The subject of the order is the construction of 1 MW net electricity storage for PGE GiEK S.A. Oddział Elektrownia Bełchatow.

The subject of the order is the implementation of the Task: "Execution of 1 MW net electricity store in PGE GiEK S.A. Branch of the Bełchat-w Power Plant "according to the" turnkey "principle, which means that all activities leading to the receipt of a ready-to-use warehouse are on the part of the Contractor.There is, among others: - execution of designs (construction, execution and as-built), - implementation of deliveries,

- execution of construction works,

- assembly,

- commissioning,

- service training,

- preparation of operating instructions; - ensuring optimal conditions for technical cooperation with the Implementer of the research program, without prejudice to the warranty conditions granted to the Ordering Party by Wa contractor for electricity storage.

A detailed description of the subject of the order is attached as Annex 1 to the SETC

1. Contractors, who are not subject to exclusion pursuant to art. 24 sec. 1 item 12-23, subject to art. 133 ust. 4, and are not subject to exclusion pursuant to art. 24 sec. 5 point 1 of the Act of 29.1.2004 Public Procurement Law (Journal of Laws no018, item 1986 unified text), further Public Procurement Law

2. In order to demonstrate the absence of grounds for exclusion, the Contractor is obliged to submit (documents must be submitted in relation to: the contractor, each contractor jointly applying for the award of the contract, entities on whose resources the contractor relies on the principles set out in Article 22a of the PPL Act) :

2.1. along with the offer, valid for the dayfor submission of offers a statement in the form of a Single European Order Document (EED) prepared in accordance with the standard form provided for in the European Commission Implementing Regulation issued on the basis of art. 80 par. 3 of Directive 2014/25 / EU, and the file must be marked with an Electronic Signature, in accordance with the provisions described in point 16 of the SIWZ. Information included in the declarationand u are preliminary confirmation that the Contractor is not subject to exclusion.

2.2. at the request of the Employer:

2.2.1. Information from the National Criminal Record in the scope specified in art. 24 sec. 1 item 13-14 of the PPL, subject to art. 133 ust. 4 Public Procurement Law,

2.2.2. Information from the National Criminal Record in the scope specified in art. 24 sec. 1 point 21 of the Public Procurement Law,

2.2.3. A copy from the relevant register orfrom central records and information on business activities, if separate regulations require entry in the register or records,

2.2.4. Contractor's declarations regarding: - - failure to issue a final court judgment or final administrative decision regarding default of taxes, fees or social security or health insurance premiums, or in the event of such a provisionthe eye or decision of documents confirming the payment of these receivables together with any interest or fines or the conclusion of a binding agreement on repayment of these debts, - absence of a ruling against him as a precautionary measure prohibiting applying for public orders, - non-payment of taxes and local fees referred to in the Act of 12.1.1991on taxes and local fees (Journal of Laws of 2016, item 716).

2.3. within 3 days of posting information on the website referred to in art. 86 par. 5 of the Public Procurement Law, the Economic Operators shall submit without a request: - A declaration on belonging to or lack of belonging to the same capital group as referred to in Article 24 para. 1 point 23 of the Public Procurement Law. Along with submitting the Statement, the Contractor may pprovide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure.

3. If the Contractor is established or resides outside the territory of the Republic of Poland, instead of the documents referred to in:

3.1. point. 2.2.1. and 2.2.2. above, he shall provide information from the relevant register or, in the absence of such a register, another estimatea document issued by a competent judicial or administrative body of the country in which the Contractor has its registered office or place of residence or a person who is the subject of the information or document, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 of the Public Procurement Law,

3.2. point. 2.2.3. above, he lodges a document or documents issued in the country in which the Contractor is based or place of orderscalls, confirming, respectively, that its liquidation has not been opened and that bankruptcy has not been announced.

Other requirements regarding submitted documents have been included in pt. 12 of the SIWZ.

1. The offer is made, under pain of nullity, in electronic form and is provided with a qualified electronic signature.

2. In the event that the Contractor joins as an attachment to the Offer a copy of a document, kthis option should be confirmed as conforming to the original by the Contractor. If the copy submitted by the Contractor is illegible or raises doubts as to its authenticity, the Contracting Authority may request the submission of the original or a notarized copy of that document.

3. Documents or statements referred to in the Regulation shall be submitted in the original in the form of a documentelectronically or in an electronic copy of the document or statement certified as true copy.

4. The attestation of compliance with the original is made by the Contractor, the entity whose ability or situation is the Contractor, contractors jointly applying for a public contract or Subcontractor, in the scope of documents or statements that each of them relates toCZA.

5. Certification of compliance with the original of an electronic copy of the document or statement referred to in point 16.8. above, is carried out using a qualified electronic signature.

6. The Employer may request presentation of the original or a notarized copy of documents or statements referred to in the Regulation only if the submitted copy is illegible ordoubt about its truth.

7. Documents or statements referred to in the Regulation, drawn up in a foreign language are submitted together with a translation into Polish.

8. Information and requirements concerning the proceedings are available on the Ordering Party's website.

9. The period of being bound by the offer referred to in section IV.2.6 shall be 60 days from the expiry of the time of submissiona. Offers

The Contractor may, in order to confirm the fulfillment of the condition of participation in the Proceeding, in appropriate situations and in relation to the Order, or its part, rely on technical or professional abilities, regardless of the legal nature of the legal relationships that it has with them. The Contractor, who relies on the abilities of other entities, must prove to the Employer that by realizing withAmending will have the necessary resources of these entities, in particular presenting the commitment of these entities to provide them with the necessary resources for the needs of the order.

12. The Contractor assures that in his activity he will comply with all applicable laws and the provisions of the above documents, in addition he shall exercise due diligence so that his employees, associates, subcontractors or persons with whom he will provide services comply with the provisions of. documents.
