The subject of the contract is the implementation of the task called "Supplementary services and supplies of necessary equipment and software." includes 7 parts: Part 1: service of designing, implementing and launching the Social Participation Portal - 1art, Part 2: design, execution and implementation of the commune`s website - 1 item, Part 3: delivery of legal editors - 8 items, Part 4: service of developing procedures with instructions for the Trusted Profile Confirmation Point - 4 items, Part 5: delivery desktop computers, type 2 - 4 pieces, Part 6: supply of desktop computers, type 3 15 pieces, Part 7: delivery, posadosetting and starting an emergency power supply system of the server room 1 item. Services and deliveries will be carried out to a different extent to / at the premises of 5 different Project Partners: Piaski Commune, Łopiennik Gorny Commune, Ulan-Majorat Commune, Chełm Commune and Krasnostawski Poviat.

Service design, implementation and launch of the Social Participation Portal (calledit hereinafter the Platform or System) "Part 1 of OPZ". The Employer requires a 60-month warranty period on the subject of the order, counting from the time of receipt of the final subject of the order. The subject of the Contract includes in particular:

a. Graphic design of the Platform along with the logo, content and texts placed on Platform (providing literary and graphic creation of the platform along with its softwarea) and submitting their design to the Employer for approval,

b. graphic design of promotional content and texts placed on the Platform to promote the Platform and presenting them to the Employer for acceptance,

c. execution and / or delivery of ready software having the functionalities indicated in SOPZ,

d. launch of e-services (including development of e-services cards and adaptationsor e-PUAP forms in accordance with the requirements of SOPZ).

e. implementation of the System, including:

- conducting instructions at the premises of each of the Project Partners for the persons indicated by them, and job assistance for system users, in the time necessary for the proper use of the system, but not less than 8 hours at the premises of each of Project Partners,

- byconducting system penetration tests,

- development of the Platform`s regulations, model regulations for providing services to users and instructions for using the e-services offered to them, model contracts with Platform users and other documents related to the implementation of tasks related to the operation of the Platform, including providing service legal regulations regarding the development of necessary ruleslaminates and contract with Platform users,

- development of documents specifying the principles of the System`s functioning at individual Employers jointly implementing the order and how to conduct social consultations by electronic means.

f. providing documentation specified in the Agreement, including SOPZ,

g. providing the Employer and Project Partners with a license to use the Portal withassessment of the fulfillment of each of the requirements of the subject of the order (on request of the Contractor, the Employer will provide an editable version of the description of the subject of the order - the Contractor will be able to refer in its content to each of the requirements by, for example, indicating the software parameter offered in close proximity to the content specifying the parameter specified in the requirement ),

8.5 Ifthe principal has its registered office or place of residence outside the territory of the Republic of Poland instead of the documents referred to in point 8.3 shall submit respectively:

8.5.1 [EDOC / EPK or ECOPDOC / EPK] in item 8.3.1 submits information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the Contractor is establishedContractors may apply, who:

1.1 are not subject to exclusion in the circumstances referred to in art. 24 paragraph 1 Public Procurement Law,

1.2 meet the conditions for participation in the proceedings regarding:

1.2.1 competences or powers to conduct specific professional activities, provided that it results from separate provisions - the Employer does not set a specific condition in this respect,

1.2.2 economic situation lThe Employer does not set a detailed condition in this respect,

1.2.3 technical or professional capacity

a) regarding the condition of technical capacity - the Employer will consider that the Contractor will meet the condition, if it is demonstrated performance within the last 3 years before the deadline for submission of tenders, and if the period of business is shorter - in this period, he performed:

- in the case of Cteeth 1 (bottom of the contract with a value of not less than PLN 10, 000.00 gross including the supply of software,

- for Part 4 (j than PLN 8, 000.00 gross, consisting of the supply of computer sets with the operating system,

- for Part 6 (delivery and commissioning of the server room emergency power supply system, the system included a power generator.

b) regarding the condition of professional capacity - the Awarding Entity will consider that the Contractor will meet the condition, if he shows that he will direct each part of the public order for implementation (i.e. separately for each part of the order on which the tender is submitted) - persons who possess usthe following qualifications:

- for Part 1 (parts 3 to 6, the Employer does not set a detailed condition in this respect,

- in the case of Part 7 (a generator house-based facility acting as the commissioning or project manager or as deputy commissioning or project manager or equivalent.

