CPV Description: Supply of lubricants, to meet the needs of the Municipality of Lavreotiki.

Supply of lubricants, to cover the needs of the Municipality of Lavreotiki, for a budget of EUR 116 925, 80, including 24% VAT, for a period of one (1) year or until the budget amount is exhausted whichever of the two occurs first), by award of the contract-the most economically advantageous tender, on the basis of price (lowest price), for the total supply of items, at the price of the study No. 12/2018

Participation guarantee

For the valid participation in the award procedure of this contract, from the participating economic operators (tenderers), a letter of guarantee, which may not exceed two-(2%) of the estimated value of the contract, excluding VAT, amounting to one thousand eight hundred eighty five euros and ninety cents (EUR 1 885.90). In the case of an association of economic operators, the participation guarantee includes and condition that the guarantee covers the obligations of all economic operators participating in the association.-shall be valid for at least 30 days after the end of the period of validity of the tender referred to in Article 2.4.5 of the Invitation, otherwise the offer will be rejected. The contracting authority may, before the expiry of the tender, ask the tenderer to extend the term of validity of the tender and of the participation guarantee before their expiry.

The guarantee is returned to the contractor upon presentation of the guarantee(b) the expiry of the time limit for the commencement of interim measures or the issue of an order for the award of an injunction. and (c) the completion of the pre-contractual audit by the Court of Auditors, in accordance withArticle 35 and 36 of law 4129/2013 (A'52), if necessary.

According to the specific provisions of article 72 of Law 4412/2016:

The participation guarantee is forfeited if the offeror withdraws the offer during this period of validity, provide false information or information referred to in Articles 2.2.3 to 2.2.8 of the competition notice (Articles 73-78 of N.4412 / 2016), does not provide□ Tenders submitted without warranty or without the appropriate warranty, are not taken into account and are rejected as inadmissible.

Performance guarantee

For signing the contract of the contract, a performance guarantee is required in accordance with Article 72 (1) (b) of Law 4412/2016, -the amount of which amounts to 5% of the value of the contract, excluding VAT, and is deposited before or at the time of signing the contract.

The performance guarantee must, in order to be accepted, include at least the sums mentioned in paragraph 2.1. 5) details of the declaration and, in addition, the number and title of the relevant contract. Its contents are in accordance with Ua model included in Appendix C of the Declaration and the provisions of Article 72 of Law 4412/2016.

The performance guarantee for the contract covers in total and non-discriminatory terms the application of all the terms of the contract and any claim by the contracting authority vis--- contractor.

In the event of a change in the contract, as per paragraph 4.5), which entails an increase in the contract value, the contractor is required to lodge, before the amendment, a supplementary guarantee amounting to 5% of the amount of the increase, excluding VAT.

The performance guarantee shall be forfeited in the event of a breach of the terms of the contract as specified in .

The performance guarantee is repaid in its entirety, after the final receipt of the goods in quantitative and qualitative termsof the contract. If the final qualitative and quantitative receipt protocol is reported or there is a delayed delivery, the return of the above guarantees is made after the observations and delays have been dealt with.

The funding body of this contract is the Municipality of Lavreotikis. budget of the Municipality of Lavreotiki in CA: 10-6641, 15-6641, -20-6641, 30-6641, 35-6641, 70-6641 for the financial year 2018 for the period from signing the contract up to 31.12.2018 and the corresponding for the financial year 2019 for the period from 1.1.2019 until the expiry of the contract
