The subject of the contract is the accident insurance service for members of the voluntary fire brigade and youth fire teams of the city Rybnik. Behindinsurance coverage includes:

1. The Purchaser reserves that the number of insured persons, TSO and MDP units specified in the specification may be subject to change. The Contractor is obliged to take insurance cover from 15.1.2020 persons and units / teams as at 14.1.2020, according to unit rates and contributions in accordance with the submitted offer. During the year szThe number of firefighters for additional personal insurance may increase by about 30-40 persons

2. Insurance documents (policies) will be issued to the Ordering Party, who will be the policyholder and the premium payer.

3. Insurance documents (policies) will be issued for annual periods, and in the case of additional insurance, until the end of each policy year.

4. The insurance premium will be payable once, within 30 days from the date of receipt by the Employer of insurance documents (policies).

5. The Contractor accepts the issuing of policies for a period shorter than 1 year, with the premium being calculated to the day for the actual protection period, according to annual rates in accordance with the submitted offer, without applying the minimum premium from the policy. In relation to any insurance, the Contractor shall waive one hundredthe minimum premium from the policy.

6. The Contractor performing the service will provide insurance protection on the conditions set out in the Terms of Reference and in accordance with the submitted offer.

7. General or specific insurance conditions, which are used by the Contractor (valid as at the date of submission of bids) and which are indicated in the document confirming the insurance cover (policy) apply only inWestia not regulated in the ToR and the contract. If the general or specific insurance conditions applied by the Contractor do not provide for the required scope of protection, it is assumed that it will be extended and adapted to the requirements of the Terms of Reference and the contract by way of additional provisions. Only such provisions of the general and specific insurance conditions are considered permitted which do not conflict with the requirementsspecified in the ToR and the contract.

8. Throughout the entire duration of the contract, the Contractor guarantees that the general and specific insurance conditions remain unchanged. An exception to this rule will be admissible in the case of changes in applicable law, in which these changes will apply to the provisions of insurance contracts.

9. Throughout the entire duration of the contract, the Contractor guarantees that the terms remain unchanged, annual rates and contributions resulting from the offer submitted.

10. The Contractor accepts the issuing of policies for a period shorter than 1 year, with the premium calculated according to the "Pro rata temporis" principle (each commenced month is considered full), according to the rates in accordance with the submitted offer, without applying the minimum premium.

11. Introduction to insurance coverage of limits or sub-limits for compensationother or additional than those specified in the ToR are not allowed.

12. In the event that the general or specific insurance conditions provide for the refusal or limitation of the payment of compensation or the limitation or suspension of insurance coverage due to the failure by the Employer or the insured to meet the obligations listed therein, they shall not apply if they are notwas not guilty of intentional guilt or had no effect on the occurrence or extent of the damage. The above shall also apply to the Contractor`s failure to provide or delay the transfer of relevant information related to the insurance contract.professional, if it results from separate regulations, the Contractor will meet the condition, if he has valid documents confirming the possession of an authorization to perform insurance services or other equivalent entitlement, which determines the right to provide insurance services covered by the subject of the order.

The contractor whose offer is the highest rated to demonstrate complianceiania above condition of participation in the proceedings will be requested to submit the following statements and documents (current as at the date of submitting the statements or documents): current documents confirming the Contractor`s possession of an authorization to perform insurance services or other equivalent entitlement, which determines the right to provide insurance services covered byotem orders.

1. The Employer will exclude the Contractor from the proceedings in the cases referred to in art. 24 paragraph 1 point 12 23 of the PPL Act

2. Employer, in accordance with art. 24 aa of the Public Procurement Law, will first evaluate the offers and then examine whether the Contractor whose bid was assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation instępowaniu.

