Purchase and replacement of 4 lifts from 1 Mai Station and North Railway Station 2.

Request no. 1 Declaration on non-compliance with the provisions of art. 177, 178 para. (1) and (2) and art. 180 of Law no. 99/2016. The way in which the fulfillment of the requirement can be demonstrated: fill in the DUAE by the economic operators participating in the award procedure, with information related to their situation. This document will be completed by each of the tenderers / associated tenderers / proposed subcontractors / third party supporter.

At the request of the entity againstthe supporting documents proving the fulfillment by the economic operators of the ones declared in the DUAE will be mandatory submitted by the tenderer ranked first.

The supporting documents may be:

- Certificate of absence of debts regarding the payment of taxes, contributions to the consolidated general budget (local budget, state budgetetc.) at the moment of the presentation, - The criminal record of the economic operator and of the members of the management, management, supervision, supervision, controlling body of the respective economic operator, those with power of representation, decision-making, control within it, as it results from the ONRC / Founding Document issued by the Founder,

- Where appropriate, documents demonstrating thatthe economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Law no. - Other editorial documents, as appropriate.

Special warnings:

The failure of the DUAE with the offer (including the affiliate / subcontractor) entails rejection of the offer as unacceptable;

With the submission of the offer and the DUAE, the bidder has obthe submission of the subcontracting agreement and / or the association agreement.

Bidders of foreign legal persons will present any editorial documents issued by the competent authorities of the country in which they are resident to prove the fulfillment of the obligations to pay the taxes / to the state budget and the local budget, in accordance with the legislationof the country of residence. If documents in the country of origin or in the country in which the tenderer is established are not of the kind referred to in the first paragraph or the documents do not cover all the situations referred to in art. 177, 178, 180, a declaration on the sole responsibility of the tenderer will be accepted, if there is no legal provision in the country concernedself-declaration, a genuine declaration made before a notary, an administrative or judicial authority or a professional association with powers in this respect.

In the case of foreign legal persons, the documents will be accompanied by a certified translation of these in the Romanian language.

Any economic operator in any of the situations provided in art. 177, 178, 180 of Law no. 99/2016, which draws the exclusion from the award procedure may provide evidence, within the meaning of para. (3) of art. 184 of Law 99/2016, which shows that the measures taken by it are sufficient to prove its credibility in terms of the reasons for exclusion, with the corresponding application of the provisions of para. (4) and (5) of the same articletanks can raise certificates and obtain information on taxes and duties to the consolidated state budget / local budget from the National Agency for Fiscal Administration, the General Directorate of Public Finances and respectively from their city halls. 2 For the purpose of carrying out the verifications provided in art. 71, art. 72 and art. 73 of Law no. 99/2016 will be presenteda declaration on own responsibility for non-compliance with the situations provided in art. 73 letter d) and e) of the Law no. 99/2016, according to the model presented in the Forms section

1) The bidder submits the tender prepared in accordance with information and requirementscontained in the procurement documents, accompanied by the participation guarantee and the documents or the European single acquisition document. The contracting entity accepts at the time of submitting the DUAE bids; 2) If the bidder intends to subcontract a part / s of the contract, the DUAE also includes the required information on subcontractors. The contracting entity may request-tenderers to submit all or some of the supporting documents as evidence of the information contained in the DUAE at any time during the conduct of a procurement procedure if this is necessary to ensure the proper conduct of the procedure. 3) If, following the evaluation of the bids, 2 or more bids rank first, with the same total score, the tie will be made taking into account the score obtained in the evaluation factors, in descending order of their weight. If equality is maintained, the contracting entity will request new profinancial applications and winning bidding will be the one with the lowest financial proposal; 4) In the case of an association, the tender must include a preliminary association agreement. The association agreement will state that all associates assume joint responsibility for the performance of the contract, that the association's leader is empowered to oblige and receive instructions from and to nthe works of all associates, individually and collectively, and that the association leader is responsible for the execution of the contract, including payments. The agreement must also stipulate that all associates are bound to remain in association for the entire duration of the contract. The bidder, if it is made up of an association involving several economic operators, will sign a declarationwhich obliges that if the joint offer is declared winner it will legalize the association and the legalized association agreement will be presented to the purchaser in original, before the date of signing the contract. The model of the Association Agreement is presented in the "Forms" section;

5) The bidder is not entitled within the same procedure:

(a) to submit two or more of the(b) to submit an individual / joint tender and to be nominated as a subcontractor in another tender, subject to the exclusion of the individual offer or, as the case may be, of the one to which the bidder is associated.

Requests for clarifications and their answers to this documentation-will exclusively address the SEAP / SICAP in the dedicated section of the tender notice. The contracting entity shall not comply with the requests addressed by means of communication other than that specified in the awarding documentation. Therefore, for the submission of clarification requests in connection with the awarding documentation, operatorsThe economic agents must register in the SEAP / SICAP.

Clarification requests shall be submitted within the deadline set by the contracting entity according to the provisions of art. 172 of Law no. 99/2016. The contracting entity will only respond to requests for clarifications addressed by the set deadline.
