The general objective of the project is to strengthen the institutional capacity and the efficiency of the activity in the Tarnăveni municipality through strategic planning, simplification of administrative procedures sand reducing bureaucracy for citizens, implementing measures from the back-office perspective (adapting internal working procedures, digitizing archives) and front-office for the public services provided. This objective will be achieved by developing and adapting existing applications and introducing new application solutions (electronic archiving, document capture, workflows and manpoweragement the physical archive of documents) that will digitally provide the basic workflows within the institution, in order to streamline the processing of documents, avoiding interruptions that may occur in the information flows of the institution, thus reducing delays in the decision-making process with impact on operational activities, thus ensuring online access to public management serviceslocated in the municipality of Tarnăveni.

Main Site: Buyer`s headquarters, Piata Primariei no. 7, the municipality of Tarnaveni.

The modernization of the computer system of the City Hall of Tarnăveni is considered. The contract to be awarded based on this specification implies:

- IT services, consisting of all the services for the implementation of the system, in accordance with the requirements ofspecifications;

- training services for users and administrators of the implemented IT solutions;

- perpetual licenses for software, in accordance with the requirements of the specifications;

- equipment required by the system in accordance with the requirements of the specifications.

According to those provided in the financing application SMIS code 129682, the estimated value of the contracttului is 2 315 512 RON excluding VAT, including the following products and services:

- IT services: 1 384 000 RON excluding VAT;

- equipment: 160 549 RON excluding VAT;

- license package: 770 963 RON excluding VAT;

- training services: 34 000 RON excluding VAT.

Requirement no. 1: the bidders, associations, third-party supporters and subcontractors must not be found in the situations provided in art. 164 of Law 98/2016 prregarding the public procurement.

The method of fulfillment and applicability within the procedure: completion of the DUAE by the economic operators participating in the award procedure (bidder / candidate / associate, third party supporter and subcontractor) with the information related to their situation, according to ANAP Notifications of 8.4.2019 and 2.7.2019.

Requirement no. 2: the bidders, associations, third-party supporters and subthe contractors must not find themselves in the situations provided in art. 165 of Law 98/2016 on public procurement.

The method of fulfillment and applicability within the procedure: completion of the DUAE by the economic operators participating in the award procedure (bidder / candidate / associate, third party supporter and subcontractor) with the information related to their situation, according notificationtheir ANAP from 8.4.2019 and 2.7.2019.

The documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked in the first place in the intermediate ranking drawn up at the end of the evaluation of the offers. These documents can be:

- the certificate of fiscal attestation regarding the payment of the obligations due to the Buthe state budget and to the state social insurance budgets (health, pensions, unemployment), issued by ANAF, in original, certified copy or certified copies according to the original, from which it can be seen that the bidder has no due dates at the date of presentation;

- the certificate regarding the payment of local taxes and taxes, issued by the local authorities, in original, certified copy or certified copiesaccording to the original, from which it can be seen that the tenderer does not have debts due on the date of submission;

- the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued de ONRC / the constitutive act;

- as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement;

- other supporting documents, as the case may be.

Notes:

1. The contracting authority excludes from the award procedure any economic operator with whom it has knowledgenta violated its obligations regarding the payment of taxes, taxes or contributions to the general consolidated budget, and this was established by a court decision or administrative decision having definitive and binding character according to the law of the state where the respective economic operator is set;

2. The contracting authority excludes from the award procedurere an economic operator where it can demonstrate by any appropriate means that the respective economic operator has violated its obligations regarding the payment of taxes, taxes or contributions to the general consolidated budget;

3. The economic operator is not excluded from the award procedure if, before the exclusion decision, he fulfills his obligations by paying taxes, taxes orcontributions to the general consolidated budget due either by other means of extinguishing them or benefiting, according to the law, from their scheduling or other facilities for their payment, including, as the case may be, any accrued interest or late payment penalties or fines;

4. By exception from the provisions of art. 165 para. (1) and (2), an economic operator does notis excluded from the award procedure when the amount of taxes, fees and contributions to the general consolidated budget due and outstanding is less than RON 10, 000.

Requirement no. 3: the bidders, associations, third-party supporters and subcontractors must not be found in the situations provided in art. 167 of Law 98/2016 on public procurement.

The method of fulfillment and appleligibility within the procedure: completion of DUAE by the economic operators participating in the award procedure (bidder / candidate / associate, third party supporter and subcontractor) with the information related to their situation, according to the ANAP Notifications of 8.4.2019 and 2.7.2019.

Requirement no. 4: the bidders (associations), third-party supporters and subcontractors must not find themselves in the situations beforeseen at art. 59 and art. 60 of Law no. 98 / 2016.

Note:

1) Failure to fill in the SEAP of the DUAE with the offer (including for associates / subcontractors / third party supporters) will result in its rejection as unacceptable. according to art. 137 (2) lit. b) from H.G. no. 395/2016, with subsequent amendments and completions.

Requirement 1: econom operatorshere they must prove a form of registration under the law of the country of residence, stating that they are legally constituted, that they are not in any of the situations of cancellation of the constitution, as well as the fact that they have the professional capacity to carry out the activities that are the subject of the contract.

Fulfillment mode: completing the DUAE by the economic operators seemparticipating in the award procedure with the information related to their situation, according to the ANAP Notifications of 8.4.2019 and 2.7.2019, following that the supporting document, respectively ONRC certificate or, for foreign bidders, equivalent documents issued in the country of residence, will be presented only at requesting the contracting authority, at the end of the evaluation of the offers, by the tenderer iin first place ranking. The requested activity must be authorized according to art. 15 of Law no. 359/2004. The information contained in the respective document must be real / valid at the date of presentation of the document.it is presented in the original, a certified copy or a copy in accordance with the original and will be accompanied by an authorized translation. legally constituted, that is not in any of the situations of cancellation of the constitution as well as the deedl that has the professional capacity to carry out the activities that are the object of the contract.

For the Romanian legal persons the documents are presented in original, legalized copy or copy according to the original, and for foreign legal persons the documents are presented in original, legalized copy or copy according to the original and they will be accompanied by an authorized translation.

Specify figureof annual average business. The economic operator must present the average of the global turnover for the last 3 years, financially concluded, respectively 2019, 2018, 2017 minimum: RON 4, 500, 000. For the equivalence, the average annual RON / foreign exchange rate communicated by the NBR for each year will be taken into account.

1. The first place bidders having equal offers will be invited on a date that will be communicatedit is about to submit in a sealed envelope, at the headquarters of the contracting authority, a new financial offer. Repeat the procedure until the offers are split;

2. All the answers to the requests for clarifications related to the award documentation will be published in an electronic file in the SEAP attached to the participation announcement, to "Documentation and clarifications" at the Internet address www.e-licitatie.ro

4. DUAE will be required to be completed by all bidders;

5. In case of submitting the joint offer, each associate will present his / her own DUAE. Also the third party supporters or subcontractors on whose capacity the bidder / candidate is based have the obligation to submit DUAE in SEAP;

6. All the requirements inthe specifications, otherwise the offer will be considered non-compliant;

7. The price of the contract is not updated;
