The subject of the order is the delivery of promotional materials for the Voivodship of Małopolska.

2. The description of the subject of the order (OPZ) is contained in Annex 3 to the ToR.

3. The terms of order fulfillment are contained ine of the contract template constituting Annex 4 to the ToR.

4. If in the descriptions there are: names of trademarks, patents or origin, this should only be treated as an aid in describing the subject of the order. In any case, acceptable products are acceptable in terms of use, materials, functionality, construction, etc.

I. Conditions for participation in the proceedings and grounds for exclusion of the contractor, -including those referred to in art. 24 sec. 5 acts

1. Contractors, who:

1) may not be excluded under the provisions of art. 24 sec. 1 of the Act and art. 24 sec. 5 point 1 and point 8 of the Act;

2. Contractors jointly applying for the award should appoint a representative to represent them in the proceedings or represent them in the proceedings and conclude the contract ine of the public order (the offer must be accompanied by a proper power of attorney), unless in the case of a civil partnership, the company's contract results in the manner of representing it (to determine what it will be necessary to attach a civil partnership to the offer). All correspondence and settlements will be made only with the acting entity as the representative of the remaining ones. The offer must be onisana in such a way that it legally obliges all entities acting jointly. The Contractors jointly applying for the contract bear joint and several liability for the performance of the contract.

II. List of statements or documents confirming compliance with the conditions for participation in the proceedings and no grounds for exclusion - Purchaser in accordance with art. 24aa of the Act, informs that it will first evaluate the offers, andthen it will examine whether the Contractor whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure - II.1) Statements and documents submitted with the offer:

1. The contractor should enclose with the offer the valid statement on the form of the Single European Order Document (hereinafter referred to as the EAT declaration), which isr is Attachment No. 2 to Siwz. - The information contained in the statement of EED is a preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure. The Employer shall attach the form JEDZ / ESPD in .xml format as Attachment 2 to Siwz and inform that in order to complete it, the attachment should be downloaded from the Ordering Party's website (BIP), save on-disk, and then import and supplement through the JEDZ / ESPD service available at:

The EAT form should be handed over to the Ordering Party in a way referred to in point VIII.1 siwz. Please note that the ESPD service does not archive files.

2. Instructions for completing the EAT are provided on the following website https: //www.uzp.gov.pl/baza-wiedzy/jednolity-europejski-dokument-zamowienia.

3. In the case of joint application by contractors for the order, the declaration of JEDZ shall be submitted by each of the contractors jointly applying for the order.

4. In the event that the Contractor is represented by the Proxy together with the offer, a power of attorney should be submitted for that person specifying its scope. The power of attorney should be signedby persons authorized to represent the Contractor.

5. All powers of attorney should be attached to the offer in the form of an original or officially certified copy of the power of attorney (notary public Article 96 of the Act of 14 February 1991 on Notary Public Law (consolidated text, Journal of Laws of 2014, item 164, as amended)).

II .2) Declaration on belonging or not belonging to the same groupcapital dust:

1. In order to confirm the absence of grounds for exclusion of the contractor from participation in the proceedings, the contracting authority requests the contractor's declaration of affiliation or lack of belonging to the same capital group; in the case of being part of the same capital group, the contractor may submit together with the statement documents or information confirming that connections with another contractor will not be carried outto distort competition in the proceedings.

2. Contractor, within 3 days of placing by the Employer on the website information referred to in art. 86 par. 5 of the Act, is obliged to provide the Employer with the statement referred to in para. 1

3. The statement is made in the original.

4. Model statement along with the information referred to in art. 86 par. 5 of the Act, will be posted by the Employer on the website on which Siwz was posted along with attachments.

II.3) Statements and documents confirming the circumstances referred to in Art. 25 ust. 1 submitted to the ordering party's request:

1. The contracting party will call to submit usexempting documents:

1) confirming no grounds for exclusion from participation in the proceedings:

a) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

b) certificate of the competent head of the tax office confirming that the contractor is not in default of paying taxes, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponed or spread into installments overdue payments or full suspension inperforming the decision of the competent authority, c) certificate of the relevant organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of offers or other documconfirming that the contractor has entered into an agreement with the competent authority regarding the repayment of such claims together with any interest or fines, in particular it obtained the legally required exemption, deferral or installment payment of overdue installments or suspension of the full implementation of the decision of the competent authority; d) excerpt from proper register or from the Central Register and Information aboutEconomic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Act, - e) the Contractor's statement that he has not issued a final court judgment or final administrative decision on his inability to pay taxes, fees or social security or health insurance premiums, oro in the event of such a judgment or decision being issued, documents confirming the payment of such claims together with any interest or fines or a binding agreement on repayment of these debts,

f) the contractor's statement on the lack of a ruling against him as a preventive measure for the prohibition of applying for public orders, g) the contractor's declaration of non-admission-with the payment of taxes and local fees, referred to in the Act of 12.1.1991 on taxes and local fees (Journal of Laws of 2016, item 716). e-g are included in Annex No. 5 to SIWZ;

1. Before the deadline for submitting bids, the contractor is obliged to submit a bid bond, for the duration of the binding period in the amount of: PLN 5, 000 in words: five thousand PLN.2. The Ordering Party allows changes to the provisions of the concluded contract in relation to the content of the offer, on the basis of which the Contractor was selected on the terms contained in the contract.
