The supporting documents that support the requirements 1 and 2 and which will be presented following the request of the contracting authority only by the economic operators ranked on the first, second and third place (leader, associate, third party supporter, subcontractor - if applicable ), are:

- certificate of fiscal attestation for legal persons regarding the payment obligations to the cons budgetforgotten of the state in original or certified copy on its own responsibility for compliance with the original, document stating that the bidder does not have outstanding debts at the time when he must present this certificate. In this case, the provisions of art. 166 para. (2) of Law no. 98/2016 regarding public procurement with subsequent modifications and completions,

- certificateof fiscal attestation for legal persons regarding the payment obligations to the local budget in original or certified copy on their own responsibility for compliance with the original, document stating that the bidder has no outstanding debts at the moment when he must present this certificate. In this case, the provisions of art. 166 para. (2) of Law no. 98/2016 regarding achpublic statements with subsequent amendments and completions,

- the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control within it, so as it results from the certifying certificate issued by the ONRC / the constitutive document or in the case of the offerto foreign nationals, equivalent documents issued in the country of residence.

For foreign legal persons: the economic operator will present edifying documents issued by authorities of the country of origin (certificates, judicial records, other equivalent documents) in order to obtain membership / registration with organs of the country said. They will be presented in accordance with the legal provisions, attesting thatthey do not register outstanding fiscal obligations under the law of the incident in the country of residence. All the answers to clarifications required by the economic operators or formulated by the contracting authoritywill be posted on the website www.e-licitatie.ro

Instructions on DUAE see the document "Instructions for bidders" attached to the present award documentation, point 1 instructions on DUAE.

Without prejudice to the provisions of Law no. 182 / 2002 regarding the protection of classified information, with the subsequent modifications and completions, the economic operator will specify in the submitted offerthose information included in the technical proposal that they declare confidential.

The confidentiality must be demonstrated by any means of proof. In the absence of documents proving the confidential character, the documents will be considered as non-confidential.

Given that the contracting authority will sign the framework agreement only with the economic operators located on the 1st, 2nd place, III, as the case may be, the way of separating the offers with equal prices will be made as follows:

1) If the commission finds that more than 2 offers have been admitted / presented in SEAP with the same prices to the bidders ranked on the 1st place, the contracting authority will send through SEAP, a request for clarification regarding the submission of new improved financial proposals (with 2 decimals)), and the economic operators will send their answer using the facilities offered by SEAP, in which case the contract will be awarded to the first 3 bidders who have the lowest price;

2) If the commission finds that more than 2 bids have been submitted admissible with equal prices by the bidders ranked on the second place, the way of their separation will be done by request, in SEAP, of a new improved financial proposal (by 2 decimal places), and the economic operators will send their answer using the facilities offered by SEAP, so that the bidder ranked in the first place is not affected, respectively the new financial proposal is not equal or lower than the offer ranked 3rd;

3) If the commission finds that more than 2 admissible offers have been submittedwith equal prices by the bidders ranked on the third place, their way of dividing will be done by requesting in SEAP, a new improved financial proposal (by 2 decimal places), and the economic operators will send their answer using the facilities offered by SEAP, so that the bidders ranked on the second place are not affected, respectively the new financial proposal is not equal tou lower than the offer classified on the second place.

The terms / dates of submission of the new financial proposals will be communicated in the request sent by the contracting authority.

The contracting authority will conclude subsequent contracts with the economic operator ranked on the first place until it declares inability to supply the products or terminate the framework agreement with it. In thatsituation the contracting authority will conclude subsequent contracts with the economic operator ranked on the second or third place if the one ranked on the second place refuses to sign the subsequent contract.
