Information and formalities necessary for evaluating if requirements are met :

1) Bidders, third parties and subcontractors should notis found in the situations provided by art. 164, 165, 167 of Law no. 98/2016. The way by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted at the requestcontracting authority, only by the bidder placed on the 1st place in the interim ranking made at the completion of the evaluation of the tenders. These documents may be: certificates of absence of overdue debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) valid at the moment of presentation. They willfiled with the DUAE the following documents: firm commitment of the third party to support the way in which its support, subcontracting agreement and / or association agreement will materialize, as the case may be. Failure to do so with the DUAE is a basis for requesting clarification of any inadvertent form of information contained in the Sectthe DUAE, both of the tenderer / candidate and of the subcontractor / third supporter, this being necessary to ensure the proper conduct of the award procedure, 2) the judicial record of the economic operator and of the members of the administration, management or supervisory body of the respective economic operator, or those having the power to represent, dcontrol or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, valid at the time of presentation. The DUAE will be completed, and the supporting documents demonstrating the assumptions made by the DUAE will be submitted only by the bidder ranked first in the intermediate rankings drawn up at the completion of the tender evaluation at the requestof the contracting authority; 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016; 4) Statement regarding non-compliance with the provisions of art. 59 of Law 98/2016 on Public Procurement (avoidance of conflict of interests)regarding the personnel of the contracting authority involved in the awarding procedure:
