Consumables for anesthesia machines

Requirement no. 1 - Declaration on non-compliance with the provisions of art. 164 of Law no. 98/2016 on thispublic appeals, with subsequent modifications and additions. The economic operator (leader, associate, third party, subcontractor - if applicable) will fill in the appropriate requirement in the DUAE form. 2 - Declaration on non-compliance with the provisions of art. 165 and art. 167 of Law no. 98/2016 on public acquisitions, with subsequent amendments and completions. The operator economic (leader, associate, third party, subcontractor, if applicable) will fill in the appropriate requirement in the DUAE form. 3 - Declaration on non-compliance with the provisions of art. 59 and 60 of Law no. 98/2016 on public acquisitions, with subsequent amendments and completions. The economic operator (leader, associate, third party, subcontractor, if applicable) will fill in ccorresponding to the DUAE form in the awarding documentation and will be attached to the SEAP with the DUAE. Decision-makers of the Emergency Clinical Hospital of Bucharest:

The supporting documents supporting the requirements 1 and 2, which will be presented only by the economic operators ranked 1st, 2nd and 3rd - The fulfillment of the payment obligations to the consolidated state budget. The economic operator (leader, associate, third party) will complete the appropriate requirement in the DUAE form from the documentedaward. For the confirmation of those declared in the DUAE only the bidders placed on the 1st, 2nd and 3rd place after the application of the award criterion will be requested to submit until the closing date of the procedure for awarding the following documents: - - tax certification certificate for legal persons regarding the payment obligations to the consolidated state budget in original orcertified true copy of the original, document showing that the bidder has no overdue debts at the time of submitting this certificate. In this case the provisions of art. 166 par. (2) of the Law no. 98/2016 regarding the public acquisitions with the subsequent modifications and completions; - a tax attestation certificate for a personit is legal regarding the payment obligations to the local budget in the original or a certified copy on its own responsibility for compliance with the original, document showing that the tenderer has no overdue debts at the moment when he has to present this certificate. In this case the provisions of art. 166 par. (2) of the Law no. 98/2016 on public acquisitions with amendments and-further additions. For foreign legal entities: The economic operator will provide editorial documents - issued by the authorities of the country of origin (certificates, criminal records, other equivalent documents) to result in membership / registration with the organs of the country. Certificates / supporting documents will be presented in accordance with the legal provisions, stating that they do notrecords outstanding tax liabilities under the law of the country in which they are resident. Documents presented in a language other than Romanian will be accompanied by certified translation. For Foreign Legal Entities as a way of fulfilling the requirement is also the completion of the DUAE according to art. 193 of Law 98/2016, with subsequent modifications and completions, followed by edifying documentsonly be submitted at the request of the contracting authority, upon completion of the evaluation of the tenders. The awarding documentation is displayed in SICAP, www.e-licitatie.ro. All answers to clarifications requested by economic operators or formulated by the contracting authority will be posted on www.e-licitatie.ro. The DUAE document is available in Englishthrough the online service, made available free of charge by the European Commission, available at https://ec.europa.eu/growth/tools-databases/espd/filter. Without prejudice to the provisions of Law no. 182/2002 regarding the protection of classified information, with subsequent modifications and completions, the economic operator shall specify in the submitted offer the informationincluded in the technical proposal and in the financial proposal considered to be confidential, classified, protected by an intellectual property right to the extent that the disclosure of such information objectively would prejudice the legitimate interests of the economic operator, in particular with regard to commercial secrecy and intellectual property. Considering that the contracting authoritythe tantra will sign the framework agreement only with the economic operators placed in the 1st, 2nd, 3rd place, as the case may be, the way of bidding with equal prices will be as follows:

1) If the commission finds that they have been deposited / introduced in the SICAP more than two admissible tenders with equal prices to the first-ranked bidders, the contracting authority will send through the SICAP a request to clarify(2 decimal places) and the economic operators will send their answer using the facilities offered by SICAP, in which case the contract will be awarded to the first 3 bidders who have the lowest price; in which the commission finds that more than 2 admissible tenders have been submitted with equal prices by the class tenderersyou have the second place, the way of dividing them will be done by requesting in SICAP a new financial proposal (with 2 decimal places) and the economic operators will send their answer using the facilities offered by SEAP, so that the bidder ranked It will not be affected, ie the new financial proposal will not be equal or lower than the ranked first place.-In the event that the new improved financial proposal submitted to the SICAP as a result of the request of the contracting authority received by it will influence the rankings of the higher places, this shall not be taken into account keeping the initial bid submitted in the SICAP in the procedure; in which the commission finds that more than 2 admissible offers have been submitted with equal prices by the offerthe third place, the way of their classification will be made by requesting in SICAP a new financial proposal (with 2 decimal places) and the economic operators will send their answer using the facilities offered by SICAP, so that the bidders placed on the place I and II are not affected, ie the new financial proposal is not equal to or less than the offer cleft in place I and II respectively. If the new improved financial proposal submitted to the SICAP as a result of the request of the contracting authority will influence the rankings of Sections I and II, this will not be taken into account, keeping in mind the initial bid submitted in the SICAP, to the procedure. Deadlines / dates for submission of new financial proposals will be communicated in the request submitted dis to the contracting authority. The contracting authority will conclude subsequent contracts with the first-ranked economic operator until it declares itself incapable of supplying the products or terminating the framework agreement with it.
