The subject of the order is a consultation service in the use of the SAP ERP system to solve problems reported by system users and a training service (workshop and stationary) in the use of the SAP ERP system

1. The contract may be applied to Contractors who they are not subject to exclusion based on the premises specified in art. 24 par. 1 point 12 23 of the Act on Public Procurement Law and in art. 24 sec. 5 points 1, 4-8 of this Act if they occurred in the periods specified in art. 24 sec. 7 of the Act on Public Procurement Law and fulfill the conditions for participation in the procedure - 2. Conditions for participation in the procedure - Contractors applying for the subject contract should meet the conditions in accordance with art. 22 ust. 1b of the Act on Public Procurement Lawin order to confirm the possession of the necessary authorizations to perform a specific activity or activity. The Contractor should demonstrate that he is a party to the binding SAP Business All-in-One partnership agreement with SAP or one of the from its subsidiaries authorized to sign contractsrtnerskich in the above scope (not applicable to SAP Poland Sp. z o. o)

In the case of Contractors jointly applying for the award of the order, the above condition should be met by each Contractor.

3. List of statements and documents filed by the Contractor ™, whose offer will be assessed the highest in the proceedings at the request of the Ordering Party in order to confirm the circumstances referred to in art. 25 ust. 1 mouthpublic procurement law:

3.1. In the scope of confirmation of fulfillment of the conditions for participation in the proceedings:

1) the applicable partnership agreement in the scope of SAP Business All-in-One with SAP or one of its subsidiaries authorized to sign partnership contracts in the above-mentioned in the range

4. In order to confirm the absence of grounds for exclusion of the Contractor from participation in the proceedings, the Ordering Party will demand the following documents:

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the Act on Public Procurement Law and on conviction for offenses for custody in the scope specified by the Employer pursuant to art. 24 sec. 5 points 5 and 6 of the Act on Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

2) certificatesproper head of the tax office confirming that the Contractor is not in arrears with payment of taxes issued not earlier than 3 months before the deadline for submission of bids or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the prescribed rightm release, postponement or installment of overdue payments into installments or suspension of the entire implementation of the decision of the competent authority; 3) certification of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security contributions or health - highttated no earlier than 3 months before the deadline for submission of bids or other document confirming that the contractor has concluded an agreement with the competent authority regarding repayment of such receivables with possible interest or fines, in particular has obtained the legally required exemption, postponement or spreading into installments of overdue payment or suspension of the entire implementation of the decision- 4) excerpt from the relevant register or central register and information on economic activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion pursuant to art. 24 sec. 5 point 1 of the Public Procurement Law,

1. The contractor should show thatis insured against civil liability in the scope of business activity related to the subject of the order for a guarantee sum not less than PLN 500, 000.

In the case of Contractors jointly applying for the order, the above condition may be met by one Contractor or jointly by all Contractors jointly applying for granting forspeech.

2. In the scope of confirmation of fulfillment of the conditions for participation in the proceedings, the Contractor will submit a document confirming that the Contractor is insured against civil liability in respect of the business related to the subject of the order for a guarantee sum in an amount not lower than PLN 500, 000

1.On the offer, each Contractor should attach current on the day of submitting bids forbenefits referred to in art. 25a of the Public Procurement Law in the scope confirming the fulfillment of the conditions for participation in the proceedings, which also includes a statement on the lack of grounds for exclusion from the proceedings.

1.1. The contractor submits the above-mentioned statements in the form of a single document prepared in accordance with the standard form set out in the implementing regulation of the European Commission(EU) 2016/7 of 5.1.2016 (Journal of Laws EU No. L 3/16 of 6.1.2016) establishing a standard form for a single European order document in electronic form, in accordance with the Instructions described in point 3.4. below. The Employer makes available the template of the Uniform European Order Document, hereinafter referred to as "EAT", which constitutes Annex No. 1 to the ToR (in pdf and editable version in xml format)-generated from the eESPD website). 1.2.Information contained in EED will be a preliminary confirmation that The Contractor is not subject to exclusion and meets the conditions for participation in the procedure. 2. The offer submitted by the Contractor should be made in accordance-with the Offer Form included in Chapter III of the ToR and should contain a document containing the password for access to the EJF file and, if necessary, other information for correct access to EAT, in particular information about the encryption program used or the procedure of decrypting data contained in EAT;

3 . The offer should be accompanied by:

3.1.licenses in the case of signingand offers by persons whose authorization to act on behalf of the Contractor does not result from the document, the Register of the Contractor, which the Employer may download by using a free, publicly available database indicated by the Contractor (the obligation to indicate the address of the database does not apply to contractors from Poland). The Contractor shall submit the power of attorney in the original or a copy certified by a notary public;

3.2. In the case ofmembers of jointly applying for a contract - information on the appointment of a representative to represent them in the public procurement procedure or representation in the proceedings and conclusion of a public order contract in writing;

3.3. the obligation of the entity on which the Contractor relies on the principles set out in art. 22a of the Public Procurement Law - in writing;

3.4. In the event of the Contractor intending to entrust the execution of a part of the order to subcontractors - indication by the Contractor of these parts of the order. The names of the subcontractor's companies are given in the MARK

Supplemented information on the documents to item III.1.1):

5) the Contractor's statement that he has not been the subject of a final court decision or final administrative decision on defaulting on the payment ofallowances, fees or social security or health insurance premiums or in the event of issuing such a verdict or decision documents confirming payment of such receivables with possible interest or fines or conclusion of an ongoing agreement on repayment of such receivables; - 6) Contractor's statement about the lack of a ruling against him as a preventive measure to prohibit the application-for public orders;

7) the Contractor's statement on the lack of a final conviction of a conviction court for violation of liberty or a fine to the extent specified by the awarding entity pursuant to art. 24 sec. 5 points 5 and 6 of the Public Procurement Law Act,

8) a statement of the Contractor about the lack of a final administrative decision on the breach of obligations under the law-labor law, environmental protection law or social security regulations to the extent specified by the awarding entity on the basis of art. 24 sec. 5 point 7 of the Public Procurement Law Act,

9) the contractor's statement on not paying taxes and local fees, referred to in the Act on Local Taxes and Fees
