Conclusion of a framework agreement for the supply of dialysis kits.

Main Site: Colentina Clinical Hospital, Șteeaua Ștefan cel Mare no. 19-21, sector 2, Bucharest.

Dialysis kits - according to the specifications of the specifications.

The duration of the framework agreement is 48 months.

Tenderers, partners, third party supporters and subcontractors must not be found in the situations provided in art. 164, 165, 167, 59, 60 of Law no. 98/2016, with modifficulties and completions of GEO 107/2017, regarding public procurements.

1. Failure to comply with the provisions of art. 164 of Law no. 98/2016 on public procurement.

The economic operator will fill in the corresponding requirement in the DUAE form from the award documentation. The classification in the situation provided in art. 164 of Law no. 98/2016 on public procurement entails the exclusion of the bidder from the procedure applied for the award of the public procurement contract;

2. Failure to comply with the provisions ofrt. 98/2016 on public procurement.

The economic operator will fill in the corresponding requirement in the DUAE form from the award documentation. The classification in the situation provided in art. 165 of Law no. 98/2016 on public procurement entails the exclusion of the bidder from the procedure applied for the award of the public procurement contract;

3. Failure to comply with the provisions of art. 167, with the amendments and completions of GEO 107/2017, from Law no. 98/2016 regarding the public procurements

The economic operator will fill in the corresponding requirement in the DUAE form from the award documentation. The classification in the situation provided in art. 167 of Law no. 98/2016, with the amendments and completions of GEO 107/2017, regarding public procurements, attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract.contracting parties, only by the bidders ranked on the first three places, after the application of the award criterion, until the conclusion of the report of the award procedure according to art. 196 para. (2) of Law no. 98/2016 on public procurement. These documents can be:

1. certificates stating the absence of outstanding debts regarding the payment of taxes, fees or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation;

2. criminal record ofthe economic operator and the members of the administrative, management or supervisory body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the ascertaining certificate issued by ONRC / the constitutive act; 3. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on achpublic institutions;

4. other building documents, as the case may be.

Non-resident (foreign) economic operators have the right to present any building documents, issued by the authorities of the country where they are residents to prove the fulfillment of tax obligations to the state budget and local budget, in accordance with the legislation of the country of residence. Certificates must certify the absence of outstanding debts regarding the payment of taxes and insuranceat the time of their presentation. The documents will be presented accompanied by their authorized translation into Romanian.

4. Failure to comply with the provisions of art. 59 and art. 60 of Law no. 98/2016 on public procurement.

The economic operator will fill in the corresponding requirement in the DUAE form from the award documentation. The documents will be signed with an extended electronic signature and will be posted in SEAP. The classification in the situation provided in art. 59 and art. 60 of Law no. 98/2016 prpublic procurement entails the exclusion of the tenderer from the procedure applied for the award of the public procurement contract.

The persons with decision function within the contracting authority, regarding the organization, development and completion of the award procedure, are: Mihalcea;

1. The economic operators submitting the offer must prove a form of registration under the law of the country of residence, to show that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution, and that it has the professional capacity to to carry out the activities that are the object of the contract, at the present moment

Method of fulfillment: completion of DUAE by all economic operators, following that the supporting document, respectively ONRC certificate (the object of the procurement procedure must have a correspondent in the CANE codes from the ONRC certificate) or, for foreign bidders, equivalent document issued in the country of residence, to be presented only by the bidders ranked on the first three places, in the intermediate ranking, drawn up at the end of the evaluation of the offers after the completion of the bachelor stageelectronic itation. The documents will be signed with the extended electronic signature and will be posted in SEAP;

2. The economic operators submitting the offer must have a certificate or membership from a professional point of view, respectively to have a distribution authorization issued by the Ministry of Health ANMDM, for the storage, distribution and marketing activity for the product / products offered, in accordance with Law no. . correspondent in the CANE codes from the ONRC certificate).

Method of fulfillment: completion of DUAE by all economic operators, following that the supporting documents, respectively the ONRC certificate and the authorization issued by NAMMD (the object of the procurement procedure must have a correspondent in the CANE codes from the ONRC certificate ) or for foreign bidders, equivalent documents issued in the country of residence, to be presented only by the bidders ranked on the first three places, after the application of thethe award procedure, until the conclusion of the report of the award procedure, according to art. 196 para. (2) of Law no. 98/2016 on public procurement.

The documents will be signed with the extended electronic signature and will be posted in SEAP. a request for re-tendering from the contracting authority, to which the economic operators will send the new Fr.

The contracting authority reserves the right to unilaterally terminate the framework agreement before the deadline, in case ASSM Bucharest or the Ministry of Health will conclude on the basis of GEO 71/2012 contracts having as object the products of this procedure.

Requests for clarifications regarding to this award documentation will be addressed exclusively in SEAP to the section "Questions" within the award procedure carried out by electronic means, and the answers to them will bebe published in SEAP, in the section "Documentation, clarifications and decisions" within the announcement / invitation to participate, the contracting authority will not respond to requests addressed by another means of communication than the established one.

Certification for conformity of documents submitted to SEAP is made by the legal representative of the economic operator by writing on each page the statement "according to the original" accompanied by the signature of the person concernedive.
