The object of this order is the delivery and implementation of the Equipment together with the necessarySoftware, provision of warranty service and delivery of training vouchers, in accordance with the submitted offer of the Contractor and the requirements of the Employer specified in OPZ.

2. The subject matter of this order is the delivery and implementation of the Equipment along with the necessary Software, providing the services of the dialectand delivery of training vouchers in accordance with the Contractor`s submitted offer and with the Ordering Party requirements specified in OPZ.
3. The scope of the subject of the contract is specified in the Model Contract (Annex 2 to the Terms of Reference) and Description of the subject of the Order Attachment No. 1 to the Terms of Reference (Annex No. 1 to the Contract Model).
Chapter IV of the ToR, para. 7. Based on art. 25 para. 1 point 2 of the Act, to confirm thatthe ordered item meets the requirements specified by the Ordering Party, the Ordering Party requests submission of a Technical Specification form filled in and signed by the Contractor, ie a completed and signed Annex No. 1 to the Terms of Reference (Description of the item, order / Technical Specification). Chapter VI of the Terms of Reference:
1 . Contractors who are not under the contract may apply for the contractthey are subject to exclusion on the terms referred to in art. 24 sec. 1 and par. 5 points 1 and 8 of the Act, and meet the conditions for participation in the proceedings set out in points 2 - 4 below.
2. Condition for participation in proceedings related to competences or entitlements to conduct a specific professional activity: the Employer does not formulate specific requirements, stopping on the Contractor`s declaration on fulfilling the conditionsparticipation in the present proceedings.
3. Condition for participation in the proceedings regarding the economic or financial situation: the Employer does not formulate specific requirements, stopping on the Contractor`s statement on meeting the conditions for participation in the present proceedings
4. Condition for participation in the proceedings regarding technical and professional capacity: The contracting authority does not formulate specific requirements, just stopon the Contractor`s statement on fulfilling the conditions of participation in the present proceedings.
5. The Contractor may, in order to confirm compliance with the conditions of participation in the procedure, in appropriate situations and with regard to a specific order or part thereof, rely on the technical or professional abilities of other entities, regardless of the legal nature of the legal relationship he has with it.. The Contractor, which relies on the abilities or situation of other entities, must prove to the Employer that while performing the order, he will have the necessary resources of these entities, in particular by presenting the obligation of these entities to give him the necessary resources for the needs of the order. If the technical or professional capacity of the entity referred to in point5, do not confirm the Contractor`s fulfillment of the conditions for participation in the procedure or the exclusion basis for these entities, the Employer requests that the Contractor,
1) replaced the entity by another entity or entities or - 2) undertook to personally perform the relevant parts of the order, if it shows technical or professional skills about whichh referred to in item 4.
8. In order to confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion, the Contractor is required to submit a statement in the form of a single European order document (as specified in Commission Implementing Regulation (EU) 2016/7 of 5.1.2016). 9. The Employer provides a single document in the xml format generated from the eESPD website. Direct access to the Polish language version of eESPD is available at https://espd.uzp.gov.pl/
10. Contractor who refers to the resources of other entities in order to demonstrate the lack of grounds for exclusion and fulfillmentia, in so far as it relies on their resources, the condition of participation in the proceedings shall also be submitted by EEDs regarding these entities prepared in electronic form and signed by a qualified electronic signature by these entities, using means of electronic communication, ie by loading on the Platform.
11. In the event of a joint application by the Contractors, the EED has been preparedin electronic form and signed by a qualified electronic signature by persons authorized to represent a given Contractor, each of the Contractors jointly applying for the order shall submit using electronic means of communication, ie loading on the Platform. EAT confirms the lack of grounds for exclusion, as well as fulfillment of the conditions for participation in proceedings in the scope in which each of WShareholders demonstrate fulfillment of the conditions for participation in the proceedings.
12. The Contractor may use in the single document still valid information contained in another single document submitted in a separate procurement procedure. The Employer does not require a single document for the subcontractor if the Contractor does not rely on his resources in demonstrating the fulfillment of the conditionso participate in the proceedings
14. If the Contractor does not attach the required uniform document to the offer or the submitted single document is incomplete, contains errors or raises doubts, the Ordering Party will call the Contractor to supplement or provide explanations on the date indicated by him. The contracting authority may at any time during the procedure address any contractto submit all or some of the required declarations or documents confirming compliance with the conditions of participation in the proceedings or no grounds for exclusion, if this is necessary to ensure the proper course of the proceedings. The ordering party shall call the Contractor whose bid has been the highest rated before submitting the order, to submit within the prescribed period, not the numberthan 10 days, valid as of the date of submitting declarations or documents confirming the circumstances referred to in art. 25 para. 1 of the Act
17. In order to demonstrate the absence of grounds for exclusion, the Contractor referred to in point 16 above shall submit to the Ordering Party`s request the following statements and documents:
1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14, 21 of the Act, issued not earlier than 6 months before the deadline for submitting bids;
2) certificate of the competent head of the tax office confirming that the Contractor is not in arrears with paying taxes, issued not earlier than 3 months before the deadline for submission of offers, or other document confirming that the Contractor has entered into an agreement with the competent authoritiesm tax on the repayment of these receivables together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or suspension in full of the decision of the competent authority; - 3) certificate of the relevant organizational unit of the Social Insurance Institution or Funds Agricultural Social Insuranceit or another document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of these receivables together with possible interest or fines, in particular he obtained predicteda) an excerpt from the relevant register or from central records and business information, if separate regulations require an entry in the register or records, in order to confirm the right to dismiss, defer or split into installments of overdue payments or suspend in full the decisions of the competent authority; no grounds for exclusion under Art. 24 sec. 5 point 1 of the Act;