2. The Employer may, at any stage of the procedure, consider that the Contractor does not have the required capabilities, if the involvement of the Contractor`s technical or professional resources in other economic activities of the Contractor canpoint 1.1, and in Chapter Va, point 1, points 1.1-1.2, i.e. referred to in art. 24 section 1 and section 5 points 1 and 8 of the Public Procurement Law, must be demonstrated by each of the Contractors.

4. The Contractor may confirm compliance with the conditions referred to above in point 1.2.3. Rely on technical or professional capacity for the relevant situation and for the specific contract, or part thereofor the financial or economic situation of other entities, regardless of the legal nature of the legal relations which it has with him.

5. The Employer also informs that the "relevant situation" referred to above in the preceding point will occur only if:

5.1 The Contractor, which relies on the capabilities or situation of other entities, must prove to the Employer thatthe contract will have the necessary resources of these entities, in particular, presenting the undertaking of these entities to make available to it the necessary resources for the purposes of the contract.

5.2 The Employer will assess whether the technical or professional capabilities or technical or economic situation made available to the Contractor by on demonstration by the Contractor ofreviewing the conditions of participation in the proceedings and will examine whether there are grounds for exclusion against this entity, as referred to in art. 24 paragraph 1 point 13 22 and par. 5 points 1 and 8 of the Public Procurement Law

5.3. With respect to conditions relating to education, professional qualifications or experience, Contractors may rely on the abilities of other entities, if these entities carry out work, to implement whiche abilities are required.

Va. GROUNDS FOR EXCLUSION REFERRED TO IN ARTICLE 24 (5) OF THE PZP ACT 1. The contracting authority provides, additionally, based on art. 24 paragraph 5 points 1 and 8 of the Public Procurement Law, exclusion of the Contractor:

1.1 in relation to which the liquidation was opened, in the arrangement approved by the court in the restructuring proceedings it is envisaged to satisfy the creditors by the liquidation of his assets or the courtordered the liquidation of his assets pursuant to art. 332 paragraph 1 of the Act of May 15, 2015 Restructuring Law (Journal of Laws of 2016, item 1574, 1579, 1948 and 2260) or whose bankruptcy was announced, with the exception of the Contractor who, following the declaration of bankruptcy, entered into an arrangement approved by a final court decision, if the arrangement does not provide for satisfaction of creditors by liquidation of the bankrupt`s assets, unless the court ordered the liquidation of his property pursuant to art. 366 section 1 of the Act of February 28, 2003, the Bankruptcy Law,

1.2, which violated the obligations regarding the payment of taxes, fees or social security or health insurance contributions, which the Awarding Entity is able to prove by means of appropriate evidence, except in the case referred to in Art. . 24 paragraph 1 item 15) of the Public Procurement Law, unless the Contractor has made the payment of taxes, fees or social security or health insurance due together with interest or fines or has entered into a binding agreement on the repayment of these debts.

VI. LIST OF STATEMENTS OR DOCUMENTS CONFIRMING MEETING THE CONDITIONS FOR PARTICIPATION IN THE PROCEEDINGS AND NO BASIS FOR EXCLUSION

A. Documents and statements submitted with the offer:

1. executionIn order to confirm compliance with the conditions for participation in the proceedings set out in Chapter IX of the ToR and to demonstrate that there are no grounds for exclusion, the adviser submits together with the offer a current declaration on the day of submitting the offers in the form of a single European order document (JEDZ) [EDOC / EPK]. Necessary information about the Single European Procurement Document (EAT):

1.1 Employer informduring these proceedings for the award of a public contract, the provisions of the Act of 29 January 2004 Public Procurement Law (Journal of Laws of 2017, item 1579 as amended), hereinafter referred to as the "Public Procurement Law" or "Public Procurement Law", and in matters not regulated by the Act Public Procurement Law, provisions of the Civil Code. In these proceedings, the Employer will use the so-called REVERSE PROCEDURE, i.e.t the procedure specified in art. 24aa of the PPL Act, pursuant to which he will first evaluate the offers in terms of the conditions for rejecting the offer on the basis of art. 89 paragraph 1 of the Public Procurement Law and the criteria for assessing the offers described in the ToR. Then, only in relation to the Contractor whose tender will be assessed as the most advantageous will make an subjective assessment of the Contractor, i.e. examine the initial statement, and the nexte requests submission of documents pursuant to art. 26 section 1 of the Public Procurement Law

1. The Employer requests Contractors to lodge a security deposit.
