The contracting authority intends to acquire "Services for implementing an integrated platform dedicated to operational management" The objective of the present procedure is the acquisition ofimplementation services of an integrated platform dedicated to operational management, hereinafter referred to as ERP, for the CNCIR headquarters, together with the licenses necessary for the system`s operation, as well as a security solution for infrastructure protection, including advanced mechanisms for preventing computer attacks and access. secured in ERP application modules.

The contracting authority intends to purchase "Services for the implementation of an integrated platform dedicated to operational management". The objective of the present procedure is the acquisition of services for the implementation of an integrated platform dedicated to operational management, hereinafter referred to as ERP, for the headquarters. principal at CNCIR, impIt reunites with the licenses necessary for the functioning of the system, as well as a security solution for the protection of the infrastructure, comprising advanced mechanisms for preventing the computer attacks and the secure access in the modules of the ERP application.

Requirement no. 1. The bidder (individual / association) must not be in the exclusion situations provided in Law 98/2016 art. 164, 165 and 167. Also, according to the provisions of art. 170 and 183 of Law 98/2016, the subcontractors and third-party supporters declared in the tender must not be in the exclusion situations provided by art. 164, 165 and 167 of Law 98/2016.other subcontractors and third party supporters, if nominated in the offer. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked on the first place in the intermediate ranking prepared at the end of the evaluation of the bids (including the associate / subcontractor or yousupporting rt, as the case may be), according to art. 196 paragraph (2) of Law 98/2016 on public procurement.

These documents are:

1) certifying certificates issued by ANAF and the local authority regarding the absence of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget of the state and to the local budget for the registered office, secondary offices and points of lucru for which there are payment obligations, according to the information from the certifying certificate ORC;

2) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by ONRC/ the constitutive act;

3) as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement;

4) other edifying documents, as the case may be.

Note: the documents must present current information at the time of presentation. If there are uncertainties relatedin the case of an economic operator, the contracting authority has the right to request information directly from the competent authorities. If in the country of residence no specific certifications are issued regarding the fulfillment of the payment obligations to the state budget and the local budget the foreign bidders have the right to present any document issued by the competent authorities of the country in whichresident butter, to prove the fulfillment of the requirement, in accordance with the legal provisions in the country in which it is established.

For foreign natural / legal persons:

(a) edifying documents proving a form of registration in accordance with the legal provisions of the country in which the bidder is a resident. Requirement no. 2. Failure to comply in the situations of incompatibility and conflict of interests provided by art. 59 and 60 of Law 98 / 2016.

Also, according to the provisions of art. 170 and 183 of Law 98/2016, the subcontractors and third party supporters declared in the tender must not be in the situations provided by art. 60.
