Prthe order is based on comprehensive advertising and marketing services (including advertising campaigns, strategy, creation, production and purchase of media)

1. The subject of the order is the provision of marketing services for the Ordering Party in this field:

• conducting advertising campaigns,

• advertising strategy,

• creation (development of original designs or adaptation•) • production and post-production, • planning, purchase of airtime and advertising space in the media,

• internet marketing services.

Within the above scope, the agencies will be responsible for the implementation of promotional, advertising, image and information activities. The actions will be ordered each time by the Ordering Party within the framework agreement concluded, taking into account csales or information elow. Planned activities include ATL, BTL and DIGITAL advertising.

2. The Employer stipulates that during the performance of the Contract, the Contractors may not execute orders that conflict with the interests of Energa Obrot SA and other companies of the Energa SA capital group that they meet the conditions for the provision of services covered by the subject of the order in a non-binding manner.tronny and fair (In the case of joint application for the award of this Order by 2 or more Contractors).

3. The expected date of commencement of the provision of the service by the Contractor is 1 January 2018, however the date may change as a result of the Employer's actions related to the subject matter. The Contractor who is not subject to the contract may apply for the awardits exclusion under art. 24 sec. 1 point 13) point 23) of the Act

2. The Procurer will exclude the Contractor based on art. 24 sec. 5 point 1) point 8) of the Act.

Required Documents:

1. Valid as of the date of its submission, a preliminary statement confirming that the Contractor is not subject to exclusion and meets the conditions for participation in the Procedure (Annex 1 to the Application). finishesthe cusp only fills in the alpha section in part IV. 2. Information from the National Criminal Register in the scope specified in art. 24 sec. 1 item 13), point 14) and 21) of the Act and, regarding conviction for offense to custody, pursuant to art. 24 sec. 5 point 5) and 6) of the Act, issued not earlier than 6 months before the deadline for submitting the billPROPOSAL.

3. Certificate of the competent head of the tax office confirming that the Contractor is not in arrears with taxes, issued not earlier than 3 months before the deadline for submitting the application, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular, he provided for the exemption, postponement or spreading of overdue payments in installments or suspension of the execution of the decision of the competent authority in full.

4. A certificate from the relevant organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying contributions social insurance-or health care, issued not earlier than 3 months before the deadline for submitting the application, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables with possible interest or fines, in particular has obtained the legally required exemption, postponement or distribution to installment of delinquent payments or suspension in fullthe decision of the competent authority.

5. A copy from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion based on art. 24 sec. 5 point 1) of the Act

12. The Employer demands from the Contractor, which relies on the ability or situationji other entities under the terms set out in Article 22a of the Act, submitting to these entities the documents listed in points 2-10.

The Contractor may apply for the award of the Contract, who:

1. They will confirm the possession of financial resources or creditworthiness in the amount not less than 300, 000.00 PLN (in words: three hundred thousand zlotys 00/100).

2. They have achieved in each of the last 3 years-turnover, and if the period of business is shorter in this period, the annual turnover in the area covered by the contract, in an amount not lower than PLN 1, 500, 000 (in words: one million five hundred zlotys 00/100).

In the case of Contractors jointly applying for granting The order condition described in paragraph 1. paragraph 2. above, a group of Contractors jointly applying for may meetawarding the Contract - Contractor demonstrating compliance with the condition referred to in paragraph 1. paragraph 2. above may rely on the resources of other entities under the terms of art. 22a paragraph 1 of the Act.

Required Documents:

1) Information of the bank or cooperative savings and credit union, confirming the amount of financial resources owned or creditworthiness of the Contractor for an amount not less thanthat PLN 300, 000.00 (in words: three hundred thousand zlotys 00/100), issued not earlier than one month before the deadline for submitting the application in the procedure for awarding the order.

2) Declaration of the contractor with the annual turnover of the contractor in the area covered by the contract in the amount less than PLN 1, 500, 000 (in words: one million five hundred zlotys), for a period not longer than the last 3 financial years, and-if the period of business is shorter for this period;

In case of signing a contract with the contractor's personal data will be processed pursuant to Article 6 (1) (b), FROM RODO, i.e. to conclude and execute the contract, to which the person whose data is a partyconcern. The data will also be processed for purposes resulting from legitimate interests pursued by the administrator. The legitimate interest of ADO is: to pursue claims arising from the provisions of law.

1.4. recipients of personal data may be: - persons or entities to whom the documentation of proceedings based on art. 8 and art. 96 para. 3 of the Act of29.1.2004 Public Procurement Law (Journal of Laws of 2018, item 1986), hereinafter the "Public Procurement Law", - authorized public bodies, - companies of the Energa Group, based on internal agreements, - correspondence providers, - entities performing documentation destruction services, - entities providing legal advisory services and in court cases, - entities providing IT services insystems that process personal data

1.5. personal data will be processed for the period necessary to achieve the processing purposes indicated in point 1.3

- stored, in accordance with art. 97 ust. 1 of the Public Procurement Law, for a period of 4 years from the date of completion of the contract award procedure, and if the duration of the contract exceeds 4 years for the entire duration of the contract,

- in the scope of the contract, if it is signed, for a period to be completed, after that time the data will be processed for the period required by law or for the period necessary to pursue the claims. 1.6. the obligation to provide personal data directly concerning the contractor who is a natural person is a statutory requirement set out in the provisions of the Public Procurement Law, related to participation in the procurement procedurethe public; the consequences of failure to provide specified data result from the Act;

1.7. in relation to personal data decisions will not be taken in an automated manner, pursuant to art. 22 RODO;
