The minimum and maximum quantities of the framework agreement, respectively of the subsequent contract are mentioned and can be viewed by the economic operators in the specifications. 164, 165, 167 of Law no. 98/2016. The way in which the requirement can be demonstrated: will cfilling DUAE by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the bidders ranked on the first 5 places, related to each lot in the intermediate ranking drawn up at the end.bad evaluation of offers. These documents can be:

1) certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation;

2) the criminal record of the economic operator and of the members of the administration, management or supervisory body of the respectiveui economic operator or those with power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act;

3) as the case may be, documents demonstrating that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurementwhat;

4) other edifying documents, as the case may be.

Information regarding the non-compliance with the provisions of art. 58-63 of Law no. 98/2016. The information requested for not complying with the provisions of art. 58-63 of Law no. 98/2016 are also requested by the subcontractor and the supporting third party, if applicable. Conf. Declaration conf art. 63 paragraph (1) of Law 98 /2016 in conjunction with art. 21 paragraph (5) of the GD 395/2016, will be presented by bidders, third-party supporters and subcontractors, together with DUAE. it is legally constituted, as it is not in any of the situations of cancellation of the constitution as well as the onebecause it has the professional capacity to carry out the activities that are the subject of the contract. Modality by which the fulfillment of the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively certificatea certificate issued by ONRC or, in the case of foreign bidders, equivalent documents issued in the country of residence, will be presented, at the request of the contracting authority only by the bidders ranked on the first 5 places, for each lot in the intermediate ranking drawn up at the end of the evaluation of the bids.

Lots: 1, 2, 3, 4. Specify the average annual turnover. informand regarding the average of the global turnover for the last 3 years 2016, 2017, 2018. For the calculation of the equivalence, the annual average RON rate / other currency communicated by the NBR for each year will be applied: 2016, 2017, 2018. Euro 2016 average rate: 4.4908, 2017: 4.5681, 2018: 4.6535.

If, following the application of the award criterion the lowest price, the admissible offers have the same price, the way of separating the offers with the same price, will be realized by re-offering without affecting the price ranked on the previous place, also in electronic format by sending a request for clarification from the contracting authority to which the economic operators will send their answer online (in SICAP) . According to the provisions of art. 93 of Law 98/2016, the contracting authority will actinstead of the DUAE (Single European Procurement Document) tenders instead of the requested documents in order to demonstrate the qualification requirements, as the preliminary evidence DUAE can be downloaded in order to complete and submit at https://ec.europa.eu/growth/ tools-databases / espd / filter

Before awarding the framework agreement the contracting authority will ask the tenderer / tendererto the winner / winners after applying the award criterion to present the updated supporting documents to demonstrate the fulfillment of all the qualification criteria according to the information contained in the DUAE. The DUAE will be deposited as appropriate, by the supporting third party and the subcontractor. In the case of foreign economic operators, equivalent documents will be presentedissued in accordance with the law applicable in the country of residence