3. The contractor whose bid is highest rated will be invited to submit within a specified period, not shorter than 10 days, the date valid as at the date of submitting the statements or documents confirming:

1) the circumstances referred to in art. 25 paragraph 1 (valid as at the day of submitting the statements and documents):

a) information from the National Criminal Record in the scope specified in art. 24paragraph. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of bids;

b) the Contractor`s statement that he has not issued a final court judgment or the final administrative decision regarding arrears with the payment of taxes, fees or social security contributions or health or in the event of such a verdict or documentary decision being confirmedthose who pay these debts together with any interest or fines or conclude a binding agreement on the repayment of those debts;

c) the Contractor`s statement that no decision has been issued against him as a preventive measure forbidding public procurement.

4. The Contractor within 3 days from the date of posting on the website the information referred to in art. 86 section 3 of the Public Procurement Law, provides the Employer with a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the Public Procurement Law.

5. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland (hereinafter: the Republic of Poland), instead of the documents referred to in point 3 point 1 lit. andsubmits information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the Contractor has its registered office or place of residence, or the place of residence of the person to whom the information or document relates, to the extent specified in art. 24 paragraph 1 point 13, 14 and 21.

6. Documents referred to in point 5, should be issued not earlier than 6 months before the offer submission deadline.

7. If in the country in which the Contractor has its registered office or place of residence or place of residence the person to whom the document relates does not appear the documents referred to in item 5, they shall be replaced by a document containing the Contractor`s statement, indicating the person or persons authorizedto his representation, or a statement of the person to whom the document was to be submitted, lodged before a notary public or before a judicial, administrative or professional or economic self-government body competent for the seat or place of residence of the Contractor or the place of residence of that person. The provisions of item 6 shall apply. Contractor based in the territory of the Republic of Poland, in relation toa person residing outside the territory of the Republic of Poland, to whom the document referred to in point 3 point 1 lit. a, submits the document referred to in item 5 to the extent specified in art. 24 paragraph 1 points 14 and 21 of the Act. If, in the country in which the person to whom the document is intended to reside, does not seem such documents, it is replaced by a document containing the statement of that personbefore a notary public or before a judicial, administrative or professional or economic self-government body competent for the place of residence of that person. The provisions of item 6 shall apply.

1. The documents or statements shall be submitted in the original in the form of an electronic document or in an electronic copy of the document or declaration certified as true copies. authenticationThe compliance with the original is made by the Contractor, the entity whose capabilities or the situation relies on the Contractor, the Contractor jointly applying for the award of the public contract or the subcontractor, in the scope of documents or statements which each concern. Certification for compliance with the original of an electronic copy of the document or declaration is made using qualificationselectronic signature.

2. For section IV.2.6: the offer is binding for 60 days.

3. All settlements related to the implementation of the order will be made in PLN.

4. When evaluating the offers, the Employer will be guided by the following criteria:

- criterion I price 60%,

- criterion II optional conditions 40%.

5. The offer consists of the following documents:

- offer form,

- fform of the single European order document. This document constitutes a preliminary confirmation of the absence of grounds for exclusion and fulfillment of the conditions for participation in the proceedings,

- power of attorney submitted in the form of an original or notarized copy with a qualified electronic notary signature in the situation:

1) Contractors jointly applying for the award of the contracteniu art. 23 of the Act (civil partnerships / consortia) power of attorney to represent all Contractors jointly applying for the contract. A proxy may be appointed to represent Contractors in proceedings or to represent in proceedings and to conclude a contract;

2) sign the offer or other documents submitted with the offer by a person for whom the right totheir signing does not result directly from the document confirming the Contractor`s legal status (e.g. excerpt from the National Court Register) power of attorney to sign the offer,

- in the case of a bid security other than cash submitted in the form of the original (i.e. a document with a qualified electronic signature by guarantor).

6. Each offer must be secured by a security deposit ofPLN 300.00 (three hundred zlotys).

7. The contractor submits the offer in electronic form via the form to submit, change, withdraw the offer or application available on ePUAP and also made available in the miniPortal. The public key necessary for the Contractor to encrypt the offer is available to the Contractors on the miniPortal.
