The subject of the Order is a service consisting in reconstruction of the switchgear protection system for PGE GiEK S.A. Branch Power Plant Opole. A detailed description of the subject of the order is attached as Annex 1 to the ToRdescription of the subject of the order together with attachments.

The subject of the Order is the service consisting in reconstruction of the switchgear protection system for PGE GiEK S.A. Branch Power Plant Opole. A detailed description of the subject of the order is attached as Appendix 1 to the Terms of Referenceon orders with attachments.

Contractors who are not subject to exclusion under Art. 24 sec. 1 (excluding point 13 (d) and paragraph 5 point 1 of the Public Procurement Law. The Contractor, confirming compliance with the conditions for participation in the procedure and demonstrating the absence of grounds for exclusion, is obliged to submit with the offer, valid as at the date of the offert the statement referred to in art. 25a para. 2 of the Public Procurement Law, in the form of a single European order document, hereinafter referred to as "EAT", and the file must be provided with an electronic signature in accordance with the provisions described in point 17 of the ToR. Information contained in the EO is a preliminary confirmation that the Contractor is not subject to exclusion and fulfills the conditions for participation in The Contractor who appoints pfor the resources of other entities, in order to demonstrate the absence of grounds for exclusion and fulfillment to them, to the extent that they refer to their resources, the condition of participation in the proceedings, also submits the EMS regarding these entities in electronic form in accordance with the provisions described in point 16 Terms of Reference. In the event of a joint application by the Contractors, EAT shall be submitted by each of the Contractorjointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates no grounds for exclusion from the proceedings. Ordering party before sending an invitation to participate in an electronic auction (pursuant to Article 26 paragraph 2f of the Public Procurement Law), and in the absence of grounds for conducting auelectronically before ordering (pursuant to Article 26 paragraph 1 of the Public Procurement Law), in order to confirm the lack of grounds for exclusion from the proceedings, call the Contractors whose Offers are not subject to rejection, to submit the following statements and documents confirming the lack of grounds for exclusion of the Contractor from participation in the proceedings): - information from the National Criminal Record inthe scope specified in art. 24 sec. 1 item 13 - 14 of the PPL Act, subject to art. 133 ust. 4 of the Act (concerning: natural persons, board members, members of supervisory boards, proxies, partners of public and partner companies, general partners in the limited partnership or limited joint-stock partnership) issued not earlier than 6 months before the deadline for submission of tenders,

- information from the National Rejcriminal ester in the scope specified in art. 24 sec. 1 point 21 of the Public Procurement Law (information should refer to collective entities) issued not earlier than 6 months before the deadline for submitting bids,

- a copy from the relevant register or from the Central Register and Information on Economic Activities, if separate regulations require entry in the register or records, to demonstrate the lack of grounds forexclusion based on art. 24 sec. 5 point 1 of the Public Procurement Law Act

In the case of joint application for awarding orders by 2 or more Contractors, the said documents are submitted separately by each Contractor - In the case of the Contractor using resources of another entity under the conditions specified in art. 22a of the Public Procurement Law, these documents are submitted by each of these entities. Note: Documents about whichwa above. submitted at the request of the Employer, must be valid as of the date of their submission.

1. Contractor, within 3 days of posting on the website information on the opening of offers referred to in Article 86 par. 5 of the Public Procurement Law, submits to the Ordering Party a declaration of belonging or non-affiliation to the same capital group referred to in art. 24 sec. 1 point 23 of the Public Procurement Law. withwhen submitting a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure. The model statement will be made available to the Contractors on the Employer`s website together with the information referred to in art. 86 par. 5 Public Procurement Law. Each of the Contractors jointly applying for the award shouldseparately make a statement on belonging to or not belonging to the same capital group.

2. The ordering party defines the requirements related to the execution of the order pursuant to art. 29 para. 3a of the Public Procurement Law Act:

2.1 The Contractor, assuming the order to be executed, will ensure that among persons directly involved in the execution of the contract, they are employed on the basis of an employment contract (in accordance withrt. 22 -1 and art. 25 -1 of the Labor Code, Dz.U. from 2018, item 917, as amended.) Persons:

- performing design-related activities,

- performing activities related to assembly work,

- performing activities related to post-assembly tests and commissioning work

2.1. In the case of employing a new person performing the above-mentioned activities in the mode referred to in point 10.3.1. SIWZ, employment should take place no later than 7 calendar days from the date of commencement of contract performance and continue uninterrupted throughout the period of contract performance. In the event of termination of the employment of the person employed by the Contractor or Subcontractor before the end of this period, the Contractor will be obliged to work within 7 calendar days (counting from the day of cessation of one hundredwork) for this place of another person in the mode referred to in point 10.3.1. Terms of Reference.

3.
