Open procedure for awarding the Third Party Civil Liability Insurance coverage service and RCT / O Opera lenders - for the Province of Como for the period 04.30.2019 12.31.2020.

Insurance coverage of civil liability towards third parties and towardsworkers.

Economic operators who declare the following conditions will be admitted to participate:

1) Non-existence of the causes of exclusion pursuant to art. 80 D.Lgs. 19.4.2016 n. 50.

2) authorization for the exercise of insurance activity on the Italian territory, pursuant to the sector regulations, in the branches relating to the insurance coverage provided for each lot forwhich intend to compete;

3) entry in the Business Register at the Chamber of Commerce, Industry, Handicraft and Agriculture for the activity related to this contract or, for companies from other EU Member States not resident in Italy, a similar registration on basis of the legislation of the State in which they have their registered office, pursuant to art. 83, paragraph 3 of Legislative Decree no. 50/2016;

In the houseo Temporary Grouping of Companies the requirements of points a) b) must be owned by each participating company.

Competent economic operators must, under penalty of exclusion of the procedure, be in possession and present the following documentation proving possession of the requisites of economic and financial capacity:

4.a) declaration attesting to the possesor of a net assets (ie Guarantee Fund, in the case of Insurance Mutual) of not less than 50, 000, 000.00 EUR (fifty million euros) for Companies authorized to operate in the Non-Life Division;

Or alternatively

4. b) possession of a rating equal to or greater than BBB issued by Standard & Poorso by Fitch Ratings, equal to or greater than B if issued by the AM Best Agency, equal or abovefurther to Baa if issued by the Agency Moody's, in the course of validity on the date of publication of the notice, with the indication of the specialized company that has attributed it. The amount of the guarantee is reduced by 50% for economic operators inpossession of the quality certification in compliance with the European standards of the UNI CEI ISO 9000 series and of the other reductions envisaged by the art. 93, c. 7 of Legislative Decree 50 / 16.

Participation in the tender is reserved for individual or associated insurance companies (hereinafter also referred to as Insurance Companies or Companies), solely through their own General Management, General RepresentativesHierarchies, authorized to carry out insurance activities on the Italian territory, pursuant to the sector regulations, in the branches relating to the aforementioned coverages, for which they intend to compete, to be proven by self-declaration.

The subjects based in other States are admitted to participate as set forth in art. 45 of Legislative Decree no. 50/2016 through the production ofequivalent documentation according to the regulations in force in the respective countries.

In the case of aggregate participation, the provisions of art. 48 of Legislative Decree no. 50/2016 in the current text. In this case the bid must contain the commitment that, in the event of awarding the tender, the same Companies will confer a special collective mandate with representation to one of them, to indicateand in the offer itself and qualified as a group leader, which will stipulate the contract in its own name and on behalf of the principals.

In accordance with paragraph 4 of art. 48 of the aforementioned Legislative Decree no. 50/2016, the offer must also indicate the parts of the service that will be performed by the individual economic operators.
