Open procedure, electronically, for the supply of LPG for the thermal power plants and the crematorium plant of AMA S.p.A. for a period of 36 (thirty-six) months

The contract concerns the awarding of the supply of LPG for the thermal power stations and the crematorium plant of AMA SpA, for a period of 36 ( trsixteen months.

The contract relates to the assignment, for the supply of LPG for the thermal power stations and to the cemetery cemetery of the Flaminio Cemetery, via Flaminia 14.4000 km, for a period of 36 (thirty-six) months, as better indicated in the Tender Regulations and relative attachments.

List and brief description of the conditions: under penalty of exclusion from the tender as essential elements of theforwarded, each competitor (single company / RTI / Consortium) must satisfy, also in accordance with the provisions of the Tender Regulations, the following conditions:

a) registration for activities related to the services subject of the tender in the Business Register or in one of the professional or commercial registers of the State of residence if it is an EU country, in accordance with its provisionsby the art. 83 of Legislative Decree no. 50/2016;

b) the existence of the reasons for exclusion pursuant to art. 80 of Legislative Decree no. 50 / 2016.

Minimum levels of capacity that may be required: under penalty of exclusion from the tender as an essential element of the offer, each competitor (single company / R.T.I. / Consortium) must possess the minimum requirements of economic and financial capacity indicated in the Regulationsof competition.

1. The additional provisions of this Call - including the additional causes of exclusion - are contained in the Tender Regulations and its annexes, which can be freely viewed and downloaded at the URL www.amaroma.it.

2. For the purposes of payment of the due contributions - pursuant to art. 1, paragraphs 65 and 67, of law no. 266/2005 - by economic operators whointend to participate in the tender referred to in this Call, the identification code of the tender (CIG) and the following 8007646685. 3. All declarations, under penalty of exclusion, must be drawn up and signed in accordance with and for the purposes of the PPE.R. n. 445/2000 and digitally signed.

4. AMA S.p.A. reserves the right to:

a) proceed with the awarding even in the presence of only one valid offer, if deemed appropriate and convenient;

b) not proceed with the awarding if no bid is suitable or suitable in relation to the contractual object;

c) suspend, redirect or not award the tender reasonably;

d) not to stipulate motivatamentitlement to the contract even if the award was previously made.

5. Competitors for whom one of the reasons for exclusion pursuant to Legislative Decree no. 50/2016 and, in particular, pursuant to art. 80 of said legislative decree.

6. Bids equal to or greater than the amount based on the tender, as well as incomplete bids, will not be accepted / excluded.partial and / or conditional.

7. Tenders submitted in paper form or by PEC or by any other method of presentation other than that indicated in the Tender Regulations will not be considered valid.

8. The abnormally low offers are identified and evaluated based on the provisions of art. 97 of Legislative Decree no. 50/2016

9. For the procedure in question the automatic exclusion of theabnormal offers according to the provisions of art. 97, paragraph 8 of Legislative Decree n. 50/2016

10. Information and clarifications on the tender documents can be requested from the General Affairs Area - Purchasing Service via the Internet, through the specific section of the Portal, no later than 4.10.2019.

11. The clarifications will be published in electronic format on the AMA website, in the applicationsection of the Portal.

12. All communications between AMA S.p.A. and the economic operators will be transmitted electronically, through the appropriate function present in the details sheet of the awarding procedure.

13. It should be noted that, with reference to the Contract that will be signed with the contractor, the regulation on the traceability of the financial flows ofreferred to in Law 13.8.2010, n. 136.

14. It should also be noted that the contractor with whom the contract will be signed, during the execution of the contract and for its entire duration, must keep AMA constantly updated in order to maintain the possession of the requisites required by the art. . 80 of Legislative Decree no. 50/2016 and subsequent amendments

15. The competitors, with the presentation of the offers, allow the processing of personal data, also personal, pursuant to EU Regulation no. 2016/679 and of the Legislative Decree n. 196/2003 and amendments, for bankruptcy and contractual requirements.

16. AMA does not make use of an arbitration clause which, therefore, is not contractually provided for.

17. If the conditions are met, AMA can use the amicable agreement, pursuant to art. 205 of Legislative Decree 50 / 2016.
