Mechanical loading and transport services according to the requirements of the specifications.

Requirement no. 1. The bidder, the associated bidder, the subcontractor, the third supporter must not find themselves in the situations stipulated in art. 164, art. 165 and art. 167 of the Law no. 98/2016 on Public Procurement.

The way of accomplishment: initially, the DUAE will be presented (elaborated according to the standard form existing in SEAP).

After authentication in the system, details of the DUAE document will be found in the "DUAE Information" section - "DUAE User Guide", respectively "Notification DUAE from AADR. "

After 18.4.2019, DUAEs in .xml format created with the European Commission application can not be opened anymore.

Clarifications:

The DUAE form is available(a) In the case of submitting an offer in association, each associate has the obligation to demonstrate the fulfillment of the requirement. This requirement will also be demonstrated by potential subcontractors. In the case of submission of an individual / joint offer technically-professional by third / third supporters, each supporter has obl- the confirmation documents of the associates / subcontractors / third-party supporters will be submitted, at the request of the contracting authority, only by the tenderer ranked on the first place in the interim ranking made when the evaluation of the tenders is finalized,

(b) The classification in one or more of the situations provided in art. 164, art. 165 and art. 167 of the Law no. 98/2016 on public procurement entails the exclusion of the tenderer from the procedure for awarding the contract, (c) the tenderer ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders shall present, at the request of the contracting authority, the supporting documents proving the fulfillment of the assumed requirements, follow:

- Certificateascertaining the lack of overdue debts at the moment of their presentation regarding the payment of taxes, taxes and social security contributions to the state budget and to the local budget (for the registered office, the secondary offices, as well as the point (s) for which there are obligations of payment),

- The criminal record of the economic operator and of the members of the administrative bodymanagement, or supervision of the respective economic operator or of those who have the power to represent, decide or control within him, as it results from the certifying certificate issued by the ONRC / constitutive document, - as the case may be, documents by which it is demonstrated that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par.(2), art. 171 of the Public Procurement Law 98/2016, - other editorial documents, as the case may be.

If documents of the requested type are not issued in the country of origin or in the country where the economic operator is established or they are not all the situations covered by art. 164, art. 165 and art. 167, any document deemed to be edifying by competent authorities shall be acceptedof the country.

In the case of foreign legal / natural persons, the documents will be transmitted in the language in which they were issued, in a certified copy "according to the original", signed and stamped by the legal representative, accompanied by a certified translation thereof In the sense of the provisions of Article 63 paragraph (1) of Law 98/2016 on public acquisitions, persons withdecision-making in D.S. D. S. Hunedoara will reduce the deadline for the submission of tenders to 15 days from the date of submission of the notice of participation, in accordance with the provisions of art. 74 par. (3) of the Law no. 98/2016. Emergency situation that led to the reduction of the term:

- there are no primary platforms for wood storagethe exploited timber must be transported as urgently as it comes from accidental products and by long storage there is a risk of its depreciation. 217 of Law no. 98/2016 with subsequent modifications and completions, the documents submitted by the bidders have the certificatepublic documents. Any person's access to them may be restricted only to the extent that such information is confidential, classified, or protected by an intellectual property right. According to art. 123 par. (1) of GD 395 2016, tenderers will indicate, reasonably, the information presented in the technical and / or financial proposal that is confidential, classifyor are protected by an intellectual property right under applicable law, having regard to the exceptions imposed by art. 217 par. (6) of the Law no. 98 / 2016.

The communication of the outcome of the procedure will be transmitted to S.E.P. and by using one of the following ways of communication: fax / e-mail / mail.

If for technical reasons exclusively related to the technical performanceof the SEAP computer system, it is not possible to transmit the documents electronically through SEAP, they shall be sent to the contracting authority within the required deadline: by e-mail (electronically signed).

The contracting authority has the right to request the tenderers, in exceptional circumstances, before the expiry of the period of validity of the offer, the extension of this offerperiod. In the event of an extension of the period of validity of the offer, the period of validity of the guarantee for participation will be extended accordingly. The tenderer has the obligation to communicate to the contracting authority whether or not it agrees with the extension of the period of validity of the tender. The tenderer who disagrees with the extension of the offer period is consideredthat he has withdrawn his offer, without this losing the guarantee of participation.

If the tenderer makes use of an association with other operators, third parties or subcontractors, in addition to the documents expressly requested by the applicant. Conditions of participation, including the offer (s) of third party claims / association agreement / subcontractor agreementif necessary, drafted in accordance with the legal provisions.

We mention that to view the awarding documentation it is necessary for the economic operators to have a necessary program to view the electronically signed documents, a free program available on the websites of the electronic signature providers.
