1. The subject of the order are maintenance services including inspection, calibration, repair and verification of speed measurement devicesvehicles in road traffic and devices for the visualization of event locations in use of the local units of the Silesian Garrison Police, KWP in Katowice, including KAP Gliwice for 2020-2021 2. The order was divided into 7 parts (tasks) 3. Detailed information on the description of the subject of the order and its scope and method of implementation are in the ToR and annexes to the ToR 4.Mthe maximum contract value for a given task will be the amount that the Employer intends to allocate for the implementation of the contract, and the settlement for services rendered will be at unit prices indicated in Annex 3 to the ToR - the price form -OPZ and in the absence of specified items in the price form the company's price list provided before concluding a contract will be usedspeech. 5. The Employer allows subcontractors.

5. The Employer requires that under each task, the subject of the order for each device for measuring the speed of vehicles in road traffic and each device for the visualization of event locations be guaranteed basic service in the field of service inspections, i.e. (cleaning, maintenance), calibration, verification, repair and maintenancenon-fragility / disassembly.

6. The Purchaser requires that the warranty for each device be:

a. for technical inspection and repair carried out, at least 6 months,

b. for spare parts, at least 24 months

6.1. The warranty will be calculated from the date stated in the service report.

6.2. The Contractor shall provide the warranty in months.

6.3. The warranty periods for spare parts for each task are separately criticalselection of the best offer and have been specified in Chapter XI of the ToR.

6.4. In the event of an incorrect specification of the warranty period for the technical inspection and / or repair and / or spare parts carried out, the conversion rules included in Chapter XI of the ToR will apply.

6.5. In the absence of an indication of the warranty period / s, the Purchaser will consider that the Contractor has offered a minimum guarantee, i.e. 6 monthsfor technical inspection and repair / 24 months for spare parts based on the statement made on the offer form.

6.6. The scope of the warranty and deadlines for complaints are set out in Annex 2 to the ToR - Contract template.

6.7. The Purchaser requires that during the warranty period the Purchaser does not incur any additional costs related to warranty service.

7. Purchaser reservesreserves the right to change the number of services of the devices indicated in the price form for each task in the event of obtaining devices in the form of a donation / lending or purchase of new or decommissioning of existing devices, but this change will not apply to changes in the terms of the contract

8. The Employer requires that the Contractor maintain fixed prices for services and consumables during the contract periodprices specified in the price form constituting Annex 3 to the ToR. A change in the prices of the legalization service may occur only in the case of a new Regulation of the Minister of Finance regarding the legalization fees of equipment or a change in the VAT rate, which will not necessitate an annex to the contract.

9. Rules regarding the implementation of the order, including pickupsdamage to devices for the purpose of providing a service and their return is specified in the contract template attached as Annex 2 to the ToR.

10. The Employer requires that the Contractor prior to concluding the contract provide the Contractor's current price list containing the list of parts and consumables (the price includes replacement and labor), which were not listed in Annex 3 to the ToR for each offered task.

11. trEquipment will be exported for the purpose of performing the service and returning to direct users will take place at the expense of the Contractor, except for devices installed in cars.

12. The Employer requires that the Contractor as part of the services ensure that devices are brought / taken to / from the rooms indicated by the Employer's direct user.

13. Until receipt of the order by the Orderthe risk of all dangers related to possible damage or loss of the subject of the contract shall be borne by the Contractor.

14. The contracting authority may cancel the procurement procedure if the funds which the contracting authority intended to spend on financing all or part of the contract have not been awarded.

15. The contracting authority allows subcontractors. In case the Contractor isNot used by subcontractors The Employer requests to indicate the part of the contract which it intends to entrust to them and to provide the names of the subcontractors' companies if they are already known (Annex 1 and No. 5 to the ToR). Provisions regarding subcontractors can be found in Chapter XVII of the ToR and in the model contract (Annex 2 to the ToR).

16. The Contractor shall ensure the protection of personal data provided in accordance with the Data Protection Actpersonal information and a Regulation of the Parliament (...)

A. Contractors are required to attach the following documents to the offer:

1. Bid form completed in accordance with Annex 1 to the ToR

2. Price form - Description of the Subject of the Order in accordance with Annex 3 to the ToR

3. Statements required pursuant to art. 25a section 2 Public Procurement Law Acts, filed on the Single European Procurement Document - EAT akcurrent as at the day of submission of tenders, in accordance with Annex 5 to the ToR.

NOTE:

a) Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and compliance with them, to the extent that he refers to their resources and conditions for participation in the proceedings are also submitted by JEDZ regarding these entities.

b) The Contractor who intends to entrust the performance of part ofordering subcontractors to show that there are no grounds for being excluded from participation in the proceedings by JEDZ regarding subcontractors. These documents confirm the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion in the scopee, in which each of the contractors demonstrates compliance with the conditions for participation in the procedure and no grounds for exclusion.

4. Contractor's statement on the warranty granted for the technical review and repair carried out, for spare parts, submitted on the offer form - Annex 1 to the ToR or on a separate document.

5. The Contractor's statement that if the warranty periods are not provided, it guaranteesand minimum, i.e. 6 months for technical inspection and repair / 24 months for spare parts submitted on the offer form - Annex 1 to the ToR or on a separate document.

6. Contractor's statement that during the warranty period the Employer will not incur any additional costs related to warranty service, submitted on the offer form - Annex 1 to the ToR or separatelydocument.

7. Contractor's statement that he will maintain fixed prices for the service and consumables specified in the price form constituting Annex 3 to the ToR, submitted on the offer form - Annex 1 to the ToR or on a separate document throughout the duration of the contract.

8. Contractor's statement that prior to the conclusion of the contract he will provide the current price list for parts and consumables (price fromincludes a replacement and labor), which were not listed in Annex 3 to the ToR for each task offered, submitted on the offer form - Annex 1 to the ToR or on a separate document.

9. Contractor's statement that the transport of equipment for the purpose of performing the service and returning to direct users will take place at its expense, except for equipment installed in cars, withplaced on the offer form - Annex 1 to the ToR or on a separate document.

10. Contractor's statement that as part of the services it will ensure the equipment is brought / taken to / from the rooms indicated by the employees of the Employer as a direct user, submitted on the offer form - Annex 1 to the ToR or on a separate document.

11. Contractor's statement that he bears all risksdangers related to possible damage or loss of the subject of the order until receipt by the Employer, submitted on the offer form - Annex 1 to the ToR or on a separate document.

12. Declaration of the Contractor or entrusts to the subcontractor / com the performance of part of the order. If the subcontractor is entrusted with the performance of the contract, the Contractor will indicate the scope that will be realz o.o. with his / her participation along with providing companies and contact details of subcontractors who will implement this scope (if known), submitted on the offer form - Annex 1 to the ToR or on a separate document.

13. Contractor's statement that he has fulfilled the obligations arising from art. 13 or art. 14 GDPR towards natural persons from whom personal data was obtained directly or indirectly in cto apply for this contract ....
