contractor whose bid has been best assessed before submitting the order, to submit - in the designatedtime, not shorter than 10 days, valid as at the date of submitting - the following declarations or documents confirming the circumstances referred to in Art. 25 ust. 1 of the Public Procurement Law and Chapter 4 of the Terms of Reference:

Requirements for the bid bond

1. The Contractor is required to pay a bid bond in the amount of 16 700.00 PLN.

2. The Contractor is required to submit a bid bond before the deadline for the submission of the offerert in the form / forms referred to in art. 45 par. 6 Public procurement law.

4. According to art. 144 para. 1 point 1 of the Public Procurement Law, the Parties agree that each contract change may take place in non-material matters and according to the following defined rules and conditions: a) in the case of a VAT rate change for the Parties, the VAT rate will applyon the day of issuing the invoice, and the change in the amount of the gross price for this title is accepted by the Parties without the need to submit additional statements - b) in the event of a change in the minimum remuneration for the work set in based on the relevant act and in the case of changes in the rules of being subject to social insurance or health insurance or the amount of the premium on insurancesocial or health reasons, each party may ask the other party to negotiate an appropriate change in remuneration (no higher than calculated according to the method specified in Article 4 paragraph 2 and 3 of the Act amending the Public Procurement Law Act No. 1232/14, as amended), provided that the changes mentioned in the introduction affect the costs of the contractor's performanceow of the contract

5. Circumstances which constitute the basis for amending the contract should be justified and documented by the party proposing to change this contract
