1. PThe object of this order is the modernization of the waste sorting line at the Municipal Waste Neutralization Plant Orli Staw 2, 62-834 Cekow as part of the Project Modernization of ZUOK Orli Staw as the Regional Recycling Center. Main Site: Municipal Waste Neutralization Plant Staw ", Orli Staw 2, 62-834 Cekow, POLAND.

Order subject

1) Execution of the projectat the technological target modernization of municipal waste sorting installations in the modernized existing and planned new hall, taking into account all three modernization stages.

2) Preparation and handing over to the Employer of construction guidelines for the planned hall, resulting from the technological project, regarding the execution of construction works to adapt existingj sorting hall and designing a new sorting hall (both this project and its construction works are not included in the scope of this order will constitute a separate contract). 3) Verification of construction, executive or branch designs developed within the framework of the separate proceedings conducted by the Employer 4) delivery of brand new equipmenttechnological process specified in the Technological Project in stage I. All equipment in accordance with OPZ.

5) Assembly of complete technological equipment, in accordance with the Technological Project approved by the Contracting Authority.

6) Designation and permanent marking of communication and transport routes (roads and pedestrian crossings) within hall

7) Replacement of the entire existing drum sieve 80/200 mm for the 80/340 mm drum sieve

8) Modernization of the existing 20mm drum cartridge / drum.

9) Reconstruction of the conveyor system of feeders and receivers in the area of the existing 80/200 mm drum sieve to adapt to the new technological functions defined in OPZ.

10) Reconstruction of chutes in existing sorting cabins, as in the requirements for new sorting cabins.

11) Equipment of the installation with new bag amusement and P002 channel conveyor in place of existing and P006, P301, P302 conveyors, and the system of loading of the composting fraction including elements 201AF001, 202AE001, 203AF001, instead of existing ones

12) Selection and assembly of equipment, assembly and organization and coordination of all works in the scope of delivery, assembly and commissioning of complete modifications

13) Execution of local power supply installation from the places of their supply made by the contractor of a new sorting hall to technological equipment of waste sorting plant

14) The implementation of a new control and visualization system for the entire technological line after modernization includes both now and nowadmitted devices.

15) Execution of the installationand technological dust removal of the ballistic separator and optoelectronic sorter of SO1TS plastics and other places necessary for the correct operation of the installation with the possibility of connecting to the existing system in the existing sorting hall.

16) Production of CCTV system for the entire technological line after modernization

17). Preparation of the commissioning documentation and expStart-up and commissioning of a complete modernized waste sorting line

19) Preparation of operating instructions for the waste sorting line

20) Carrying out starts and trainings

21) Taking over the warranty and technological responsibility for a complete modernized waste sorting line with a new one control and visualization system.

22) Marking of machines anda set of machines (modernized line) with CE mark and data identifying the producer and machine.

23) Providing complete warranty service

24) Providing warranty service with reaction time

25) Preparing and submitting to the Ordering Party the studies related to the scope of the order, in order for the Contractor to obtain the arrangements, opinions and permits requiredlegal regulations, including construction law and environmental protection necessary to complete the investment process and commence the operation of a complete, modernized sorting line, with the exception of the integrated permit, which will be obtained by the Contracting Authority in cooperation with the Contractor.

26) Delivery of a package of quickly consuming parts.

The Ordering Party will consider that the Contractor will comply with this-condition regarding the economic or financial situation, if it shows that:

1) has reached the minimum turnover in the area covered by the contract (ie design, delivery, assembly and commissioning of complete municipal sorting installations mixed and collected selectively completed with reception) for the last three financial years, and if the period of business is shorter, then for this period - innot less than PLN 15, 000, 000.00.

and

2) has financial resources or creditworthiness in the amount not less than PLN 10, 000, 000.00,

and

3) is insured against civil liability in respect of conducted activities related to subject to the order for a guarantee sum of min. PLN 15, 000, 000.00

1. Contractors who do not belong to you can apply for the contractkey and meet the conditions for participation in the proceedings. The contractor is excluded from the contract award procedure in respect of which any of the circumstances referred to in Article 24 sec. 1 item 12-23 and art. 24 sec. 5 points 1), 4) and 8) of the Public Procurement Law. The Awarding Entity does not provide for any other grounds for exclusion from the proceedings. The exclusion takes into account the wording of art. 24 sec. 7 and other provisions of the PPL act. In the scope of demonstrating the lack of grounds for exclusion, referred to in art. 24 sec. 1 item 23 of Public Procurement Law, the Contractor is obliged to submit a statement on belonging to or lack of belonging to a capital group within 3 days from posting information on the website of the Employer, referred to in art. 86 par. 5 Public Procurement Law. The Contractor may submitthe statement referred to above with the offer in case it does not belong to any capital group, which will be reflected in the content of the submitted statement. However, it should be remembered that any change in the Contractor's situation during the proceeding (inclusion in the capital group) will result in the obligation to update such a declaration on the part of the Contractor.

2. Ordering party, according to-Art. 24 aa paragraph 1 of the Public Procurement Law, will first evaluate the offers, and then examine whether the Contractor, whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings. The complete offer must include:

a) The offer form together with the Technical offer,

b) The Contractor's statement in the form of EAT,

c) the relevant Power of Attorney in the event that the authorizede to sign the contract does not result directly from the current excerpt from the relevant register or CEiDG,

d) document (s) establishing the Proxy in the case of Contractors jointly applying for the order, - e) proof of payment of the bid bond,

f) the obligation of the third party - if applicable.

4. A detailed description of how to prepare the offer and how to perform the test and evaluation activitiesy of submitted offers is included in point 13 ID.

5. The ordering party, before the order is awarded, will call the Contractor whose offer will be the highest rated, to submit in the shorter than 10 days the current time as of the date of submitting the declarations and documents indicated in point. 9.15.1) -7) IDW confirming the circumstances referred to in art. 25 ust. 1 Public Procurement Laws

6. Rules for participation in the present proceedingscontractors jointly applying for the award of the contract are described in point 10 IDENTIFICATION

The Contracting Party requires the Contractor to indicate in the offer (if applicable) the part of the contract that the subcontractors will entrust to subcontractors and provide the subcontractor companies and recommends that the Contractor should provide gross value or% share of subcontracting, if these companies and ranges are known at the stage of offer submission . sthe final rules for the participation of subcontractors in the execution of this order are set out in - 9 of the template agreement on the implementation of this order. The Contracting Party stipulates that the Contractor may entrust Subcontractors with not more than 40% of the value of the Contract related to this order.

8. The Employer allows the transmission of correspondence, i.e. statements, applications, notifications and information through mediationem of the postal operator within the meaning of the Act of November 23, 2012 Postal Law (ie, Journal of Laws of 2017, item 1481), in person, via a messenger, via fax or using means of electronic communication within the meaning of the Act of on 18.7.2002 on the provision of electronic services (ie the Journal of Laws of 2017, item 1219), taking into account the formal requirements established byh in point 13 IDW and subject to point 24 IDW

9. The Contractor is obliged to submit a tender bond in the amount of 650, 000.00 PLN (in words: six hundred fifty thousand 00/100) before the deadline for submitting bids.
