Framework agreement for the provision of legal assistance to ATP - Public law

Competition exposition of framework agreement on ongoing legal assistance in public law to ATP.

ATP is an independent, self-governing institution, which is subject to a number of public law rules as a body governed by public law. ATP is also a financial undertaking under the supervision of the Danish Financial Supervisory Authority.

The supplier must - by ATP`s ongoing needs - provide legal services to ATP in the form of public service remuneration, and in particular the following areas:

(A) Employment and employment law

(B) Occupational Injury Law, including in relation to the Labor Market Survey`s Resource Area

(C) Compliance - in relation to public sector(d) Administrative law - (E) Debt collection

(F) Law of insolvency, including in relation to the wage earners` guarantee fund

(G) Competition law (but not merger control)

(H) Personal data

(I) Public procurement law

(J) Other public law regulation.

ATP has a large number of lawyers employed in-house within various disciplines. The need for external legal assistance will therefore often mean that external assistance consists ofHighly specialized competences within the various subject areas.

Participation in the competition release can only take place electronically via the contracting authority`s applied electronic tender system (Mercell), cf. the address in the tender notice section I.3).

As soon as the application contains several editions (versions) of the same document, the latest uploaded version will be the current one. All communication in foIn connection with the competition release, including questions and answers, must be made via Mercell.

The applicant must complete and attach the common European tender document (ESPD) directly to Mercell. For an association of companies (eg a consortium), a separate ESPD must be submitted for each participating economic operator. If an applicant is based on the other units` form (e.g.or the sister company), the Applicant must also submit supporting statements or other documentation proving that the applicant actually lines this form. Template for support declaration is attached to the competition conditions. The other company (s) to which the applicant supports, must submit independent versions of the ESPD in Mercell.

ATP will exclude an applicant from participating in the competitionThe extension, if the applicant is covered by the mandatory exclusion grounds mentioned in sections 135 and 136 of the Public Procurement Act.

In addition, ATP will exclude applicants from participating in the competition release if they are covered by an exclusion ground in section 137 (1) of the Public Procurement Act. 1, no. 1, no. 2, no. 4, no. 6 or no. 7.

Unless the applicant has provided sufficient evidence that this is reliableIn accordance with section 138 of the Procurement Act.

ATP uses the ESPD as a declaration of faith and law, and the Offeror will therefore not, in the first instance, be charged with additional documentation for matters stated in the ESPD. However, ATP is entitled to request the Offeror for documentation of the information provided in the ESPD, as soon as ATP considers that this is necessary.to apply similar procedures, as in section 159 (2) of the Public Procurement Act. 5, if applications or offers do not meet the formal requirements of the competition material.

It should be noted that each applicant can only submit an application for pre-qualification. point II.1.6) The reason for not dividing the framework agreement into sub-contracts is that it is considered that better prices and better coherence can be achieved in ATP`s total tasks by not dividing into several sub-contracts. However, ATP has also divided legal assistance into two separate framework agreements, respectively. one about public law (this competition competition) and one about private law. Item IV.1.3) Collection of competition involves the drawing up of a framework agreement - a technical error in point IV.1.3
