Framework agreement for the supply of lubricating oils and lubricating agents, with a single economic operator, lasting 4 (four) years, according to the specifications in the specifications.

Frame Agreement for the supply of lubricating oils and lubricating agents, for a period of 4 years, according to the specifications of the specification. These products are necessary in order to provide the necessary consumables necessary for carrying out the repair and maintenance operations for all the equipment used in the production activity of the Forestry Division of Neamt.estimated framework agreement for a period of 4 years: minimum 3 050 liters, maximum 109 500 liters. It is estimated that a subsequent contract will be concluded with an annual periodicity.

Estimated quantities of a subsequent contract for the supply of lubricating oils and lubricating agents: Minimum 3 050 liters, maximum 27 500 liters. 1: Economic operators participating in the procedure - tenderer, ofassociate, subcontractor, third party - should not be found in the situations stipulated in art. 164, art. 165 and art. 167 of Law no. 98/2016 regarding the public procurement.

The way of accomplishing: "Completion of DUAE" by the economic operators participating in the award procedure (tenderer, associated tenderer, subcontractor, third party) with the information related to the situation l(a) Fiscal certificate issued by ANAF certifying the lack of overdue debts at the time of filing, (b) Certificate of local taxes and duties to note the lack of overdue debts at the time of filing.

Note:(c) as the case may be, documents proving that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement, (d) Judiciary Records, Valabat the date of filing, of the economic operator and of the members of the management, management or supervisory body of the respective economic operator or of those having the power of representation, decision or control within it, as it results from the certificate issued by ONRC / constitutive act

(e) other editing documents, as appropriate. 2: Economics Operatorsthose participants in the procedure - the bidder, the associated offeror, the subcontractor, the third party - must not find themselves in the situations stipulated in art. 60 of Law no. 98/2016 on Public Procurement.

Mode of performance: The economic operator (tenderer, associated bidder, subcontractor, third party) will fill in the corresponding requirement in the DUAE and will submit the "by failing to comply with the provisions of art. 60 of Law 98/2016 "with the DUAE until the deadline for submission of tenders.

1) The contracting authority has the right to to ask tenderers in exceptional circumstancesbefore expiry of the period of validity of the offer, the extension of this period. In case of extending the validity period of the offer, the validity period of the guarantee for participation will be extended accordingly. The tenderer has the obligation to communicate to the contracting authority whether or not he agrees to the extension of the offer's validity period. If I offerthe tenderer refuses to extend the period of validity of the tender and of the guarantee of participation, the offer is rejected as unacceptable according to art. 137 par. (2) lit. i) from H.G. no. (2) If an economic operator considers that certain contractual clauses are unfavorable, it may request clarification from the contracting authority, inclusively modifying them so that if these clauses are amended or modified, they will be brought to the attention of all interested economic operators before the deadline for submission of tenders. Amendments to the contract terms may also be submitted with the submission of the tender, following which the contracting authority will apply the provisions of art. 137 par. (3) lit. (b) from H.G.no. 395/2016, with subsequent amendments and completions; 3) If several tenders have been declared admissible by the contracting authority and ranked first and have equal prices, the contracting authority will request clarification through SEAP for loading by the economic operators of new documents containing new prices; 4) On the groundArt. 217 of the Law no. 98/2016, with the subsequent amendments and completions, the documents submitted by the tenderers are public documents. Any person's access to them may be restricted only to the extent that such information is confidential, classified, or protected by an intellectual property right. According to art. 123 par. (1) of GD 395/2016, the bidders will-indicate the information submitted under the procedure which is confidential, classified or protected by an intellectual property right. The indication will be made on each page of the documents in this situation. In the absence of such indication, the contracting authority will understand that the tenderer agrees with the public character of the documents submitted in the procedure;the contracting party reserves the possibility to modify the contract / framework agreement without organizing a new award procedure, based on art. 221 of Law 98 / 2016.
