Mode of accomplishment:

The DUAE will be filled in by the economic operators (leader, associate, -supporting party) Participants in the award procedure.

Incorporation in the situations stipulated in art. 164, 165, 167 of Law no. 98/2016 on public procurement entails the exclusion of the tenderer from the procedure applied for awarding the public procurement contract.

The supporting documents proving the fulfillment of the undertaken by completing the DUAE form are to be presented, the request of the contracting authority, only by the first ranked bidder in the interim ranking made at the completion of the tender evaluation. These documents are:

1) certificates of absence of overdue debts, regarding the payment of taxes, taxes or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation;the judicial authority of the economic operator and the members of the management, management or supervisory body of the respective economic operator or of those having the power of representation, decision or control within the economic operator as it results from the certifying certificate issued by the ONRC / act constituent; 3) as the case may be, documents proving that the economic operator pprovided that they benefit from the derogations provided for in Art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

Turnover annual average targeting activity over the last 3 years (2015, 2016, 2017). Will be filled in by the economic operators participating in the award procedure (bidder / affiliate / subcontractor)(a) For the calculation of the equivalence, the annual average RON / currency exchange rate communicated by the National Bank of Romania for each year shall be applied; (b) For non-resident economic operators, to the extent where the publication of balance sheets is not provided for by the law of the country of origin / country in which the economic operator is established, then that(c) When a group of economic operators submits the joint offer, the economic and financial capacity is demonstrated by taking into account all the resources of the economic operator, members of the group, (d) If the bidder was set up or startedeconomic activity of less than 3 years, account shall be taken of the submission of information corresponding to the actual period of activity.

The DUAE form must be submitted with the tender, subject to the rejection of the latter as unacceptable, according to art. 137 par. (2) lit. b) from H.G. no. 395 / 2016.

The way of placing the first place with the same price: If-two or more offers are placed first, the contracting authority requests the tenderers a new financial proposal and the contract will be awarded to the tenderer whose new financial proposal has the lowest price - art. 138 par. (2) of H.G. no. 395/2016. The request for clarification will be transmitted through the S.E.P. The new financial proposal will be transmitted via intermthe S.E.A.P.
