The contract, divided into 2 lots, pursuant to art. 1 paragraph 4 of the L.R. n. 33/2007, relates to the assignment of the insurance coverage service for liability risksto Civil to Third Parties and to Operators in favor of the following Entities: ASST Crema, ASST Fatebenefratelli Sacco.

Pena the exclusion from the procedure as essential elements of the offer, the concorrent must satisfy the following conditions:

a) registration for activities related to the subject of this contract in the C.C.I.A.A. or in the register of provincial craft commissions in accordance with the provisions of paragraph 3 of art. 83 of Legislative Decree 50/2016;

b) the existence of the reasons for exclusion pursuant to art. 80 Legislative Decree no. 50/2016 (in the case of R.T.I. or Consortia see how muchestablished in the Tender Regulations);

c) possession of the authorization to carry out insurance activities, in the national territory, in the risk branch covered by this tender pursuant to Legislative Decree no. 209/2005 and s.m.i. or equivalent documentation for companies of other countries U.E.;

d) possession of a stock exchange listing or, alternatively, possession of an S&P rating equal to or greater than BBB (or rating equivalent issued by another listed rating agency, by way of example and not limited to Moody`s Baa2, Fitch Rating BBB) or alternatively possession of equivalent documentation certifying a level of financial solvency equivalent or higher than a S&P rating equal to or greater than BBB (or an equivalent rating issued by another listed rating agency, for exampleMoody`s Baa2, Fitch Rating BBB).

Pena exclusion from the procedure as an essential element of the offer, each competitor (according to the form in which it competes and in compliance with the indications of the Tender Regulations) must satisfy the following conditions:

a) have achieved a premium collection value (gross) over the last three financial years (2018/2017/2016), relating to the Non-Life Division excluding (Land 10 RC Land vehicles and Branch 3 Land vehicles branch) at least equal to the value indicated in the paragraph of the Tender Regulations (Turnover A);

b) have realized a premium collection value (gross), in the last three financial years (2018/2017/2016), relating to the insurance coverage of the RCT / O risk in the health fieldand assistance (public or private) at least equal to the value indicated in the paragraph of the Tender Regulations (Turnover B).

1) The tender procedure is managed with the Telematic system called Sintel, accessible from the website www.arca.regione .lombardia.it. Description and method of use for the presentation of the offer are specified in the Tender Regulations, relative Annexes and buttechnical data available at www.arca.regione.lombardia.it.

2) The annexes to the Technical Specifications will be provided exclusively upon presentation of a specific request, which must be received in accordance with the methods indicated in the section of the Tender Regulations, no later than the deadline of 2.00 pm on 10.24.2019. For reasons of confidentiality of the information contained therein, the annexesThe technical specifications cannot be downloaded from the section on the Sintel platform or from the sites referred to in point I.1).

3) Information regarding the service subject to entrustment; the methods of presentation and the elements for evaluating the offers; the three-year value (gross of government taxes), corresponding to the overall starting price which cannot be exceeded penalty esclusione; the award criteria, subcontracting, additional grounds for exclusion and other information are contained in the Tender Regulations and attachments. The Contract (policy) that will be entered into by the Entity will have a duration of 36 (thirty-six) months.

4) The modalities of participation in case of temporary grouping of companies, aggregations between companies adhering to the network contract, coasssetup and consortium are regulated in the Tender Regulations.

5) Participation by competitors in one of the control situations referred to in art. Is not permitted. 2359 of the civil code or in any relationship, even de facto, if the control situation or the relationship:

i) involves that the offers are attributable to a single decision-making center,

ii) has infon the formulation of the offer. Competitors for whom it is ascertained that the relative offers are attributable to a single decision-making center, on the basis of unambiguous elements, will also be excluded from the tender.

6) Partial and / or conditional bids are not admitted as specified also in the Tender Regulations and Attachments.

7) The competitors, with the presentation of the offers, allow theprocessing of personal data, also personal, pursuant to Legislative Decree no. 196/2003 s.m.i., and EU Regulation 2016/679 for insolvency and contractual requirements.

8) Information and clarifications on the tender documents can be requested according to the procedures indicated in the Tender Regulations, within and not beyond the deadline of 10.24.2019 time: 14:00 The clarifications to the tender documents will be communicated / publishedati with the procedures set out in the Tender Regulations.

9) For the modalities of carrying out the auditing and inspection activities, which may be carried out by each competitor subject to an expression of interest that must be received exclusively through the "Communications of the procedure" function on the Sintel platform no later than 12:00 of 10.16.2019, please refer to the Specifications ofrace.

10) The competitors must indicate, at the time of submitting the offer, the elected domicile for sending notices acknowledging that they will be sent by ARCA with the methods indicated in the Tender Regulations.

11) The contract (policy) that will be stipulated by the Entity with the contractor does not provide for the arbitration clause.

12) The Sole Manager of the Procedureand Dr. Carmen Schweigl.

13) Subcontracting is allowed up to the maximum limits of the percentage and other conditions set by art. 105 of Legislative Decree 50/2016.

14) Participation in this procedure is permitted for one or more lots thereof.

15) The Selection Committee pursuant to art. 77 Legislative Decree 50/2016 will consist of a number of commissioners equal to 3.
