Delivery of a set of network switches

1. Contractors may apply to participate in the procedure, who:

1.1 are not subject to exclusion pursuant to art. 24 paragraph 1 point 12- 23 in connection from art. 24 paragraph 7 and pursuant to art. 24 paragraph 5 points 1, 5, 6 and 7 of the Public Procurement Law;

1.2 meet the conditions for participation in the proceedings regarding:

a. competence or authority to conducta given professional activity, if it results from separate regulations.

1. The Employer provides for the exclusion of the Contractor on the basis of the conditions listed in art. 24 paragraph 5 of the Public Procurement Law:

a) in relation to which liquidation was opened, in the arrangement approved by the court in the restructuring proceedings there is provision for satisfaction of creditors by the liquidation of its assets or the court ordered a liquidatorhis property under art. 332 paragraph 1 of the Act of 15.5.2015 Restructuring Law (Journal of Laws of 2016, item 1574, 1579, 1948 and 2260) or whose bankruptcy was announced, with the exception of the contractor who, following declaration of bankruptcy, entered into an arrangement approved by a final court decision, if the arrangement does not provide for satisfaction of creditors by liquidation of the assets of the bankrupt, unless the court ordered lithe quantification of his assets pursuant to art. 366 section 1 of the Act of 28.2.2003 Bankruptcy Law (Journal of Laws of 2016, item 2171, 2260 and 2261 and of 2017, item 791);

b) being a natural person who has been validly convicted of an offense against the rights of an employee or an offense against the environment, if for committing the sentence of imprisonment, restriction of liberty or a fine not less thanPLN 3, 000;

c) if an in-office member of his management or supervisory body, a partner in a public or partnership company or a general partner in a limited partnership or limited joint-stock partnership or a commercial proxy, a valid conviction for the offense referred to in point b);

d) for which a final administrative decision was issued regarding a breach of obligations under labor lawy, environmental protection law or social security regulations, if this decision was imposed with a fine of not less than PLN 3, 000.

5. The Awarding Entity, before awarding the order, will call the Contractor whose bid has been best rated to be submitted within a designated period, not shorter than 10 days, valid as at the date of submitting the following statements or documents:

a) copy of the relevantof the register or from the central register and information on economic activity, if separate provisions require an entry in the register or the register, in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the Act. If the Contractors jointly apply for the contract - each of the Contractors should submit a document;

d) information from the National Criminal Register in the scope of determiningin art. 24 paragraph 1 item 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of tenders or requests to participate in the procedure; Attention! in art. 24 paragraph 1 point 14 and art. 24 paragraph 5 point 6 refers to an acting member of the management or supervisory body, a partner in a public or partnership company, or a general partner in a limited partnershipor a limited joint-stock partnership or commercial representative;

e) the Contractor`s statement that he has not issued a final court judgment or final administrative decision regarding late payment of taxes, fees or social security or health insurance contributions or - in the case of such a judgment or decision - supporting documents payment of these receivables together with any fromhundreds or fines or concluding a binding agreement on the repayment of these claims in accordance with Annex 3 to the ToR;

f) the Contractor`s statement of the failure to issue a final judgment of the convicting court for the violation of the penalty of restriction of liberty or a fine to the extent specified by the Employer pursuant to art. 24 paragraph 5 points 5-6 of the Act in accordance with Annex 3 to the ToR;

1. Contractors may apply to participate who:

1.1 are not subject to exclusion pursuant to art. 24 paragraph 1 points 12- 23 in connection from art. 24 paragraph 7 and pursuant to art. 24 paragraph 5 points 1, 5, 6 and 7 of the Public Procurement Law.

5. Awarding Entity Before AwardedI will call the Contractor whose offer has been highest rated to be submitted within a designated period of time, not shorter than 10 days, as at the date of submitting the following statements or documents:

b) information from the bank or cooperative savings and credit union confirming the amount of financial resources or Contractor`s creditworthiness within a period not earlier than 1one month before the submission deadline, information confirming the possession of funds in the amount of at least: for lots 1 - 2, 500, 000.00 PLN, for lots 2, 600, 000.00.

The awarding entity does not envisage the awarding of supplementary orders referred to in art. 67 section 1 item 6 and 7 of the PPL, does not provide for the selection of the most advantageous bid by means of an electronic auction. The contractor is obliged toany indication in the offer form part of the order which it intends to entrust to subcontractors.

16. Application of the procedure referred to in art. 24aa Pzp - The Employer will first evaluate the offers and then examine whether the offer which has been assessed as the most advantageous (i.e. has obtained the highest number of points in the evaluation criteria) is not subject to rejection and assess whether thewca is not subject to exclusion and meets the conditions for participation in the proceedings. The Employer may not examine or evaluate the remaining bids.

The bid must be secured by a deposit of:

part 1 - PLN 92 600.00 (say: ninety-two thousand six hundred zlotys 00/100);

part 2 - PLN 24, 000.00 (say: twenty-four thousand zlotys 00/100).

The bid bond shall be paid in PLN, before the expiry of the deadlineplacing bids.

12. The offer should be accompanied by:

12.1 offer form [according to Annex 1 to the ToR];

12.2 price form [according to Annex 2 to the ToR];

12.3. current statement as at the date of submitting the bids, constituting a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure (EAT according to Annex 3 to the ToR).

Document form: original in the form of a docelectronic certificate with a qualified electronic signature;

12.4. confirmation of payment of the bid security (if the bid security is paid in a form other than cash);

12.5. power of attorney if Contractors jointly apply for the order, if the Contractor is represented by a proxy (if applicable).

Document form: original in the form of an electronic document or electronic copy of the documenthere notarized certified as being true to the original with a qualified electronic signature;

12.6. technical description of the offered subject of the order containing all necessary information enabling assessment of the offer`s compliance with the description of the subject of the order, Annex A to the ToR (i.e. list of proper names, configurations and parameters as well as device and software manufacturers inPolish language, etc.). Form of the document: the original in the form of an electronic document with a qualified electronic signature or an electronic copy of the document certified by the Contractor as a true copy of the original.

Public Procurement Law (Journal of Laws of 2017, item 1579 and 2018), hereinafter "Pzp Act";

e) personal data of Contractors participating in the proceedings bwill be stored in accordance with art. 97 paragraph 1 of the Public Procurement Law, for a period of 4 years from the date of termination of the contract award procedure, and if the duration of the contract exceeds 4 years, the storage period covers the entire duration of the contract;
