Replacement of meters for direct measurements of electricity for the areaof the District of Energy Białystok City 14, 900 1-phase meters and 2, 500 3-phase meters in accordance with Annex 1 to the ToR

The Employer does not set special conditions in this respect

1. Contractors are excluded from the procedure on the basis of:

a) Art. 24 paragraph 1 point 12 23 of the PPL Act, subject to art. 133 section 4 lipsPPL (i.e. with the exception of Article 24 (1) (13) (d) of the Public Procurement Law and Article 24 (1) (14) of the Public Procurement Law, if the person referred to in this provision has been convicted of an offense listed in Article 24 paragraph 1 item 13 letter d of the Public Procurement Law), and also subject to art. 138c paragraph 1 point 5 of the Public Procurement Law (i.e. with the exception of Article 24 paragraph 1 point 15 of the Public Procurement Law) and

b) Art. 24 paragraph 5 points 1 and 8 of the Public Procurement Law,

Note: In accordance with the authorization arising from art. 138c paragraph 1 item 5 of the Public Procurement Law, the Employer reserves the right to waive the obligation to exclude Contractors from the proceedings in relation to which the conditions for exclusion referred to in art. 24 paragraph 1 point 15 of the Public Procurement Law

1.1. Contractor who is subject to exclusion pursuant to art. 24 paragraph 1 points 13 and 14 and 1620 or paragraph 5 points 1 and 8 of the Public Procurement Law, may present together with the offer evidence that the measures taken by him are sufficient to demonstrate its reliability, in accordance with art. 24 paragraph 8 of the Public Procurement Law

1.2. The Contractor is not subject to exclusion if the Employer, taking into account the weight and special circumstances of the Contractor`s act, deems sufficient evidence provided by the Contractor pursuant to point 10.2.2. SIWZ.

1.3. In the cases referred to in art. 24 paragraph 1 point 19 of the Public Procurement Law, before excluding the Contractor, the Employer will provide the Contractor with the opportunity to prove that his participation in the preparation of the contract award procedure will not distort competition.

2. The contractor in order to pre-confirm the fulfillment of the conditions for participation in the procedure, demonstrate the lack of grounds for exclusion and purposeconfirmation that the supplies or services offered meet the requirements specified by the Employer, submits:

2.1. The Contractor`s statement made on the basis of art. 25a section 1 and 2 of the Act of 29.1.2004 Public Procurement Law regarding non-exclusion and compliance with the conditions for participation in the proceedings in the form of a single European order documentestablishment (hereinafter EAT), in accordance with the implementing regulation EC (EU) 2016/7 of 5.1.2016 establishing the standard form for the single European procurement document (Journal of Laws of the European Union of 2016, No. 3, p. 16) An example of the document is Annex 2 to the ToR;

2.2. EAT subcontractors, if the Contractor intends to entrust the performance of part of the contract to subcontractors in accordance with point 8 of the ToR, in cto demonstrate that there are no grounds for being excluded from participating in the proceedings;

2.3. EAT other entities, if the Contractor relies on the resources of these entities, in order to demonstrate the absence of grounds for exclusion and compliance with the conditions of participation in the proceedings, to the extent that it refers to their resources;

2.4. EAT each of the Contractors in case of joint applicationfor order. This document confirms the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the procedure and no grounds for exclusion;

2.5. Documents that the Contractor will have the necessary resources to the extent necessary to properly perform the contract, in order to assess whether the relationship between thea contractor with these entities guarantees real access to their resources, in particular the obligation of these entities to make available to them the resources required for the implementation of the contract, the document should be submitted in the original on the form constituting Annex 5 to the ToR.

3. To confirm the circumstances referred to in art. 25 paragraph 1 point 1 Public Procurement Law, the Contractor, at the request of the Employer, submits the documents specified in point 12.2.3 of the ToR.

4. To confirm the circumstances referred to in art. 25 paragraph 1 point 3 Public Procurement Law, the Contractor, at the request of the Employer, submits the documents specified in point 12.4 of the Terms of Reference.
