1. Declaration regarding the non-classification in art. 164 of Law 98/2016

The way in which the requirements can be demonstrated:

The DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. All the documents required for the purpose of demonstrating the fulfillment of the qualification criteria will be presented in Romanian. In the case of bidders of a nationality other than the Romanian one, the documents will be transmitted in the language in which they were issued, accompanied by an authorized translation of them into the Romanian language;

3) If 2 or more aleaflets are ranked on the first places, with equal scores, the division will be done taking into account the score obtained by the evaluation factors in descending order of their weights. In case the equality is maintained, the contracting authority has the right to request new financial proposals, through the electronic system e-bidding.ro and the winning bid will be designatedthe one with the smallest financial proposal, according to the provisions of art. 139 para. (3) of H.G. no. 395/2016, with the subsequent modifications and completions;

4) The operators will send the requests for clarifications regarding the award documentation only through the dedicated section of the SEAP platform, at the latest 19 days before the deadline for submission of tenders. The contracting authority willresponds to requests for clarifications at least 10 days before the deadline for submission of tenders. The contracting authority will respond to requests for clarifications transmitted by means other than SEAP only if, for reasons related to the operability of SEAP and not attributable to the economic operator, they could not be transmitted within the deadline set by the contracting authority throughthrough the platform;

5) The economic operators participating in the procurement procedure agree that the personal data necessary to carry out the procedure will be managed and processed by the contracting authority, in accordance with EU Regulation no. 679 of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movementie these data, with mandatory applicability starting with 25.5.2018, art. 4 points 11.
